Abstract

Abstrak Tulisan ini mencoba membahas tentang konsep Kecelakaan Kerja pada penyelenggaraan Jaminan Kecelakaan Kerja (JKK). Ide dasar tulisan ini dilatar belakangi oleh adanya kebijakan pemberlakuan sistem kerja Work from Home (WFH) yang digagas oleh Pemerintah dengan tujuan utama untuk meminimalisir penyebaran Virus Covid-19. Dengan batasan pembahasan pada permasalahan apakah ‘rumah’ dapat dikategorikan sebagai ‘tempat kerja’ dan atau ‘lingkungan kerja’ sebagaimana unsur utama untuk dapat diberikannya manfaat (JKK) kepada pekerja yang mengalami kecelakaan kerja. Dengan menggunakan pendekatan perundang-undangan dan pendekatan konsep serta teknik analisis gramatikal dan sistematis, ditemukan jawaban bahwa ‘rumah’ dapat dikategorikan sebagai ‘tempat kerja’ dan atau ‘lingkungan kerja’, sebagaimana tertuang di dalam ketentuan tempat kerja menurut UU Keselamatan Kerja. Oleh karena itu, pekerja yang bekerja dengan menggunakan sistem WfH sebagaimana ‘perintah’ pemberi kerja berhak atas JKK apabila mengalami kecelakaan kerja. Kata Kunci: Konsep, Kecelakaan Kerja, JKK, Work from Home Abstract This paper tries to discuss the concept of work accidents in the implementation of Work Accident Benefits (JKK). The basic idea of this paper is motivated by the policy of implementing the Work from Home (WFH) work system which was initiated by the Government with the main objective of minimizing the spread of the Covid-19 Virus. The discussion limitation on the issue of whether a 'home' can be categorized as a 'workplace' and/or 'work environment' as the main element in which JKK benefits can be given to workers who have a work accident. By using a statutory approach and a conceptual approach as well as a grammatical and systematic analysis technique, the answer was found that 'home' can be categorized as 'workplace' and/or 'work environment', as stated in the workplace provisions according to the Work Safety Law. Therefore, workers who work using the WfH system as 'ordered' by the employer are entitled to JKK if they have a work accident.

Abstract

This article aims to analyze the reason of eliminated of criminal sanction on employer obligation to opt in their worker to social security. By using statute approach, conseptual approach and historical approach obtained result that the reason of eliminated of criminal sanction are (i) the inclusion of criminal sanction in previous regulation was ineffective (ii) the eliminated of criminal sanction is in line with the aim of provision of social security, and (iii) the eliminated of criminal sanction is corresponding with the principal of social security.

Abstract

ABSTRACT Purpose of the study: This study examines the legal reasoning behind the judicial decision in the case between Siti Khalimah and the Social Security Administrator of Health (Badan Penyelenggara Jaminan Kesehatan/BPJS) in Papua, Indonesia. This case demonstrates the need for a constructive interpretation of the Civil Code to determine if BPJS committed a law-violating action. Methodology: As normative research, this study employed statute, case, and conceptual approaches. The statutory approach used laws and regulations as legal sources for research. The case approach was focused on the judge's ratio decidendi or the legal reasons behind their conclusion. The conceptual approach was used to refer to the fundamental principles of law. To analyze the data, the authors employed grammatical, systematic, and teleological analysis techniques. Results: Results found that that BPJS should not be declared to have violated Article 21 clause (1) of the BPJS Law as an error in fulfilling Article 1365 of the Civil Code. The judges emphasized that the aim of the norm in Article 21 clause (1) is to protect its participants against economic risks, including the loss of income. The panel of judges prioritized justice as a value in its decision. Applications of this study: This study provides a new point of view on law violating actions in the judges’ decision at court, notably in terms of social security administrators’ legal obligations, especially BPJS. Novelty/Originality of this study: Few articles have addressed the subject of legal violations committed by BPJS. Furthermore, in this article, the authors applied Dworkin's theory to the analysis of court decisions. This demonstrates the article's originality. Keywords: health insurance, worker protection, legal reasoning, legal violation, BPJS.   ABSTRAK Tujuan penelitian: Penelitian ini mengkaji alasan hukum yang melatarbelakangi putusan pengadilan dalam perkara antara Siti Khalimah dan Badan Penyelenggara Jaminan Kesehatan (BPJS) di Papua, Indonesia. Kasus ini menunjukkan perlunya penafsiran yang konstruktif terhadap Kitab Undang-Undang Hukum Perdata untuk menentukan apakah BPJS melakukan perbuatan melawan hukum. Metodologi: Sebagai penelitian normatif, penelitian ini menggunakan pendekatan perundang-undangan, kasus, dan konseptual. Pendekatan perundang-undangan menggunakan peraturan perundang-undangan sebagai sumber hukum penelitian. Pendekatan kasus difokuskan pada ratio decidendi hakim atau alasan hukum yang melatarbelakangi putusannya. Pendekatan konseptual digunakan untuk merujuk pada asas-asas hukum yang fundamental. Untuk menganalisis data, penulis menggunakan teknik analisis gramatikal, sistematis, dan teleologis. Hasil: Hasil penelitian menemukan bahwa BPJS tidak dapat dinyatakan melanggar Pasal 21 ayat (1) UU BPJS karena dianggap keliru dalam memenuhi Pasal 1365 KUH Perdata. Para hakim menekankan bahwa tujuan norma dalam Pasal 21 ayat (1) adalah untuk melindungi para pesertanya dari risiko ekonomi, termasuk hilangnya pendapatan. Majelis hakim mengutamakan keadilan sebagai nilai dalam putusannya. Aplikasi penelitian ini: Penelitian ini memberikan sudut pandang baru terhadap tindakan pelanggaran hukum dalam putusan hakim di pengadilan, khususnya dalam hal kewajiban hukum penyelenggara jaminan sosial, khususnya BPJS. Kebaruan/Keaslian penelitian ini: Hanya sedikit artikel yang membahas tentang pelanggaran hukum yang dilakukan oleh BPJS. Lebih lanjut, dalam artikel ini, penulis menerapkan teori Dworkin untuk menganalisis putusan pengadilan. Hal ini menunjukkan keaslian artikel tersebut. Kata kunci: asuransi kesehatan, perlindungan pekerja, penalaran hukum, pelanggaran hukum, BPJS.

Abstract

Tulisan ini bertujuan untuk menganalisis karakteristik hubungan hukum antara pengemudi ojek online dan perusahaan aplikasi. Melalui pendekatan yuridis-sosiologis diperoleh kesimpulan bahwa karakteristik hubungan hukum tersebut adalah: pengemudi dapat menolak atau menerima tawaran memberikan layanan kepada penumpang; pengemudi memiliki fleksibilitas waktu kerja; pengemudi bukan bagian dari organisasi perusahaan aplikasi; risiko keuangan dalam menjalankan pekerjaan menjadi beban pengemudi; dan pembayaran atas setiap layanan dari pengguna akan langsung masuk ke akun pengemudi setelah dipotong biaya penggunaan layanan aplikasi. Karakteristik yang demikian tidak menggambarkan wujudnya hubungan kerja antara pengemudi dan perusahaan aplikasi, yang oleh karenanya pengemudi tidak dapat dikualifikasikan sebagai pekerja, melainkan pekerja mandiri.

Abstract

The philosophy of organizing labor social security aims to protect workers from socio-economic risks resulting from involuntary loss of income. This includes providing protection during and after the employment relationship. Job Loss Insurance (JKP) under the National Social Security System (SJSN) is designed to offer protection to workers experiencing Termination of Employment (PHK), but workers who resign voluntarily are not entitled to benefits under Article 19 in conjunction with Article 20 of Permenaker No. 37/2021. This paper proposes reinterpreting the concept of termination and applying the Difference Principle to extend JKP benefits to workers who resign involuntarily (Constructive Dismissal) in line with the principles of organizing social security.

Abstract

The Old Age Security Program has attracted considerable attention within the broader context of social security implementation, particularly due to frequent changes in regulations governing benefit distribution. This article analyses the inclusion of criteria for workers or labourers who have ceased employment as an expansion of the definition of 'retirement age' in relation to beneficiary eligibility under Government Regulation No. 46 of 2015 concerning the Implementation of Old Age Security (Government Regulation No. 46/2015) and its amendments. Under Article 35, paragraph (2) of Law No. 40 of 2004 concerning the National Social Security System (SJSN Law), Old Age Security benefits are provided to participants who retire, experience permanent total disability, or pass away. This analysis differs from previous studies that focused solely on changes to the waiting period for workers or labourers experiencing termination of employment. The research employs statutory, case, and conceptual approaches, and applies grammatical and systematic analysis to legal materials. The findings indicate that, although expanding the definition of 'retirement age' in the implementation regulations does not align with the original intent of the Old Age Security Program as part of the National Social Security System, the Constitutional Court has determined that such expansion is permissible under conditions of force majeure, such as termination of employment. It is recommended that future benefit distribution under the Old Age Security Program realign with the program's foundational principles.
