Abstract

Easy requirements with a fast process and no collateral required make funding through LPBBTI highly popular among the community. In addition, these activities also provide convenience, speed, and practicality in funding. Unfortunately, there are funding risks involved, such as potential defaults by fund recipients. The funding risk will be borne by the funder and the risk will be even greater if there is no collateral in the funding because the position of the funder is only as a concurrent creditor. The objective of this research is to find out precautionary principles in information technology-based joint funding services. The method used judicial normative research was conducted to understand the legal subject and legal relationship of precautionary principles in information technology-based joint funding services. Therefore, the POJK10/POJK.05/2022 does not explicitly state the precautionary principle as the basis for LPBBTI's business activities. However, it has been realized in the norms contained in POJK10/POJK.05/2022, in the form of norms that require and norms that prohibit. One of them is the obligation to conduct funding risk analysis as a risk mitigation effort. This is intended to ensure that LPBBTI develops optimally, healthily, contributively and that users' needs for optimal protection can be accommodated.

Abstract

AbstractNotary as public officials have an obligation to implement the principle of recognizing beneficial owners in a corporation. A notary play an important role in disclosing beneficial ownership of a corporation, however, the transparency of beneficial ownership disclosure must be based on good faith and clear information from parties who representing the corporation. Therefore, the existence of beneficial ownership cannot fully detected by a notary, moreover, a notary has to apply the confidentiality principle. The objective of this research is to find out and examine the legal protection for Notaries regarding the provisions as reporting parties in applying the principle of recognizing the beneficial owners of corporations. The legal research is used as the research method with statute approach and conceptual approach. The results of the research explain that the provisions in Presidential Regulation Number 13 of 2018 must be implemented by the Notary even if this obligation is contrary to the principle of confidentiality. Matters that can be reported by a Notary are only in accordance with what is known and submitted by the parties to prevent misuse of business entities for illegal purposes such as money laundering and terrorism financing.Keywords: Confidential Principle of Deed; Notary Compliance; Beneficial Owner Transparency. AbstrakNotaris sebagai pejabat publik memiliki kewajiban untuk melaksanakan asas mengenali pemilik manfaat dalam suatu perusahaan. Notaris memegang peranan penting dalam pengungkapan kepemilikan manfaat suatu perusahaan, namun demikian, keterbukaan pengungkapan kepemilikan manfaat tersebut harus dilandasi oleh itikad baik dan keterangan yang jelas dari pihak yang mewakili perusahaan tersebut. Keberadaan kepemilikan manfaat tidak dapat sepenuhnya diketahui oleh notaris tanpa adanya itikad baik dan pemberian informasi yang benar, terlebih lagi notaris harus menerapkan asas kerahasiaan. Tujuan penelitian ini adalah untuk mengetahui dan mengkaji perlindungan hukum bagi Notaris terkait ketentuan sebagai pihak pelapor dalam penerapan asas pengakuan pemilik manfaat korporasi. Metode penelitian yang digunakan adalah metode penelitian hukum dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menjelaskan bahwa ketentuan dalam Peraturan Presiden Nomor 13 Tahun 2018 wajib dilaksanakan oleh Notaris meskipun kewajiban tersebut bertentangan dengan asas kerahasiaan. Hal-hal yang dapat dilaporkan oleh Notaris hanya sesuai dengan apa yang diketahui dan disampaikan oleh para pihak untuk mencegah penyalahgunaan badan usaha untuk tujuan yang melanggar hukum seperti pencucian uang dan pendanaan terorisme.Kata Kunci: Prinsip Menjaga Kerahasiaan Isi Akta Notaris; Pelaporan Notaris; Prinsip Mengenali Pemilik Manfaat dari Korporasi.

Abstract

The Old Age Security Program has attracted considerable attention within the broader context of social security implementation, particularly due to frequent changes in regulations governing benefit distribution. This article analyses the inclusion of criteria for workers or labourers who have ceased employment as an expansion of the definition of 'retirement age' in relation to beneficiary eligibility under Government Regulation No. 46 of 2015 concerning the Implementation of Old Age Security (Government Regulation No. 46/2015) and its amendments. Under Article 35, paragraph (2) of Law No. 40 of 2004 concerning the National Social Security System (SJSN Law), Old Age Security benefits are provided to participants who retire, experience permanent total disability, or pass away. This analysis differs from previous studies that focused solely on changes to the waiting period for workers or labourers experiencing termination of employment. The research employs statutory, case, and conceptual approaches, and applies grammatical and systematic analysis to legal materials. The findings indicate that, although expanding the definition of 'retirement age' in the implementation regulations does not align with the original intent of the Old Age Security Program as part of the National Social Security System, the Constitutional Court has determined that such expansion is permissible under conditions of force majeure, such as termination of employment. It is recommended that future benefit distribution under the Old Age Security Program realign with the program's foundational principles.
