Abstract

This article which in its writing uses normative research methods, using a statutory approach and a conceptual approach. The formulation of the problem in this research is: 1) What is the criminal responsibility of minors involved in committing criminal acts of terrorism ? 2) What is the legal protection for minors involved in committing criminal acts of terrorism? From the legal research that has been carried out using the research approach mentioned above, it can be concluded that in the first formulation of the problem regarding the criminal responsibility of minors who are involved in committing criminal acts of terrorism, that is, children cannot be held criminally responsible because not all of the conditions for the elements of guilt are met (cumulative). Meanwhile, the second problem formulation discusses the basic considerations for providing legal protection for children and the relevant and appropriate legal protection to be given to children involved as perpetrators of criminal acts of terrorism.

Abstract

One of the major developments in legal technology is the use of computerized information and case management systems. Fraud in electronic/online transactions is basically the same as fraud in general. Electronic transactions refer to the process of buying and selling, services, goods or information through the internet network media. Here are a few; Inappropriate products, price discounts, free shipping services, special events, fake accounts / fake accounts / falsified identities. Normative Legal Research is a legal research method used to collect data and analyze literature. Normative legal research focuses on positive legal principles with the discipline of studying legal doctrine and analyzing certain legal cases. Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) and Law Number 19 of 2016 concerning Amendments to the ITE Law are relatively new legal regulations. In the context of using the internet, information networks and electronic transactions, it is mandatory to comply with the provisions in the ITE Law Article 3. Fraud in electronic transactions can result in civil and criminal law consequences. In civil law, perpetrators of fraud can be forced to compensate victims. On the other hand, in criminal law, perpetrators of fraud can face criminal penalties in accordance with applicable regulations. It is very important to adhere to principles such as good faith, fairness, etc. when engaging in an electronic transaction. In addition, maintaining the principle of vigilance is very important for sellers when shipping goods and for buyers when sending payments to minimize the risk of fraud.

Abstract

This study examines the Military Court's legal process and authority in trying to resolve human rights violations committed by TNI personnel. Normative legal research is used with a legislative approach and a conceptual approach, which is then analyzed against laws and regulations related to the problem to determine which court has the authority to try the case. The analysis results show that the Military Court's rule is to try criminal acts committed by a soldier, who according to the law is considered equal to a soldier, and members of a group or position or agency are considered soldiers according to the law. Military courts in the military justice system, even though they are under the jurisdiction of a special court, namely the human rights court in the general justice system.

Abstract

The development of the current era requires humans to use various technologies, one of which is the internet. With social media or the internet, humans have a very important role in resolving various injustices in legal practice in this country. Because efforts to achieve justice cannot be ignored. A rule of law cannot be ignored. may be apathetic towards the struggle and every effort to uphold justice. the concept of justice is very important so that a rule of law becomes the basis for all parties, both citizens and leaders as certainty in resolving various legal problems they face. so many use social media in solving various cases of injustice what the media can reveal tends to be resolved openly and can be followed and controlled by the public. Today's media is a place for citizens to seek and realize justice in accordance with their role. This mass media also monitors law enforcement and justice in the country. this is it. the role of netizens is a very large mass in raising a case so that it goes viral it is very important without a response from netizens then a case will not go viral. The reason someone uploads to social media for the first time is because there are so many social media users and there are almost all over the world , secondly, because social media is an internet-based technology where news dissemination will be faster than word of mouth, thirdly, if it is viral in the mass media, related parties will handle it quickly. And this is what politics does law in dealing with legal cases that do not get justice before they are viral in the mass media, legal politics also influences the strength or weakness or how important the legal objectives are to be achieved.
