Abstract

This research aims to analyze the motives of political participation among coastal communities in the 2020 Makassar Mayoral Election, particularly in the Sangkarrang Islands Subdistrict. The research method employed is qualitative with a descriptive type. The informant selection technique used is nonprobability sampling with purposive sampling, where 6 informants were chosen based on specific criteria and their ability to answer research questions. The research findings indicate that political participation motives can be categorized into several factors, including intentionality, emotional factors, internal factors, external factors, and rational considerations. Intentionality arises from the understanding and awareness of individuals regarding the contribution they can make to the general election process. Meanwhile, emotional factors are related to personal relationships or shared identity, and in some situations, participation can be influenced by ethnic similarities and identity without coercion. Some individuals also engage in the election process due to emotional involvement with specific candidates. Motives for participation can also stem from social needs for communal leadership and external influences, such as political education organized by election organizers

Abstract

This research aims to determine the position of testimony from the victim's witness in proving Sexual Violence Criminal Acts based on Law No. 12 of 2022 concerning Sexual Violence Criminal Acts, and to identify the qualifications of valid evidence in proving Sexual Violence Criminal Acts based on Law No. 12 of 2022 concerning Sexual Violence Criminal Acts. This study adopts a normative research type with a statutory approach. The research results indicate that the position of the victim's witness testimony in proving sexual violence criminal acts is outlined in Article 25 (paragraph 1). The qualifications of valid evidence in proving sexual violence criminal acts are also outlined in Article 24 (paragraph 1), as regulated in Law No. 12 of 2022 concerning Sexual Violence Criminal Acts.

Abstract

This study examines the application of criminal law to the offense of joint murder, using the District Court of Parepare Decision Number 111/Pid.B/2020/PN.Pre as a case study. It explores how the panel of judges constructs their legal reasoning by connecting the facts established at trial, including witness testimonies, forensic evidence, and material exhibits, with the relevant provisions of the Indonesian Criminal Code, particularly Article 338 in conjunction with Article 55 paragraph (1) sub-paragraph 1. The research employs a normative legal method with a statute approach and case approach, relying on primary legislation (the Criminal Code and the Code of Criminal Procedure), court decisions, and scholarly literature on offenses against life and doctrines of criminal liability as its main sources of legal material.
