Abstract

The implementation of the General Election and Local Leader Election (Pilkada) requires the cooperation of numerous parties. One of them is by involving all community groups to be involved in supervision at every stage. Community involvement in elections is not only manifested in the form of people coming to polling stations and exercising their right to vote. One of the Election Supervisory Agency's (Bawaslu) mission is to encourage community-based participatory supervision. However, before reaching election supervision, community involvement in guarding democracy must first go through a process of socialization and the transfer of knowledge and skills in election supervision. The Participatory Monitoring Village is one of the national priority programs for participatory supervision that is being developed by the Election Supervisory Agency (Bawaslu) in West Java, where there is a group of people with the same area and concern for the progress of democracy and identical pioneering the monitoring village movement. The participatory monitoring village activities are comprised of two major components: the Citizens' Forum and Face-to-face Socialization by delivering materials on democracy, elections and participatory supervision. The community participates in the follow-up to these activities by monitoring and reporting fraud to the Election Supervisor.

Abstract

Pemilihan Serentak Tahun 2020 diselenggarakan pada saat pandemi Covid-19 belum mereda. Esensi penyelenggaraan Pemilihan tersebut adalah melakukan pembatasan sosial dalam setiap aktifitas pelaksanaan tahapannya. Tantangan bagi Bawaslu dalam mengawasi Pemilihan adalah menyelamatkan jajaran penyelenggara dan Pengawas Pemilihan dari potensi penularan Covid-19 dengan rapid test dan penggunaan alat pelindung diri, menyelamatkan pemilih dengan penerapan protokol kesehatan ketat dan penyediaan bilik khusus di TPS, serta menyeimbangkan standar tata laksana pengawasan dengan standar protokol kesehatan Covid-19. Bawaslu telah menetapkan strategi pengawasan dengan beradaptasi pada keadaan “new normal” melalui prosedur pengawasan tatap muka secara langsung didalam ruangan, prosedur pengawasan tatap muka secara langsung diluar ruangan, prosedur pengawasan pengumpulan orang dalam jumlah tertentu, serta prosedur pengawasan penyampaian dan penyimpanan berkas. Dua hal yang menjadi fokus dalam setiap kegiatan pengawasan adalah mencegah kerumunan dan penerapan protokol kesehatan secara ketat. Dengan mendasarkan pada penerapan protokol kesehatan, Pengawas Pemilihan telah diberikan kewenangan khusus memberikan peringatan hingga pembubaran kegiatan kampanye Peserta Pemilihan yang melanggar protokol kesehatan. Hasilnya, 206 peringatan tertulis telah disampaikan oleh Pengawas Kecamatan di 8 (delapan) Kabupaten/Kota dan 1 (satu) pembubaran dilakukan.

Abstract

Personal Data Protection is normatively regulated in the provisions of Law Number 27 of 2022, with the enactment of these provisions it should be a solution to problems that arise in the election oversight process, especially the election law enforcement process. The concept of personal data protection is important, especially with regard to Supervision of the Registration and Verification Stages of Election Contestants, Compilation of Voter Lists and Voting. In this stage it is closely related to the privacy of personal data and the personal dignity of a person to hold information and how this information is used. With the enactment of the concept of personal data protection in election supervision, it should be able to strengthen the position of election supervisors in preparing more technical legal instruments to prevent and deal with alleged election violations.
