Abstract

Kasus sengketa merek antara MS Glow dengan PS Glow merupakan gugatan mengenai ganti rugi kepada pihak Tergugat yang sesuai dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Artikel ini ditulis dengan metode penelitian yang diperoleh dari data sekunder dengan studi kepustakaan serta buku, jurnal dan surat kabar. Putusan hakim belum sepenuhnya memenuhi ketentuan Undang-Undang No. 48 tahun 2009 tentang Kekuasaan Kehakiman, di mana alasan dan dasar penjatuhan putusannya belumlah jelas dan belum sepenuhnya memenuhi aspek keadilan, kemanfaatan, dan kepastian hukum. Putusan hakim mempertimbangkan posisi pihak Tergugat adalah pihak yang dirugikan.Kata kunci: Putusan Pengadilan, Hak Merek, Sengketa

Abstract

In an era of increasingly tight free competition, companies are encouraged to find ways to develop strategies in order to survive. Acquisition has become a popular business expansion strategy used by companies to maintain their existence and survival. This article was written with the aim of finding out more about the legal provisions on the company acquisition process in Indonesia and its impact on company profitability. The method used in this writing is to use the normative legal method, which prioritizes library materials. Finally, it can be concluded that the company acquisition process in Indonesia which is based on Law Number 40 of 2007 concerning Limited Liability Companies can go through two stages, namely through the company's board of directors and direct acquisition from shareholders. Acquisitions can have a significant impact on company profitability by increasing operational efficiency, creating synergies, and expanding market share. Through acquisitions, companies can optimize financial ratios such as ROE, ROI, GPM, OPM, and NPM, which reflect the company's ability to generate profits and maximize value for shareholders.

Abstract

Along with the rapid digital transformation in various aspects of people's lives, the need to reform the legal system towards digitalization is becoming increasingly urgent. So that the establishment of e-Court in Indonesia is an important response to this development. Therefore, this article is compiled with the aim of finding out more about the urgency of the establishment of e-Court and its application in the civil justice system in Indonesia. The method used in this writing is to use the normative legal method, which prioritizes library materials. Finally, it can be concluded that the Establishment of e-Court is based on various Supreme Court regulations, starting from Supreme Court Regulation Number 3 of 2018 to Supreme Court Regulation Number 7 of 2022, as a form of reform in the field of information technology in the justice system. This e-Court system accelerates the judicial process by utilizing technology, but in its implementation, not all parties have adequate access or technological capabilities, so that it can cause gaps in the implementation of justice.

Abstract

In the increasingly competitive era of globalization in the trading industry, brand protection has become a very important aspect for Micro, Small and Medium Enterprises (MSMEs). Trademark registration is a strategy that is really needed because it is an effort to build strength and protection for MSME owners. Brand registration can not only provide a clear identity for the product, but also protect intellectual property rights, which is very necessary in maintaining competitiveness in the global market. The writing of this article examines the registration of certified marks as an effort to build legal strength and protection for MSME owners, because currently there are many legal violations found in the form of copying brands to gain instant profits or discredit other brands. Therefore, through this study, it is hoped that effective strategies can be found for MSMEs to be able to utilize brand registration to increase business value to face global challenges and can raise awareness for MSMEs to protect their brands so that they are able to adapt and compete at the international level.
