Abstract

This article which in its writing uses normative research methods, using a statutory approach and a conceptual approach. The formulation of the problem in this research is: 1) What is the criminal responsibility of minors involved in committing criminal acts of terrorism ? 2) What is the legal protection for minors involved in committing criminal acts of terrorism? From the legal research that has been carried out using the research approach mentioned above, it can be concluded that in the first formulation of the problem regarding the criminal responsibility of minors who are involved in committing criminal acts of terrorism, that is, children cannot be held criminally responsible because not all of the conditions for the elements of guilt are met (cumulative). Meanwhile, the second problem formulation discusses the basic considerations for providing legal protection for children and the relevant and appropriate legal protection to be given to children involved as perpetrators of criminal acts of terrorism.

Abstract

This study examines the Military Court's legal process and authority in trying to resolve human rights violations committed by TNI personnel. Normative legal research is used with a legislative approach and a conceptual approach, which is then analyzed against laws and regulations related to the problem to determine which court has the authority to try the case. The analysis results show that the Military Court's rule is to try criminal acts committed by a soldier, who according to the law is considered equal to a soldier, and members of a group or position or agency are considered soldiers according to the law. Military courts in the military justice system, even though they are under the jurisdiction of a special court, namely the human rights court in the general justice system.

Abstract

Program pengabdian ini melibatkan serangkaian sosialisasi interaktif kepada para mahasiswa berbagai Fakultas di Universitas Muhammadiyah Ponorogo selaku dalam kelompok usia rentang yang mencakup materi tentang hak asasi manusia, perlindungan hukum, serta mekanisme pengaduan. Pendampingan hukum disediakan untuk membantu individu dalam menghadapi kasus-kasus yang berkaitan dengan hak-hak mereka. Melalui pendekatan yang inklusif dan berbasis komunitas, diharapkan kelompok usia rentan dapat lebih berdaya, teredukasi, dan mampu mengadvokasi hak-hak mereka secara efektif. Metode pelaksanaan dilakukan melalui tahapan mencari kasus keluhan masyarakat, penentuan kasus, perencanaan, pelaksanaan, evaluasi dan tindak lanjut. Hasil dari pelatihan dan pendampingan ini menunjukkan peningkatan signifikan dalam pengetahuan hukum peserta serta kemampuan mereka dalam mengakses dan memanfaatkan layanan hukum. Dengan demikian, program ini tidak hanya berkontribusi pada pemberdayaan individu, tetapi juga memperkuat masyarakat secara keseluruhan dalam upaya penegakan hukum dan keadilan sosial. Kata Kunci: pendampingan hukum, usia rentan, ekonomi AbstractThis community service program involves a series of interactive socialization to students of various faculties at the Muhammadiyah University of Ponorogo as an age group that includes material on human rights, legal protection, and complaint mechanisms. Legal assistance is provided to assist individuals in dealing with cases related to their rights. Through an inclusive and community-based approach, it is hoped that vulnerable age groups can be more empowered, educated, and able to advocate for their rights effectively. The implementation method is carried out through the stages of finding cases of community complaints, determining cases, planning, implementation, evaluation and follow-up. The results of this training and assistance show a significant increase in participants' legal knowledge and their ability to access and utilize legal services. Thus, this program not only contributes to individual empowerment, but also strengthens society as a whole in efforts to enforce the law and social justice. Keywords: legal assistance, vulnerable age, economy

Abstract

Sengketa terkait kepemilikan hak atas tanah seringkali muncul di masyarakat. Penelitian ini merumuskan dua masalah utama, yaitu: 1) Pengadilan mana yang memiliki kewenangan untuk menangani sengketa pertanahan? dan 2) Bagaimana tahapan penyelesaian sengketa pertanahan melalui proses litigasi? Penelitian ini menggunakan pendekatan normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa untuk masalah pertama, kewenangan pengadilan dalam menangani sengketa pertanahan bergantung pada beberapa faktor, seperti apakah substansi yang disengketakan terkait dengan hak atas tanah atau tidak, asal-usul penerbitan sertifikat (apakah deklaratif atau konstitutif), serta jenis perbuatan hukum yang mendasari penerbitan sertifikat tersebut, termasuk kualifikasi perbuatan hukum dan peraturan yang mendasarinya, serta subjek dan objek sengketa, dasar gugatan, dan tuntutan yang diajukan. Sedangkan untuk masalah kedua, proses penyelesaian sengketa melalui litigasi mengikuti ketentuan dalam Herziene Indonesisch Reglement (HIR) jika sengketa yang terjadi terkait dengan kepemilikan hak atas tanah (bezit), dengan dasar gugatan berdasarkan perbuatan melawan hukum (Pasal 1365 BW). Namun, jika sengketa berkaitan dengan pembatalan sertifikat tanah akibat adanya cacat administrasi yang merupakan keputusan tata usaha negara (beschikking), maka proses litigasi mengikuti prosedur hukum yang diatur dalam Undang-Undang No 5 Tahun 1986 tentang Peradilan Tata Usaha Negara.

Abstract

Article 9 Paragraph (1) of Law No. 31 of 1997 concerning Military Justice states that the military justice system has the authority to try criminal acts committed by a person who at the time of committing the crime, firstly because the subject is indeed a soldier; secondly because the subject can be equated by law as a soldier, and thirdly can also be a civilian because the decision of the Commander in Chief with the approval of the Minister of Justice must be tried by a Court within the military justice system. Meanwhile, in Article 5 and Article 6 of Law No. 46 of 2009 concerning the Corruption Court, the Corruption Court states that the corruption court is the only court that has the authority to examine, try, and decide on corruption cases whose prosecution is submitted by the public prosecutor and is emphasized in Article 6 of the Corruption Court Law that the corruption court in its authority examines, tries, and decides on special cases in corruption cases; money laundering crimes whose original crime is a corruption crime; and/or crimes that are expressly determined in other laws as corruption crimes. Looking at the provisions of the formulation of the two articles, it is not impossible that there could be a clash of authority if a TNI member commits a criminal act of corruption, whether it is the authority of the military court because it looks at it from the subject's side or it is the authority of the corruption court because it looks at it from the side of the crime committed, considering that the two courts are both special in terms of material and formal law. This research is of a normative juridical nature which uses a statutory approach, as well as a conceptual approach, where the results of this study show that if a criminal act of corruption occurs involving the TNI, based on the principle of lex specialis systematica (the specialness of the special), the TNI who commits a criminal act of corruption will still be tried and subject to the military court, and processed in accordance with the procedures in Law No. 31 of 1997 concerning Military Justice.

Abstract

This research addresses the legal ambiguity in determining jurisdiction over corruption crimes committed within Indonesia’s fisheries sector. Globally, both corruption and illegal fishing represent complex transnational crimes that demand clear legal enforcement. In Indonesia, two distinct legal frameworks intersect in such cases: the Fisheries Court established under Law No. 45 of 2009 and the Corruption Court under Law No. 46 of 2009. This study aims to analyze the jurisdictional conflict that arises when an act of corruption occurs in the fisheries sector, potentially falling under both courts’ authority. Using a normative juridical method, the research applies a statutory and conceptual approach by examining relevant laws, court decisions, and legal doctrines. The findings reveal that despite the dual specificity of laws, corruption crimes—even when committed in the fisheries sector—fall under the jurisdiction of the Corruption Court based on the principle of lex specialis systematica. This principle prioritizes legal norms that are systematically more specific in handling a particular offense. The study contributes to legal scholarship by clarifying the hierarchy and interaction of overlapping special laws in Indonesia’s legal system and provides practical implications for law enforcement agencies and the judiciary to avoid conflict of competence. Future research may explore comparative models in other legal systems for resolving similar jurisdictional overlaps.

Abstract

Indonesia merupakan negara maritim dengan luas perairan mencapai 3.257.483 km2 yang mengandung sumber daya perikanan yang melimpah, tentunya dengan luas perairan tersebut, dimungkinkan rawan terjadi praktek illegal fishing yang dilakukan nahkoda kapal beserta anak buah kapal berbendera Indonesia atau berbendera asing di wilayah pengelolaan perikanan Republik Indonesia. Dalam Pasal 71 Undang-Undang Nomor 45 Tahun 2009 tentang Perikanan telah membentuk Pengadilan Perikanan sebagai pengadilan khusus di lingkungan peradilan umum sebagaimana dalam Pasal 27 UU Kekuasaan kehakiman di samping pengadilan hak asasi manusia, pengadilan tindak pidana korupsi, pengadilan niaga, pengadilan hubungan industrial serta pengadilan anak yang berwenang untuk memeriksa, mengadili dan memutus tindak pidana illegal fishing. Lalu timbul masalah apabila tindak pidana illegal fishing dilakukan dengan melibatkan seorang anak buah kapal yang masih anak dibawah umur. Pasal 24 Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, bahwa anak yang melakukan tindak pidana bersama-sama dengan orang dewasa atau anggota Tentara Nasional Indonesia diajukan ke pengadilan anak, sedangkan orang dewasa atau anggota Tentara Nasional Indonesia diajukan ke pengadilan yang berwenang, sehingga bukan tidak mungkin terjadi konflik kewenangan mengadili mengingat kedudukan pengadilan perikanan dan pengadilan anak sama sama pengadilan khusus di lingkungan peradilan umum. Dengan menggunakan pendekatan perundang-undangan dan konseptual diperoleh bagaimana karakteristik dari pengadilan perikanan sebagai pengadilan khusus dalam memeriksa perkara tindak pidana illegal fishing serta apakah pengadilan perikanan sebagai pengadilan khusus berwenang untuk mengadili tindak pidana illegal fishing yang dilakukan oleh anak dan pendekatan kasus untuk mengupas kasus yang terdapat dalam putusan pengadilan yang akan ditelaah. Ketentuan pidana dalam UU Perikanan tentu berlaku bagi anak pelaku tindak pidana illegal fishing sehingga tunduk pada pengadilan perikanan, persidangannya pun dilakukan di pengadilan perikanan, karena pada prinsipnya pengadilan perikanan dan pengadilan anak merupakan pengadilan khusus yang berada dalam satu tempat dan lingkup yang sama yakni di peradilan umum sekaligus sebagai prinsip efisiensi, namun karena anak pelaku tindak pidana illegal fishing ini masih dibawah umur proses pemeriksaan maupun persidangannya tetap mengacu pada prinsip-prinsip Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak agar hak-hak mereka sebagai anak tetap terpenuhi.
