Abstract

A street vendor is any individual or organization that seeks or trades on a sidewalk, boulevard, yard/yard, or other place not intended for it. The regulation and arrangement of street vendors is an important issue for local governments in many regions. This is because urban population growth and rapid urbanization have resulted in an increase in demand for accessibility and diversity of goods and services. MPAs emerged in response to this need, but uncontrolled growth can lead to significant overcrowding and space limitations. The research method used in this study is sociological or empirical legal research, which includes research on legal identification (unwritten) and research on legal effectiveness. There are many obstacles faced by the Kupang regency government in controlling and managing street vendors at the Oesao market and Lili market, such as the lack of communication between the parties, both the government as an institution that issues policies, the community and traders who are used as objects; the ineffectiveness of the efforts issued by the Kupang district government in providing socialization and also the inadequate selling places that have been built by the Kupang district government. The strategy made by the Kupang regency government in controlling street vendors at the Oesao market and Lili market, namely providing strategic places to sell by building markets far from public routes; Updating facilities and infrastructure and improving cleaning and security services.

Abstract

The legal profession is one of the professions that demands the fulfillment of moral values from its development. The main benchmark for being an organizer of the legal profession in enforcing the law lies in the independence of professional organizers and strong moral integrity when facing various problems that are their responsibility. To be a good organizer of the legal profession in carrying out its professional duties in enforcing the law, practitioners who have qualified attitudes, humanitarian attitudes, attitudes of justice, are able to see and place objective values in a case handled, an honest attitude, and have technical skills and ethical maturity. The code of ethics of the legal profession actually functions as an ethical controller for those who carry out the legal profession. With legal professional ethics, it is expected that legal professionals have certain critical individual abilities.The National Police as one of the legal profession that deals directly with the community so that content is needed related to the standards of behavior and actions that are observed, where the Code of Professional Ethics of the National Police of the Republic of Indonesia is basically a guide for all actors of police functions in carrying out their duties in accordance with the laws and regulations in force in their territory contained in POLRI Regulation No. 7 of 2022 concerning the Code of Professional Ethics and Commission on the Code of Ethics of the National Police of the Republic of Indonesia. However, it is undeniable that there are still many violations of the code of ethics that often occur and are committed by police officers which result in low or decreased integrity of the police in the eyes of the public.

Abstract

Hak atas tanah merupakan hak dasar sangat berarti bagi masyarakat untuk harkat dan kebebasan diri seseorang. Di sisi lain, adalah kewajiban negara memberikan jaminan kepastian hukum terhadap hak atas tanah itu walaupun hak tersebut tetap dibatasi oleh kepentingan orang lain, masyarakat, dan terlebih lagi negara. Dalam hal ini pengakuan kepemilikan tanah yang dikonkretkan dengan penerbitan sertifikat hak atas tanah. Sertifikat merupakan surat tanda bukti hak atas tanah, suatu pengakuan dan penegasan dari negara terhadap penguasaan tanah secara perorangan atau bersama atau badan hukum yang namanya di tulis di dalamnya serta menjelaskan lokasi, gambar, ukuran dan batas-batas bidang tanah tersebut sebagaimana termuat dalam Pasal 19 ayat (2) huruf c UUPA. Sertifikat tanah diterbitkan oleh Badan Pertanahan Nasional, namun mengalami kecacatan dalam bagian status kepemilikan yg lebih berdasarkan satu pemilik yg mempunyai wewenang atau tumpang tindih hak pada menguasai suatu bidang tanah baik sebagian atau keseluruhannya menggunakan para pemilik yag bersangkutan mempunyai surat atau dokumen perindikasi bukti yg sama. Di Kantor BPN Kota Kupang terjadi sengketa sertifikat ganda hak milik atas tanah yang diselesaikan di kantor BPN Kota Kupang., yakni masalah sebidang taanah seluas 17.880 m2 an. Bahwa pemilik tanah berinisial A. N yang menguasai objek sebidang tanah tersebut sejak tahun 1942 berlokasi di Tuak Merah Desa Oebufu Kecamatan Kupang Tenggah Kabupaten Kupang Provinsi Nusa Tenggara Timur. Dalam perjalanan waktu, pada tahun 1983 ada pihak lain yang mengklaim bahwa tanah tersebut adalah miliknya (keluarga S atas nama M. S dan A.S).
