Abstract

The rapid development of information technology has raised concerns about cybercrime and mayantara crime, which has an impact on various aspects of life. Therefore, people who communicate on social networks must have good ethics and interact well with others because their mistakes can result in criminal sanctions. This research aims to understand criminal offenses, sanctions, and legal considerations in the dissemination of defamatory electronic documents and information. Normative juridical is used by the author in this research which means using court decisions as the basis for solving problems. Secondary data is obtained from primary data used in this research. Data for this research was collected through literature research. Qualitative data was used for analysis. Dissemination of electronic information containing defamation or Article 27 paragraph (3) of the Electronic Information and Transaction Law regulates defamation. Defamation of private electronic information is a violation of the law. In Decision No. 978/Pid.Sus/2018/PT. MDN of the Medan High Court, the judge decided that the perpetrator of the criminal offence of disseminating electronic documents and information containing insults and defamation fulfilled the requirements of Articles 45 and 27 of the Electronic Information and Transaction Law, both including paragraph (3). This research concludes that the judge has applied the provisions of the Electronic Information and Transaction Law. Future research should conduct field research related to this field.

Abstract

The development of Artificial Intelligence (AI) has significantly impacted structural transformation and the dynamics of social control within society. AI not only changes how individuals interact with the world but also influences various sectors such as the economy, education, and government. Large-scale automation and data processing enable greater efficiency but also present complex social challenges, including technological access inequality, job displacement, and ethical and privacy concerns. This study aimed to analyze the implications of artificial intelligence (AI) on the structural transformation and dynamics of social control in society. This article discusses how AI has become a catalyst for social change, affecting human interaction patterns, job structures, and the legal regulations needed to ensure that technological advancements align with principles of justice and inclusivity. A normative juridical approach is used to analyse the impact of AI on legal and social norms, as well as how regulations can address emerging challenges. The study’s findings indicate that AI holds significant potential to improve human quality of life through efficiency and innovation but may also pose threats if not accompanied by appropriate regulations. Therefore, balanced policies are required to ensure that technological advancements are utilized while protecting human rights, allowing AI to contribute positively to social transformation. This study highlights the need for balanced and ethical regulation of AI. Practically, the findings help policymakers design fair rules to minimize the risks and maximize the benefits of AI for society

Abstract

: The purpose of this study is to investigate how consumers might be protected against improper products when purchasing and selling online. Examining the type and extent of legal protections available to consumers and sellers of non-conforming items is the main goal of this study. A clear understanding of the rights and obligations of consumers and sellers in online transactions is very important. This study uses a normative juridical approach. A normative legal research technique, which entails a qualitative examination of the legal norms found in existing laws and regulations, is employed in this study. The obligations of business actors and consumer legal protection against inappropriate products during online transactions are the main topics of this study. The results of the study show that customers are entitled to products that reflect their preferences, and sellers in the market will be held liable for such errors under the Consumer Protection Act if the goods sold do not match. In order to boost transparency and customer trust, e-commerce also plays a significant role in advising manufacturers to make sure that the pictures of the products being promoted appropriately reflect their state and in promoting the usage of actual product photos. Buyers can take legal action, both litigation and non-litigation, if the goods sold do not match the drawings.

Abstract

Perseroan terbatas dapat memenuhi kewajiban sosial dan lingkungannya jika ingin mempertimbangkan faktor-faktor tersebut saat melakukan operasi komersialnya, hal yang sama tercantum dalam Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Satu tujuan penelitian adalah untuk menentukan bagaimana Pasal 74 memenuhi kewajiban sosial dan lingkungannya. Penelitian ini menggunakan metode hukum normatif bersama dengan analisis normatif kualitatif untuk mencapai tujuannya dan mendapatkan data yang lengkap. Studi literatur dan peraturan perundang-undangan digunakan sebagai data pendukung dalam proses pengumpulan data. Selanjutnya, data yang terkumpul ditampilkan sebagai kalimat naratif yang telah disusun secara metodis. Pasal 74 Undang-Undang Nomor 40 Tahun 2007, yang terdiri dari empat pasal dan mengatur perseroan terbatas, masih belum dipenuhi oleh masyarakat bisnis, menurut kesimpulan penelitian. Undang-Undang Nomor 40 Tahun 2007 yang mengatur tentang Perseroan Terbatas, Pasal 74 ayat (2), mensyaratkan bahwa biaya yang berkaitan dengan pelaksanaan kewajiban sosial dan lingkungan harus dianggarkan, diperkirakan, dan dilaksanakan secara adil dan wajar, yang sangat relevan dalam hal ini. Dalam praktiknya, bisnis tidak menyisihkan uang untuk biaya tanggung jawab lingkungan dan sosial karena kebijakan pemilik masih mengatur bagaimana hal itu dilakukan.
