Abstract

This paper analyzes the fulfillment of the constitutional rights of women commercial sex workers and the responsibility of the State in fulfilling the constitutional rights of women commercial sex workers in Bendan Sari, Pekalongan City. This empirical juridical research uses a qualitative approach. Collecting data using observation, interviews and literature study. The analysis uses an interactive model. The results show that the constitutional rights of women commercial sex workers in Bending Sari have not been fully fulfilled. For example, the right to a decent life, the right to health care and the right not to be discriminated against. This is due to the local government's rejection of their existence as Commercial Sex Workers, so they do not get the space and opportunity to fight for their rights. The responsibility of the state, in this case is the Pekalongan City government to fulfill the constitutional rights of Women Commercial Sex Workers in Bendan Sari carried out by prevention and guidance to them through social services by providing training and business capital. The aim is that the female commercial sex workers who have been trained have the skills and willingness not to return to work as sex workers, so that they can continue to live a better, decent and healthy life. In addition, to protect the rights of citizens, in this case the community in the vicinity of the Bendan Sari prostitution area.

Abstract

The Law of the Republic of Indonesia Number 27 of 2022 Concerning Personal Data Protection contains provisions regarding the privacy data of children and persons with disabilities that are specifically regulated. The rules regarding the protection of personal data are important, especially in light of the rapid development of technology. The existence of Personal Data Protection Law must be motivated by the purpose of law as a tool to integrate and coordinate various interests in society by regulating the protection and limitations of these various interests. This study falls under the category of normative-juridical research, which employs prescriptive methods such as logic and legal reasoning. Using a statutory, philosophical, and conceptual approach, this study will examine the existing privacy regulations for children and persons with disabilities and the principles of protection and ideal rules regarding the privacy of children and persons with disabilities in the future. The results of the study show that there are still weaknesses in the protection of children's and persons with disabilities' data; all data on children and persons with disabilities tends to be at risk of being misused because there is still a legal vacuum regarding technical rules for protecting children's and persons with disabilities' data. Unfortunately, the Personal Data Protection Law does not regulate the "special" process in question. Furthermore, there is no definite age standard regarding the classification of children in the Personal Data Protection Law. The Personal Data Protection Law, which regulates the privacy of children and persons with disabilities, is not in accordance with the theory of legal protection and the theory of legal certainty.

Abstract

Artikel ini mengkaji bagaimana paradigma konstruktivisme Guba dan Lincoln dapat diterapkan untuk menganalisis penalaran hukum dalam putusan pengadilan pada kasus Ferdy Sambo, sebuah perkara pidana menonjol yang melibatkan pembunuhan berencana oleh seorang perwira tinggi Kepolisian Republik Indonesia. Pertanyaan penelitian utama yang diajukan adalah: bagaimana faktor sosial dan kontekstual membentuk konstruksi realitas hukum dalam putusan pengadilan melalui pendekatan konstruktivisme? Penelitian ini menggunakan pendekatan kualitatif dengan metode studi dokumen terhadap putusan pengadilan pada tingkat pertama, banding, dan kasasi. Paradigma konstruktivisme, yang menekankan relativisme dan konstruksi bersama atas makna, digunakan sebagai kerangka analisis untuk memahami bagaimana hakim menafsirkan fakta hukum dan membentuk narasi hukum. Hasil penelitian menunjukkan bahwa putusan hukum tidak sepenuhnya didasarkan pada norma hukum formal, tetapi turut dipengaruhi oleh persepsi hakim, tekanan opini publik, dan wacana institusional, sehingga membentuk realitas hukum yang bersifat sosial dan tidak sepenuhnya objektif. Studi ini menyimpulkan bahwa paradigma konstruktivisme dapat memperluas pemahaman terhadap keadilan. Namun, hal tersebut sekaligus mengungkap keterbatasan dalam pencapaian kepastian hukum dalam konteks perkara yang bersifat politis dan sarat perhatian publik. Abstract This paper investigates how Guba and Lincoln’s constructivist paradigm can be applied to analyze judicial reasoning in the case of Ferdy Sambo, a high-profile criminal proceeding involving premeditated murder by a senior Indonesian police official. The central research question posed is: how do social and contextual factors shape the construction of legal reality within court decisions in the Sambo case through a constructivist lens? Utilizing a qualitative, document-based analysis of court rulings at the district, appellate, and supreme court levels, this study examines how judges interpret legal facts and construct legal narratives. The constructivist paradigm, which emphasizes relativism and the co-construction of meaning, provides a framework to understand how legal decisions are influenced not only by statutory provisions but also by socio-political dynamics and institutional discourse. Findings reveal that legal judgments are shaped through multi-actor interactions, including judicial perception, media framing, and public sentiment, reflecting a socially constructed reality rather than a purely objective legal truth. This study concludes that while constructivist analysis offers a broader understanding of justice, it also highlights the inherent limitations in pursuing legal certainty within highly politicized and publicized legal contexts.
