Abstract

This research aims to analyze the implementation of sanctions against perpetrators of tourism site vandalism in North Toraja; and to examine the constraints on the application of sanctions in law enforcement against perpetrators of tourism site vandalism based on Regional Regulation No. 7/2016. This research uses empirical research methods, using statutory approaches and conceptual approaches. Primary data is obtained through field research using interview and observation methods, while secondary data is obtained through literature study. The results indicated that the enforcement of sanctions of Regional Regulation No. 7/2016 on the Implementation of Tourism in North Toraja has not complied with the regulation. Moreover, the case of Ke’te’ kesu’ vandalism committed by perpetrators who are sanctioned by custom, is characterized by many unresolved cases and weak enforcement of sanctions. The constraints in the implementation of sanctions in law enforcement are mostly caused by delayed information to the Civil Service Police Unit so that initial administrative actions are conducted before handing over to the Prosecutor’s Office. Another constraint is the absence of a MoU between the Police, Prosecutor’s Office, and Courts, and limited budget which affects the capacity of Civil Service Police Unit (Satpol PP) in protecting tourists. A comprehensive approach is needed, which includes training of law enforcers, inter-agency coordination, legal education for the community, and a review of local regulations to enhance justice and appropriateness of sanctions.

Abstract

Tujuan penelitian ini untuk mendeskripsikan dan mengetahui penerapan sanksi pidana dan hambatan dalam mengembangkan objek pariwisata di Toraja Utara. Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan jenis data primer sekunder yang diperoleh dari studi kepustakaan dan wawancara. Hasil penelitian ini menjelaskan bahwa Toraja Utara dalam menerapkan sanksi belum dapat diterapkan karena sebagian bahkan seluruh objek wisata di Toraja Utara masih dikelola pihak yayasan atau keluarga, Hambatan penerapan sanksi karena anggaran yang lambat bahkan tidak ada, dan kurangnya sarana prasarana sehingga tidak menjangkau setiap pelanggaran Perda yang ada di Toraja Utara. Pemerintah Daerah perlu kerjasama dengan pemilik yayasan objek wisata agar terjadi keamanan yang baik sehingga mengurangi pelanggaran Perda terhadap pelaku pengrusakan objek wisata. The research aims to describe and determine the application of criminal sanctions and barriers in developing tourism objects in North Toraja. This study uses a qualitative descriptive approach with secondary primary data types obtained from literature and interview studies. The results of this study explained that North Toraja in applying sanctions can not be applied because some even the whole tourist attraction in North Toraja still managed by the foundation or family, barriers to application of sanctions due to slow budget Not even exist, and lack of infrastructures so as not to reach any violations of Perda that exist in North Toraja. The local government needs to cooperate with the owner of the tourism object in order to make good security, thus reducing Perda violations against the perpetrators of tourism objects.

Abstract

This study aims to analyze the enforcement of sanctions against perpetrators of the destruction of tourist objects in Ke'te' Kesu' North Toraja. This research uses empirical legal research methods with a statutory approach. The results of this study indicate that the enforcement of sanctions against the perpetrators of the destruction of tourist objects in Ke'te' Kesu' North Toraja is still less effective and the case has not been followed up, despite having a Regional Regulation of North Toraja Regency Number 7 of 2016. There are several obstacles faced in the application of sanctions in law enforcement against perpetrators of destruction of tourist objects due to, among others: (1) the civil service police unit can’t apply criminal sanctions because it does not have an agreement from the Police, Prosecutor's Office, and the Court; (2) the budget is slow or even non-existent so that the civil service police unit can’t move in guarding every tourist who enters North Toraja, and (3) the lack of personnel of the civil service police unit, so that it does not reach every violation of the destruction of Ke'te Kesu' Toraja Utara tourist objects.
