Abstract

Tujuan dari mekanisme penetapan nilai BPHTB melalui program PTSL adalah untuk memberi masyarakat kepastian hukum dan perlindungan hukum atas hak atas tanahnya. Penelitian ini menggunakan analisis kualitatif sebagai metode penelitian yuridis normatif. Penelitian ini bertujuan untuk mengetahui dan menganalisis mekanisme penetapan nilai BPHTB melalui program PTSL untuk menjamin kepastian hukum. Hasilnya menunjukkan bahwa undang-undang telah menetapkan mekanisme penetapan nilai BPHTB melalui program PTSL. Agar mekanisme ini dapat lebih memberikan kepastian hukum, masih ada beberapa hal yang perlu diperhatikan saat diterapkan.

Abstract

The Indonesian state, as stated in the 1945 Constitution, initially declared itself a legal state before undergoing amendments. After the amendment, the statement changed to "Indonesia is a state of law." This means that every action taken by the government or state must comply with the legal provisions in force in Indonesia. The principle of the rule of law is regulated in the 1945 Constitution, Article 1 Paragraph (3), both before and after the amendment, indicating that Indonesia is a country based on law. Indonesian law also regulates the rights and obligations of parents in the modern era. The development of modern society brings changes in interpersonal relationships, especially in the family context. The main issue that emerged was regarding the status of children born out of wedlock, reflecting shifts in social values and raising complex legal questions regarding the rights of parents and children. With the significant increase in the number of children born outside of marriage, there is a need to review the legal system that regulates the status of children outside of marriage. The primary focus is on the parents' and children's rights perspective, with attention to child recognition, custody, and financial responsibilities.

Abstract

The Indonesian government is moving towards digital transformation in land administration by introducing electronic certificates (e-certificates) through the Regulation of the Minister of ATR/BPN Number 1 of 2021. This initiative aims to improve the security and legal certainty of land ownership, building upon existing programs like the Complete Systematic Land Registration Program (PTSL). This study used a normative legal research method to investigate the opportunities and challenges associated with implementing e-certificates in Indonesia. Primary legal sources, such as the Electronic Information and Transactions Law (UU ITE) and relevant ministerial regulations, were analyzed. Secondary data from legal journals, academic publications, and theses were also examined. The study revealed that e-certificates offer several advantages, such as increased efficiency in land administration, potential integration with blockchain technology, and improved land mapping and survey processes. However, challenges remain, including cybersecurity risks, limited technological infrastructure, and the digital literacy gap. Furthermore, the legal status of e-certificates as evidence in court, while recognized by the Ministry of ATR/BPN and UU ITE, requires further clarification within the Indonesian legal framework. This study concludes that e-certificates hold the potential to modernize land administration and enhance legal certainty in Indonesia, but successful implementation requires addressing critical challenges and ensuring comprehensive legal and regulatory clarity.

Abstract

Digital transformation of land registration is an important step in improving efficiency and transparency in land asset management. This research analyzes the challenges and effectiveness of implementing the “sentuh tanahku” application in the context of Society 5.0, where technology plays a crucial role in improving social interaction and public services. The research method used includes qualitative analysis through interviews with users and application managers, as well as literature study. The results show that although the application is able to speed up the registration process and reduce bureaucracy, challenges such as the lack of digital literacy among the community and uneven technological infrastructure are still significant obstacles. However, the app's effectiveness in providing better access to information and simplifying land transactions is expected to support the realization of Society 5.0 which focuses on collaboration between humans and technology. This research includes discussions on improving digital training for users and strengthening infrastructure to support the sustainability of this transformation.

Abstract

Artikel ini membahas prosedur pendaftaran tanah pertama kali di Indonesia menurut Peraturan Pemerintah Nomor 24 Tahun 1997. Pendaftaran tanah bertujuan untuk memberikan kepastian dan perlindungan hukum terhadap hak atas tanah, serta menyediakan informasi yang dibutuhkan oleh pihak-pihak berkepentingan. Proses pendaftaran terdiri dari tiga tahap: pengumpulan data fisik, pengolahan data yuridis, dan penerbitan dokumen hak. Artikel ini juga mengidentifikasi kendala yang dihadapi masyarakat dalam proses pendaftaran, seperti pemahaman yang kurang mengenai fungsi sertifikat tanah, biaya yang dianggap mahal, dan anggapan bahwa pendaftaran memakan waktu lama. Dengan memahami prosedur dan kendala ini, diharapkan masyarakat dapat lebih aktif dalam mendaftarkan hak atas tanah mereka, sehingga tercipta transparansi dan kepastian hukum yang lebih baik dalam pengelolaan sumber daya tanah.

Abstract

Pendaftaran tanah di Indonesia bertujuan untuk memastikan kepastian hukum serta melindungi hak atas tanah bagi pemilik yang sah. Proses ini krusial dalam membangun stabilitas hukum, ekonomi, dan sosial melalui sertifikasi kepemilikan yang sah. Namun, implementasi pendaftaran tanah menghadapi tantangan sistematis, seperti tumpang tindih peraturan, pengakuan hak tanah adat yang belum optimal, serta potensi korupsi dan lemahnya penegakan hukum. Studi ini menggunakan metode yuridis normatif dan pendekatan deskriptif-analitis untuk menganalisis kendala tersebut serta mengidentifikasi solusi implementatif, termasuk digitalisasi sistem, peningkatan transparansi informasi, mediasi sengketa tanah, edukasi hukum bagi masyarakat, dan reformasi birokrasi. Diharapkan, reformasi ini dapat meningkatkan efisiensi dan akuntabilitas, sehingga kepastian hukum atas tanah semakin terjamin dan dapat mendukung pembangunan nasional yang berkelanjutan.

Abstract

Hak tanggungan merupakan hak tanggungan yang dikenakan pada hak atas tanah dengan tujuan memberikan kepastian hukum dan status keutamaan bagi pemiliknya. Regulasi dan praktik di lapangan harus berjalan beriringan sesuai dengan tujuan awal. Penelitian ini bertujuan untuk menganalisis secara komprehensif aspek hukum hak tanggungan, meliputi kekuatan, kelemahan, serta peluang dan tantangan yang dihadapi dalam pelaksanaan pendaftaran hak tanggungan tanah di Indonesia. Jenis penelitian yang digunakan adalah hukum normatif dengan pendekatan deskriptif kualitatif. Penelitian ini menemukan bahwa dari segi regulasi, hak tanggungan tanah telah diatur dengan baik dan matang. Namun dalam praktik di lapangan, proses pendaftaran KPR masih diwarnai berbagai kendala, baik dari segi prosedur, biaya, maupun pemahaman masyarakat. Oleh karena itu, pemerintah perlu mempertimbangkan perbaikan sistem pencatatan dan pelaporan KPR, termasuk penggunaan teknologi yang mendukung transparansi dan akurasi data, seperti sistem digital yang terintegrasi secara nasional.

Abstract

Artikel ini membahas perbandingan kebijakan pendaftaran tanah antara Indonesia dan Australia dalam mengelola sumber daya tanah untuk mencapai kepastian hukum dan efisiensi administrasi pertanahan. Pendaftaran tanah memiliki peran penting dalam memberikan perlindungan hukum bagi pemilik tanah dan mencegah sengketa yang berkaitan dengan kepemilikan tanah. Sistem pendaftaran tanah Indonesia diatur oleh Undang-Undang Pokok Agraria dan menghadapi tantangan terkait kompleksitas hukum adat dan birokrasi yang masih membutuhkan penyempurnaan. Sementara itu, Australia menerapkan sistem Torrens Title yang modern dan terkomputerisasi, menawarkan jaminan kepastian hukum yang tinggi serta kemudahan dalam proses transaksi. Artikel ini menggunakan pendekatan yuridis normatif untuk mengidentifikasi kekuatan dan kelemahan dari kedua sistem serta memberikan wawasan bagi pengembangan kebijakan pertanahan di Indonesia.

Abstract

This research examines the urgency of using drone technology in Complete Systematic Land Registration (PTSL) to increase the efficiency of land mapping. Currently, the land registration process in Indonesia still faces various obstacles, especially regarding accuracy and efficiency in land mapping. Drone technology is considered capable of providing innovative solutions by producing accurate spatial data and speeding up the field monitoring process. In this research, a normative juridical method is used to analyze legal provisions regarding land registration in Indonesia and the urgency of using drone technology in complete systematic land registration including potential benefits, as well as challenges faced in its implementation. The research results show that the use of drones in PTSL can not only speed up the land certification process, but also strengthen legal certainty for land owners through more accurate data. It was announced that the use of this technology can support the government's accelerated land certification program more efficiently and effectively, as well as contribute to sustainable development.

Abstract

This article examines the procedural review of legal protection for taxpayers in filing objections to the Land and Building Rights Acquisition Duty (BPHTB). Legal protection for taxpayers is essential to ensure administrative justice and provide a guarantee of rights for those who dispute the BPHTB value determined by the authorities. This study highlights the stages of the objection procedure, the rights and obligations of taxpayers, and the role of the tax court in dispute resolution. Using a normative juridical approach, the article identifies shortcomings in the procedural system that may hinder access to justice for taxpayers. The findings reveal that a more transparent procedure and robust protection mechanisms are essential to safeguard taxpayers' rights in BPHTB dispute resolution.
