Abstract

The purpose of this study is to get an idea of how the principles in Islamic and modern government systems compare, both similarities and differences. Researchers use descriptive-qualitative research. Data obtained through literature reading, analyzed and critically compromised for further narrative description. This research uses descriptive-qualitative analysis, data and information about matters related to this research are studied, reviewed, classified carefully, then the analysis process is carried out by deduction, the analysis process takes place continuously from beginning to end with the aim of finding answers to the rumplations of problems carried by the research.  Based on the analysis of this research data concludes that  the leader in the early Islamic and contemporary government system is a powerful and influential figure, the establishment of the State of Medina on the basis of the agreement of diverse nations, this is the same as the establishment of many countries in the world today, the State of Medina is a state of law because it has a Medina Charter or Medina Constitution,  as many countries in the world declare as State of law. Muhammad as a central figure has always been open in accepting the opinions of others for the benefit of the country, his style of government is fiber with domocracy. Muhammad also at one time became the leader of the State as well as the leader of the government and had full authority just like  the current presidential system of government.

Abstract

Tujuan penelitian ini mengetahui tata cara pelaksanaan ritual pra nikah di Desa Air Meles Atas Kecamatan Selupu Rejang Kabupaten Rejang Lebong dan bagaimana pandangan hukum Islam terhadap ritual pra nikah. Adapun metode penelitian yang digunakan dalam penelitian kualitatif. Dari penelitian yang dilakukan maka penulis mendapatkan hasil penelitian bahwa pelaksanaan ritual pra nikah di Desa Air Meles Atas Kecamatan Selupu Rejang Kabupaten Rejang Lebong terdiri dari puasa, wakaf, ziarah kubur dan genduren. Tidak ada dalil mengenai semua ritual yang dilakukan masyarakat Desa Air Meles Atas sebelum nikah. Namun ada yang tetap boleh dilakukan dan ada juga yang tidak boleh. Ritual yang tetap boleh dilakukan seperti puasa, wakaf dan ziarah kubur. Karena puasa dan ziarah kubur merupakan tradisi yang baik, sedangkan wakaf untuk kemaslahatan orang banyak. Adapun ritual yang tidak boleh dilakukan adalah ritual genduren. Karena di dalam pelaksanaannya terdapat sajen yang dipersembahkan untuk Dewi Padi yang diyakini sebagai Dewi penjaga beras pada saat acara pernikahan nanti. Dalam Islam sendiri ini termasuk menyekutukan Allah dan termasuk dosa besar apabila tetap dilakukan.

Abstract

The purpose of this study is to find out what are the implementation of contemporary waqf investment models, then solve how Islamic law views the implementation of contemporary waqf investment and review in detail how the principles and signs of shari'ah for control of the implementation of contemporary waqf investment. This research is a descriptive-qualitative research. Data obtained through literature reading, analyzed and critically compromised for further narrative description.  The primary object of this study is the text, which in turn what is contained in the text will be reviewed in depth with the methodology of taking Islamic law. This research uses descriptive-qualitative analysis, data and information on matters related to this research are studied, reviewed, classified carefully, with the aim of finding legal provisions and principles of control over research problems. Based on data analysis, this study concludes that contemporary waqf investment law is permissible with various provisions according to the investment pattern applied. The sharia principle for contemporary investment control is that the form of investment must be in accordance with sharia and invested in lines that do not contradict the shari'a, should invest in various lines to reduce the possibility of losses that occur, written and officially written and insured with sharia insurance, investment must not conflict with the requirements of the waqf and not harmful to the benefit of the waqf itself.
