Abstract

Abstrak: Diskursus negara Islam (Daulah Islamiayah ) di negara kita akhir-akhir ini boleh dibilang menjadi fenomena. Kecenderungan untuk menerapkan syariah Islam dalam negara atau pemerintahan merupakan gejala yang bukan hanya berkembang di indonesia tapi juga  di banyak negara Muslim, seperti Pakistan, Yordania, Sudan, Mesir, Maroko, Kuwait,  Iran, dan lain-lain. Munculnya  fenomena gerakan Islam (harakah Islamiyah ) mulai dari yang berskala internasional seperti gerakan ikhwanul muslimun ,jamaah Murabitun, Tanzibul Jihad, Hizbut Tahrir, sampai yang berskala lokal seperti DI/TII,NII, Jama’ah Muslimun (Jamus) dan yang lainnya merupakan follow-up dari upaya meralisasikan aturan syariat dalam negara ( sebut saja negara  Islam). Tulisan ini berusaha untuk mencari jawaban terhadap permasalahan-permasalahan yang muncul dari pandangan para pendukung dan penentang  negara  Islam  terkait dengan konsep negara syariah dalam sistem politik Islam      (Islamic State) , serta penerapannya dalam sistem negara-bangsa (nation state). Ada dua hal yang perlu digaris bawahi terkait hal ini yaitu (1) Apakah Islam memang berkaitan dengan penyelenggaraan negara dan (2) apakah politik Islam diarahkan untuk mencari dan mencapai konsesi kekuasaan, sehingga cita-cita Islam tercapai ?. Dalam upaya merelisasikan dan mewujudkan semangat politiknya  tidak jarang terjadi “ketegangan” antara kelompok yang ingin menerapkan syari’ah sebagai simbolisasi negara Islam dalam aturan-aturan pemerintahan dengan kelompok yang menentangnya. Dan tak jarang terjadi berbagai tindak kekerasan dan bahkan terjadi  kudeta terhadap pemerintahan yang sedang berjalan.Kata Kunci: Disparitas, agama, negara

Abstract

Abstract: This article discusses about the concept of justice in the perspective of the philosophy of Islamic law. Philosophically, there are two formulations of justice: first, the view that what is meant by justice is a harmony between the use of right and obligation are in line with the implementation of the proposition of “the balance of law” or “the dose of right and obligation”; second, the view of the lawyers who formulate that justice is a harmony between legal certainty and proportionality of law. Justice, in Islamic law, is derived from the Most Just. It is because Allah SWT is the upholder of justice, then He must be believed not to apply unjust to His servants. The concept of justice, based on al-Shatibi’s maqasid al-shari’ah theory, is determined by the benefits which are divided into three, namely daruriyyat (necessities), hajiyyat (needs), and tahsiniyyat (luxuries). This indicates that Islam is concerned with the issue of justice. The conception of justice will continue to evolve in line with the social development. Construction of law and justice in Islam cannot be separated from morality and transcendental beliefs since these aspects are intertwined.Keywords: Justice, philosophy, law, Islam.

Abstract

This field research highlights "The Mourning Period for Husband in Ngimbang Village under the Islamic Law and Islamic Law Compilation (KHI) Perspective". The focus of the discussion are to find out the mourning period for husband who left by his wife died in Ngimbang, Palang, Tuban and how the Islamic law and Islamic Law Compilation (KHI) perspective. The results of the research known that the limit of declaring the mourning period for husband in Ngimbang Village divided into two, namely the mercy of the mourning period and the propriety of husband to marry again. The mercy of the mourning period is for 4 months and 10 days, while the propriety to marry again is 1000 days. As for the period of mourning, a husband should avoid the things that can cause slander, except for important purposes. These provisions are the product of socio-cultural that have long been guarded and do not violate the rules of Islam namely to avoid any slander. It has also been justified by Article 170 paragraph (2) Islamic Law Compilation, which mentions: "Husbands left by their wives should do mourning period according to appropriateness and decency." Therefore, husbands who have recently been abandoned by their wives should carry out a mourning period according to the propriety of their respective societies.

Abstract

Di Indonesia  terdapat empat lingkungan peradilan, yaitu  peradilan umum, peradilan agama, peradilan tata usaha negara, dan peradilan militer. Masing-masing peradilan mempunyai kompetensi atau kewenangan sendiri yang sudah diatur oleh undang-undang. Dalam kedudukan kasus sengketa bisnis syariah di Indonesia memiliki keistimewaan dibandingkan dengan sengketa lainnya, dimana dalam kasus tersebut tiga lembaga peradilan yakni Peradilan Agama (PA), Peradilan Negeri (PN) dan Badan Abritase Syariah Nasional (Basyarnas) bisa digunakan sebagai sumber penegak hukum jika terjadi masalah sengketa. Dengan demikian masyarakat bisa memilih lembaga peradilan.

Abstract

This article emphasizes on contract law in islamic perspective. The important aspect about islamic economy is the aspect of transaction, in which contract is widely use in everyday economic activities. A transaction is an event in which a person commits to other person or in which two persons commits to implement a certain thing. From this event, a relationship appears between those two people. It is called a contract. A transaction creates a contract for people involved. Islamic banking in its operational puts forward values of islamic economy. It implies that islamic banking must complies on the implementation of norms of islamic law on contract. Before the amandment of the Law No.7/1989, the implementation of contract law in sharia financial institution referred to Civil Code which was basically translation of Burgerlijk Wetboek (BW), civil code of the Dutch Colonial authority since 1854. Consequently, the concept of islamic contract is not applicable. However, after the enactment of Law No. 3/2006 on the Revision of the Law No.7/1989 on Religious Court, the concept of islamic contract is applied and becomes the basis of business transaction of sharia financial institutions, especially islamic banking.

Abstract

The existence of Islamic banking system, with the different variant products, has its own legal implications particularly after emerging some disputes for the parties involved. The banking dispute is usually solved through the court. In this position, Court is to be a place to seek justice and resolve legal issues that arise. In addition, there is also an alternative of non-litigation settlement in Indonesia. Undang-undang Perbankan Syariah no 21 tahun 2008, which has provided the competence or authority to public courts in Islamic banking dispute resolution, has reduced the absolute competence of religious courts, in Undang-undang nomor 3 tahun 2006, it is very clearly mentioned that the religious courts have absolute competence in the field of economy of Islam, including the Islamic banking system. The Absolute authority of religious courts as defined in Undang-undang no 3 tahun 2006, in its application, is still potentially determined by choice of forum that can be done by the parties involved in contract

Abstract

Abstract: The use of CCTV as evidence in court is the result of technological advances. Furthermore, in criminal circumstances, CCTV footage can be used as solid evidence to prove someone's guilt. According to Islamic law, proof comes from the Arabic term al-Bayyinah, which means "the one who explains". One must be able to present valid shreds of evidence for evidence during the trial procedure. So both positive law and Islamic law regulate the use of CCTV. Therefore, the authors are interested in writing this paper which examines the use of CCTV as evidence in the context of positive law and Islam. This research is a normative juridical research where data is collected from statutes, books, and journals, as well as normative descriptive data.. Keywords: CCTV, Evidence, Positive Law, Islamic Law, Crime   Abstrak: Penggunaan CCTV sebagai alat bukti di pengadilan merupakan hasil dari kemajuan teknologi. Selanjutnya, dalam keadaan kriminal, rekaman CCTV dapat digunakan sebagai bukti kuat untuk membuktikan kesalahan seseorang. Menurut hukum Islam, pembuktian berasal dari istilah bahasa Arab al-Bayyinah, yang berarti “yang menjelaskan”. Seseorang harus dapat menyajikan potongan bukti yang valid untuk bukti selama prosedur persidangan. Jadi baik hukum positif maupun hukum Islam mengatur penggunaan CCTV. Oleh karena itu, penulis tertarik untuk menulis makalah ini yang mengkaji penggunaan CCTV sebagai alat bukti dalam konteks hukum positif dan Islam. Penelitian ini merupakan penelitian yuridis normatif dimana data dikumpulkan dari undang-undang, buku, dan jurnal, serta data deskriptif normatif. Kata kunci: CCTV, Alat Bukti, Hukum Positif, Hukum Islam, Tindak Pidana.

Abstract

Concurrent elections should not be injured by dissenting interpretations of Islamic Law in terms of its contextual connection to Positive Law. This research aims to delve into the connection between the norms of Islam and politics in Indonesia and the measures taken to bring about the harmony of religious norms within the political system of law in Indonesia. With a normative-descriptive approach, this legal research discovered that the legal objective is not restricted to justice, but it also takes into account legal certainty and merit. The discourse on justice often refers to two thoughts. John Rawls and Jürgen Habermas, within the scope of critical philosophy developed by Kant, attempted to seek the primary principles underlying social life. Concurrent elections 2024 in Indonesia refer to direct, universal, free, secret, genuine, and just principles. These principles serve as the basis for justice enforcement, especially in the fulfilment of the political rights of the citizens. The justice principle builds the harmonization of the norms that underlie elections with Islamic Law as the core soul of the elections. Participation in elections is understood as the exercise of the norms of Islamic law with the frameworks aiming to bring about the merit of the people as a whole. How do the principles of justice in the principles of elections intertwine with the principle of justice in Islamic law?
