Abstract

Salah satu tujuan dasar dari pemberantasan tindak pidana korupsi yaitu pengembalian kerugian keuangaan negara. Sudah banyak ketentuan-ketentuan dalam menangani tindak pidana korupsi itu sendiri, tapi pada kenyataannya belum berhasil secara optimal mengembalikan kerugian keuangaan negara. Tidak jarang yang melakukan tindak pidana korupsi itu hanya perorangan tetapi korporasi juga melakukan tindak pidana korupsi dengan berbagai modus operandi. Tulisan ini bermaksud untuk membahas tentang pengembalian kerugian negara yang disebabkan oleh tindak pidana korupsi yang dilakukan korporasi melalui konsep penerapan Deffered Prosecution Agreement (DPA). Tulisan ini membahas Eksistensi sistem pemidanaann terhadap korporasi pelaku korupsi di Indonesia. Tulisan ini juga membahas tentang penerapan konsep Deffered Prosecution Agreement dalam upaya pemberantasan korupsi oleh korporasi di Indonesia. Metode yang digunakan mendapatkan data yang diperlukan adalah metode penelitian kualitatif yang mengambil sikap kritis normatif dari wawasan atau keberadaan manusia dalam masyarakat serta mengkritik terhadap praktik hukum maupun dogmatik hukum. Penulisan ini menggunakan studi dokumen khususnya meneliti peraturan perundang-undangan serta buku dan jurnal yang relevan

Abstract

This article discusses the existence of women’s and children’s units. The Women and Children Unit is responsible for providing services in the form of legal protection for women and children as victims of crime and law enforcement against their perpetrators. At present, the child, as the perpetrator of other violations of the law, is investigated according to the field of violations committed by the child and not dealt with by the Women and Children Unit. The focus of this article is on how the position and authority of the Women and Children Unit are based on Regulation No. 10 of 2007 on the Organization and Organization of Women and Children Units, as well as the urgency of the reform of criminal law through the powers of the Women and Children Unit. The research method is the juris-normative study of law. The findings of the research show that the Women’s and Children’s Units were given authority on the basis of Article 11 of Capolri Regulation No. 3 of 2008. This rule provides special protection and treatment for children who commit certain criminal acts, both as victims and as perpetrators of certain crimes. The uncertainty of the Women's and Children's Units in the process of handling children in terms of the investigation of the child of a criminal offense caused a large number of children to be involved in the investigation and investigation process, which was carried out by adult investigators and not children. With the impact caused in the process of handling the child, the offender’s conduct is considered inappropriate or less relevant. The provisions on the treatment of children of perpetrators in the case of investigation and investigation of children should be reformulated so that the child is protected from the negative impacts that may affect the fulfillment of the objectives of the child criminal justice system.

Abstract

So far, the attention to protection given to children has focused more on children who are victims or witnesses of a crime, while attention as a child of a criminal offense during the case investigation process is still relatively lacking. The fact is that not all child investigators in the police have certification as child investigators, so not all investigators understand the human rights of children that must be obtained when a child becomes a perpetrator of a crime. The research method used is the normative juridical method through a statutory approach to reviewing the legal ratio of related laws. The results of the study found that the Certification Position of child investigators is regulated based on Presidential Regulation Number 175 of 2014 concerning Integrated Education and Training for Law Enforcers. Presidential Regulation Number 175 of 2014 requires the police to participate in Integrated Training and Certification Functions for Child Investigators in the Investigation of Child Crimes by the police so that child investigators have certain knowledge and skills according to the child's condition. The expertise of special child investigators can be proven by having a child investigator certificate. Considering that UUSPA itself provides special treatment for child crimes as mandated by Article 26 of Law no. 11 of 2012, the examination and investigation of children will also be given by special investigators

Abstract

Discussing that children is very important. The Protection of children in a nation's society is a benchmark for the nation's civilization itself. Therefore, all elements of society and components of the nation must strive so that children do not commit crimes or other disgraceful acts. Diversion efforts are carried out in every legal process by law enforcers, the Police, the Public Prosecutor, and the Court. In practice, diversion has not been tested for its effectiveness for 3 parties. This study examines the concept of diversion in the juvenile criminal justice system in Indonesia and diversion reformulation that reflects the principle of child protection. The method used in this research is descriptive analysis. The purpose of this study was to determine the concept of diversion in the juvenile criminal justice system in Indonesia and to reformulate diversion that reflects the principle of child protection. The results of this study are, the concept of diversion in the juvenile criminal justice system in Indonesia is a concept by diverting a case from a formal process to a non-formal process. The main principle of implementing the concept of diversion, namely persuasive action or a non-penal approach that provides an opportunity for someone (especially child) to correct mistakes and become a good person again. Reformulation of law enforcement against criminal acts committed by children should be carried out, of course by reforming the criminal law by revising regulations and Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, especially regarding diversion requirements, in the provisions of article 7 paragraph (2) letter (a) Law no. 11 of 2012 concerning Juvenile Justice System, with Article 9 paragraph (2).

Abstract

Penyalahgunaan narkotika merupakan salah satu tindak pidana yang dapat dilakukan oleh anak. Pada penerapannya ancaman pidana dalam Undang-undang Nomor 35 Tahun 2009 tentang Narkotika tersebut berlaku penuh bagi mereka yang sudah dewasa. Dengan tidak adanya dasar untuk memberikan sanksi lain selain dari apa yang ditentukan Undang-undang Nomor 35 Tahun 2009 tentang Narkotika tersebut, maka anak cenderung selalu diberikan sanksi pidana penjara. Ancaman pidana penjara pada pasal-pasal terkait yang mengakibatkan anak terampas hak kebebasannya. Penelitian ini dimaksudkan untuk menemukan jawaban tentang Apakah urgensi pemidanaan terhadap anak sebagai penyalahguna narkotika dan bagaimana Reformulasi pemidanaan terhadap anak sebagai penyalahguna narkotika. Dengan menggunakan metode penelitian yuridis normatif, penelitian ini menyimpulkan bahwa Reformulasi pemidanaan terhadap anak sebagai pelaku tindak pidana penyalahgunaan narkotika dalam sistem peradilan pidana anak sudah semestinya dilakukan terutama mengenai ketentuan sanksi pidana yang dapat mempengaruhi tercapainya tujuan pemidanaan terhadap anak yaitu dengan memperhatikan kepentingan terbaik bagi anak dengan tujuan menjamin perlindungan anak dalam menjalani ancaman pidananya agar anak terhindar dari dampak-dampak negatif dari pidana penjara.

Abstract

Artikel ini mengkaji bagaimana paradigma konstruktivisme Guba dan Lincoln dapat diterapkan untuk menganalisis penalaran hukum dalam putusan pengadilan pada kasus Ferdy Sambo, sebuah perkara pidana menonjol yang melibatkan pembunuhan berencana oleh seorang perwira tinggi Kepolisian Republik Indonesia. Pertanyaan penelitian utama yang diajukan adalah: bagaimana faktor sosial dan kontekstual membentuk konstruksi realitas hukum dalam putusan pengadilan melalui pendekatan konstruktivisme? Penelitian ini menggunakan pendekatan kualitatif dengan metode studi dokumen terhadap putusan pengadilan pada tingkat pertama, banding, dan kasasi. Paradigma konstruktivisme, yang menekankan relativisme dan konstruksi bersama atas makna, digunakan sebagai kerangka analisis untuk memahami bagaimana hakim menafsirkan fakta hukum dan membentuk narasi hukum. Hasil penelitian menunjukkan bahwa putusan hukum tidak sepenuhnya didasarkan pada norma hukum formal, tetapi turut dipengaruhi oleh persepsi hakim, tekanan opini publik, dan wacana institusional, sehingga membentuk realitas hukum yang bersifat sosial dan tidak sepenuhnya objektif. Studi ini menyimpulkan bahwa paradigma konstruktivisme dapat memperluas pemahaman terhadap keadilan. Namun, hal tersebut sekaligus mengungkap keterbatasan dalam pencapaian kepastian hukum dalam konteks perkara yang bersifat politis dan sarat perhatian publik. Abstract This paper investigates how Guba and Lincoln’s constructivist paradigm can be applied to analyze judicial reasoning in the case of Ferdy Sambo, a high-profile criminal proceeding involving premeditated murder by a senior Indonesian police official. The central research question posed is: how do social and contextual factors shape the construction of legal reality within court decisions in the Sambo case through a constructivist lens? Utilizing a qualitative, document-based analysis of court rulings at the district, appellate, and supreme court levels, this study examines how judges interpret legal facts and construct legal narratives. The constructivist paradigm, which emphasizes relativism and the co-construction of meaning, provides a framework to understand how legal decisions are influenced not only by statutory provisions but also by socio-political dynamics and institutional discourse. Findings reveal that legal judgments are shaped through multi-actor interactions, including judicial perception, media framing, and public sentiment, reflecting a socially constructed reality rather than a purely objective legal truth. This study concludes that while constructivist analysis offers a broader understanding of justice, it also highlights the inherent limitations in pursuing legal certainty within highly politicized and publicized legal contexts.

Abstract

The purpose of this study is to explore the urgency for a judicial review of the constitutionality of Indonesia's constitutional amendments. In addition, it explores, using Germany, Colombia, and India as comparative materials, the practice of judicial review regarding the constitutionality of constitutional amendments. The main writing approach used in this article, which examined the constitutional texts of Germany, Indonesia, Colombia, India, and Germany, was a comparative one. Similar provisions that are unchangeable explicitly or implicitly may be found in the constitutions of Colombia, Germany, India, and Indonesia. However, there are fundamental differences in efforts to protect, maintain and preserve these unchangeable provisions (as the fundamental structure and identity of the Constitution) in reviewing the constitutionality of constitutional amendments. This mechanism is practiced in India, Germany and Colombia but not in Indonesia. However, if studied carefully, 3 aspects show the urgency of implementing this mechanism in Indonesia: 1) historical aspects (the existence of past events regarding constitutional changes or transitions that are normatively unconstitutional; 2) philosophical and juridical aspects (the existence of Pancasila as state ideology as well as constitutional identity and the existence of Article 37 paragraph (5) which clearly states that the Form of the Republic of Indonesia cannot be changed); and 3) sociological aspects (the issue of constitutional amendments which seems to be patterned at the end of each president's term of office to extend the period of the president's term of office to three terms). These three aspects are the primary consideration and basis for implementing a mechanism for reviewing the constitutionality of constitutional amendments so that the fundamental structure and identity of the Indonesian Constitution are not damaged or eliminated by parliament through constitutional amendment activities.
