Abstract

Pengakuan hukum dan perlindungan terhadap hak kekayaan intelektual, khususnya Desain Tata Letak Sirkuit Terpadu (DTLST), menjadi fokus penelitian ini. Undang-undang di Indonesia (UU No. 32 Tahun 2000) dan Malaysia (UU Desain Tata Letak Sirkuit Terpadu 2000) mengatur DTLST, sementara Trinidad dan Tobago memiliki UU serupa (UU No. 19 Tahun 1996). Sengketa antara Nvidia dan Intel menunjukkan penyelesaian non-litigasi. Tujuan penelitian ini adalah menganalisis mekanisme pengaturan DTLST, perbandingan internasional, serta alternatif penyelesaian sengketa. Penelitian ini menggunakan pendekatan deskriptif kualitatif dan penelitian hukum normatif.

Abstract

The digital service innovation PAK DALMAN, implemented by the Dispendukcapil of Kendal Regency, is a strategic step in supporting the transformation of public service law, particularly in population administration. PAK DALMAN enables citizens to apply for civil documents such as electronic ID cards, Family Cards (KK), birth certificates, and relocation certificates daring without having to visit service offices. This study employs a participatory observation method, where the author directly serves as a PAK DALMAN agent, along with a literature review of relevant regulations, such as Law No. 25 of 2009 and Ministerial Regulation No. 7 of 2019. The findings show that PAK DALMAN enhances efficiency and accountability in civil administration services. However, challenges related to digital literacy among citizens and infrastructure readiness remain significant barriers. Therefore, increased socialization and digital literacy efforts are needed, especially for communities unfamiliar with technology. By addressing these issues, PAK DALMAN can serve as a more inclusive and effective public service model in the long term.

Abstract

Environmental criminal law enforcement in Indonesia faces structural challenges due to the normative subordination between Law No. 32 of 2009 on Environmental Protection and Management and Law No. 5 of 1990 on Conservation. This study aims to analyze the effectiveness of environmental criminal norms in judicial practice and their implications for ecological protection. The method employed is normative legal research using a juridical-normative approach, with primary and secondary legal materials and descriptive qualitative analysis. Results indicate that legal authorities tend to apply administrative conservation norms, overlooking scientific evidence and the potential application of Article 98 of Law No. 32/2009, preventing optimal operationalization of environmental criminal law. The novelty of this study lies in mapping normative subordination as a structural factor hindering substantive ecological protection. Reforming norm hierarchies, strengthening institutional capacity, and changing legal culture are necessary to make environmental criminal law the primary instrument of ecological protection.

Abstract

Taxes serve as the primary revenue source for governments, with the Transfer of Land and Building Rights Acquisition Tax (BPHTB) being a significant contributor. BPHTB is levied on transactions related to the transfer of land and building rights. While the central government initially managed this tax, the implementation of regional autonomy has shifted the responsibility for Transfer of Land and Building Rights Acquisition Tax management to local governments. This research aims to investigate the fundamental concept of local taxes in the context of regional autonomy and the role of local governments in collecting Transfer of Land and Building Rights Acquisition Tax, all within the framework of regional autonomy principles. The research methodology relies heavily on a literature review (library research) using secondary data sources, particularly legal regulations. The analysis follows interpretative principles and employs the hermeneutic method. The research findings indicate that, under the framework of regional autonomy, regions have specific rights, including the authority to impose local taxes and levies. As per the Regional Tax and Regional Levy Law, two tax types, Land and Building Tax (PBB), and Transfer of Land and Building Rights Acquisition Tax (BPHTB), previously managed by the central government, have now been transferred to local governments.
