Abstract

Among modern women, there are those who do not agree with the implementation of female circumcision, especially those that damage the reproductive organs, because it is an act of violence against women. This does not mean that there is a contradiction between Islamic teachings and the provisions of “Positive Law” regarding female circumcision, because textually there is no explicit argument that can be referred to do make it mandatory, so that from a fiqh perspective no Ulama of fuqaha requires it. Some Ulama even state that the law on female circumcision in only permissible, it may or may not be carried out, therefore, it is up  to parents of the government. If it is considered more beneficial not carry it out, this research is a type of library research, namely research whose object of study uses library data in the form og books, journals, articles and so on as the data source. This research os carried out by reading, reviewing an analyzing various existing literature, in the form of the Qur’an, hadith, MUI fatwa, as well as research argument that requires or considers circumcision for women to be sunnah, either from al-Qur’an, sunnah, ijma’ and qiyas. Qardhawi also revealed that the ulama agrees on this abilities. So there is not a single scholar who says that circumcision is something that is forbidden or that is makruh li tanzih or li tahrim. Therefore, it is nor considered good for someone to criticize the person who did it or consider to have committed an act against the law, uncles it is done excessively to the point that one of the parties feels aggrieved.

Abstract

Teknologi informasi sangatlah pesat perkembangannya, sehingga merubah sebagian besar gaya hidup masyarakat yang awalnya bersifat tradisional menjadi modern. Dunia perbankan saat ini juga sudah memanfaatkan teknologi informasi dalam operasionalnya sehari-hari, dimana operasionalnya dikenal dengan sistem aplikasi perbankan. Dengan pemanfaatan teknologi informasi operasional bank semakin hari semakin efektif dan efisien serta menyediakan fasilitas-fasilitas pendukung yang mempermudah transaksi keuangan bagi nasabah seperti fasilitas pembayaran non tunai. Penggunaan teknologi modern sebagai instrument pembayaran non tunai, baik secara domestik maupun secara internasional, telah berkembang pesat disertai dengan berbagai inovasi yang mengarah pada penggunaan yang semakin efisien, praktis, aman, cepat dan nyaman. Fasilitas pembayaran non tunai tersebut akhir-akhir ini muncul dalam bentuk instrument pembayaran yang dikenal dengan uang elektronik (electronic money/e-money). Untuk itu dalam tulisan ini akan lebih membahas dan memperjelas secara mendalam tentang penggunaan uang elektronik dan sebagai pengganti uang tunai. Sehingga masyarakat akan lebih mengetahui macam-macam, dan manfaat serta kelebihan dan kekurangan uang elektronik.

Abstract

This research discusses how holidays differ in Indonesia. The difference in determining the start of the Qamariah month, especially the start of Ramadan, Shawwal and Zulhijah, is a recurring phenomenon in Indonesia. These differences often cause unrest among Muslims, disrupt the solemnity of worship and even threaten the stability of the brotherhood. Ru'yatul hilal is a practical method to prove whether the new crescent moon (hilal) is visible or not. If in astronomy the celestial objects that are usually rukyat are recommended to be above an angle of 15 degrees, then ru'yatul hilal is done when the moon's irtifa' is still very low, and is done every 29th of Sha'ban or Ramadan regardless of whether it has been ijtima' or not. The science of arithmetic is the equivalent of the science of astronomy, which is a branch of applied astronomy that discusses determining times of worship by calculating the position of the sun and moon relative to the earth. The issue of reckoning and rukyat at the beginning of the month of Qamariah is an important issue because it is related to determining major Muslim holidays, for example the months of Ramadhan, Shawwal and Zulhijah.
