Abstract

Absolute power in the case of land objects was initially prohibited in accordance with the provisions of the Minister of Home Affairs Instruction Number 14 of 1982 concerning the Prohibition of the Use of Absolute Power of Attorney as a Transfer of Land Rights and Government Regulation Number 24 of 1997 concerning Land Registration. The use of absolute power can then be permitted in accordance with the provisions of the Letter of the Director General of Agrarian Affairs on behalf of the Minister of Home Affairs of the Republic of Indonesia Number 594/493/AGR dated 31 March 1982 and the Regulation of the Head of the National Land Agency of the Republic of Indonesia Number 10 of 2014 concerning the Revocation of Legislation Regarding Land. The purpose of this research is to explore the limits of absolute power that can or cannot be used in the case of land as an object of mortgage rights as an embodiment of legal certainty by referring toestablished rightwhile exploring the legal consequences. The type of legal research used is normative. The approach used in this research is statutory, conceptual and case regulations. The results of the research found that the limits of absolute power that can be used are inseparable from the main agreement which includes that all rights attached to the parties have been fulfilled. The grant of power cannot then be substituted. The legal consequences are attached to the agreement, namely that it can be canceled or null and void by law. Legal certainty regarding the use of absolute power has not yet been realized, because there are no explicit statutory regulations that regulate absolute power.

Abstract

Sengketa terhadap tanah garapan dimuat dalam Putusan No. 181/B/2020/PT.TUN. Penggugat dimenangkan karena telah terlebih dahulu memperoleh pengakuan Sertifikat Hak Milik (SHM), di sisi lain Tergugat II Intervensi mendapatkan SHM atas dasar penguasaannya terhadap objek sengketa dengan dasar penguasaan tanah garapan yang diakuinya dilakukan turun temurun. Penelitian dilakukan dengan tujuan untuk mengetahui dasar pertimbangan hakim dan akibat hukum dari putusan yang memenangkan Penggugat terhadap tanah garapan yang didalilkan Tergugat II Intervensi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Bahan hukum yang digunakan yaitu bahan hukum primer dan sekunder, kedua bahan hukum tersebut diperoleh melalui studi kepustakaan yang akan dianalisis secara deskriptif preskriptif. Hasil penelitian menemukan jika pertimbangan hukum yang digunakan sudah tepat karena tanah garapan seharusnya digunakan 3 tahun berturut-turut berdasarkan Pasal 9 PP No. 224/1961 sedangkan dari fakta yuridis tidak ditemukan Surat Izin Menggarap yang dimiliki oleh orang tua ataupun kakek dari tergugat II intervensi. Abstract

Chinese inheritance is regulated in Book II of the Civil Code on property, adhering to a closed system, meaning that no new articles or regulations are allowed other than existing ones. Inheritance assets left by the testator by law are transferred to the heirs without distinguishing between the gender of the heirs according to the law or by appointment as a will. Even though the first class of heirs can have their rights violated, only by law. Deviations are based on customary law as something that is contrary to the matters stipulated in Article 18B paragraph (2) of the 1945 Constitution. Wills can be given to anyone, including heirs, but are not allowed to harm the heirs' absolute rights according to the law. The provisions of Article 914 of the Indonesian Civil Code, if you leave four children as heirs, the full share of the heirs is three-quarters, if given as a whole, in contrast to the absolute right share known as the share that must be given to the heirs.
