Abstract

Distribution case narcotics involved child the more increase along development technology and convenience access facility general. Involvement children in narcotics distribution is problem seriously threatening generation successor nation. The perpetrator's son is often entangled in the network distribution adult narcotics so that potential become victims of exploitation. Although accordingly, the Law Number 35 of 2009 concerning Narcotics No differentiate in a way special age perpetrator dealer narcotics. Criminal law approach should be more directed at effort rehabilitation child than condemnation, remembering child perpetrator tend become a victim. Therefore, that country through government and society is obliged to protect children involved in the act of criminal narcotics distribution.

Abstract

The Honorary Council of Notaries is a body that has the authority to develop Notaries and has the right to give approval or rejection in matters of investigation and judicial process, especially with regard to taking photocopies of Deed Minutes and summoning Notaries to be examined in all matters relating to Notarial Deeds or Protocols made by Notaries. In Constitutional Court Decision No. 49/PUU-X/2013, the phrase "with the approval of the Regional Supervisory Council" is revoked and decided to be cancelled. Akil Mochtar, Chairman of the Panel of Judges of the Constitutional Court at that time, stated that this phrase had no binding legal force and was contrary to the 1945 Constitution. The Constitutional Court stated that the attitudes, titles, words, behaviour and actions of Notaries in relation to morals - eiwit, were not a matter of — socially acceptable. After the Constitutional Court's decision that many Notaries were "bullied" and "worked" by clients who had to be assisted in authenticating deeds. Many clients "bully" notaries with the help of their lawyers, and form notaries as "an outlet for their own legal dissatisfaction." Maybe the Notary Honorary Council should map out any legal issues that might involve notaries so that the notary's voice can be heard. The exercise of discretion by the MKN in defending the Notary profession requires understanding the Religiosity of Science with a prophetic approach so that it can apply moral values ??to build a dignified Notary profession ABSTRAKMajelis Kehormatan Notaris adalah institusi yang berwenang untuk membina Notaris dan berhak memberikan (approval) persetujuan atau penolakan dalam hal penyidikan dan proses peradilan, terutama berkaitan dengan pengambilan fotokopi Minuta Akta dan pemanggilan Notaris untuk diperiksa dalam setiap hal yang berkaitan dengan Akta atau Protokol Notaris yang dibuat oleh Notaris. Dalam Putusan MK No. 49/PUU-X/2013, frasa "dengan persetujuan Majelis Pengawas Daerah" dicabut dan diputus batalkan. Akil Mochtar, Ketua Majelis Hakim Mahkamah Konstitusi yang menjabat pada saat itu, menyatakan bahwa frasa tersebut tidak binding atau memiliki kekuatan hukum yang mengikat dan berseberangan dengan UUD 1945. Mahkamah Konstitusi menyatakan bahwa sikap, sebutan, ucapan, perilaku, dan perbuatan Notaris dalam kaitannya dengan moral—eiwit, bukan urusan—dapat diterima masyarakat. Setelah putusan Mahkamah Konstitusi bahwa banyak Notaris”bully” dan “dikerjai” oleh client yang harus dibantu dalam akta autentik. Banyak client “bully” Notaris dengan dibantu oleh pengacara mereka, danformation Notaris sebagai “pelampiasan atas ketidakpuasan hukum yang mereka lakukan sendiri”. Mungkin Majelis Kehormatan Notaris harus mapping permasalahan hukum apa saja yang mungkin melibatkan Notaris supaya voice of notary bisa terdengar. Pelaksanaan diskresi oleh MKN dalam melakukan pembelaan terhadap profesi Notaris diperlukan memahami Religiusitas Sains dengan pendekatan profetik sehingga dapat menerapkan nilai-nilai moral untuk membangun profesi Notaris yang bermartabat

Abstract

KKN (Real Work Lecture) activities aim to apply the scientific knowledge that students gain during their studies in the community and as a forum for community service. Making house numbers and trash cans is one of the work programs carried out by Regular KKN students at Wisnuwardhana University Malang located in Patuksari Hamlet, Plaosan Village. Based on the survey results, most of the residents' houses in Patuksari Hamlet do not have house numbers and there are no trash bins for storing waste. So village officials who want to collect data and senders of goods also have difficulty finding home addresses. Apart from that, many people throw their household waste into areas around the river. Therefore, Regular KKN students at Wisnuwardhana University Malang created this program, by installing 80 house numbers consisting of 40 house numbers for RT 02 and 40 numbers for RT 04 with 2 trash bins for each RT consisting of organic and non-organic waste bins.

Abstract

This study aimed to identify the characteristics of the Governmental Silent Act (Principle of Lex Silencio Positivo) in the land rights application proposed by the Community, to find the legal consequences when the government remains "silent" (Principle of Lex Silencio Positivo) on the land rights application proposed by the Community, and to analyze the construction of norms that provide legal certainty regarding the Silent Act (Principle of Lex Silencio Positivo) by the government in relation to the land rights application submitted by the Community. This study was conducted using a normative legal research method, employing a legislative approach, a conceptual approach, a historical approach, a case approach, and a comparative approach. The results of this study showed that the legal consequences of the Governmental Silent Act on land rights applications lead to uncertainty regarding the status of the land rights proposed by the applicants. This uncertainty results in grievances for the parties affected by the Governmental Silent Act, including the applicants themselves. Furthermore, the legal consequences of the Governmental Silent Act are seen as a violation of the General Principles of Good Governance, as it has caused legal uncertainty over the land rights applications proposed by the applicants. Meanwhile, the decision is an obligation for government officials, as mandated in Article 175 of the Omnibus Law (Cipta Kerja) in conjunction with Article 53 of the Government Administrative Law. The legal consequences of the government's silence also lead to potential material losses for applicants, which include individuals, legal entities, and government institutions with a legal interest in the land rights application.
