Abstract

Tujuan penelitian menganalisis efektivitas perlindungan hukum terhadap anak sebagai pelaku tindak pidana pencurian (Studi Kasus Kepolisian Resort Wajo). Penelitian ini menggunakan metode penelitian empris, pengumpulan data dilakukan dengan Wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa: (1) Efektifitas perlindungan hukum terhadap anak sebagai pelaku tindak pidana pencurian di Unit PPA (Pelayanan Perempuan dan Anak) Kepolisian Resort Wajo kurang efektif dalam pemenuhan hak-hak anak dan Diversi yang kurang efektif dalam hal upaya restorative justice terhadap anak. (2) Faktor yang menjadi kendala perlindungan hukum yakni kurangnya pemahaman masyarakat terkait diversi terhadap anak sehingga gagalnya upaya diversi, personil penyidik khusus anak yang terbatas, orangtua anak sebagai pelaku tindak pidana pencurian tidak kooperatif, serta kurangnya sarana dan prasarana di Unit PPA Kepolisian Resort Wajo. The research objective is to analyze the effectiveness of legal protection for children as perpetrators of criminal acts of theft (Case Study of the Wajo Resort Police). This research uses empirical research methods, data collection is carried out by interviews and documentation. The results of this research indicate that: (1) The effectiveness of legal protection for children as perpetrators of criminal acts of theft in the PPA (Women and Children Services) Unit of the Wajo Resort Police is less effective in fulfilling children's rights and Diversion is less effective in terms of restorative justice efforts towards child. (2) Factors that become obstacles to legal protection are the lack of public understanding regarding child diversion resulting in the failure of diversion efforts, limited special investigator personnel for children, parents of children as perpetrators of criminal acts of theft who are uncooperative, as well as a lack of facilities and infrastructure at the Wajo Resort Police PPA Unit.
