Abstract

This study aims to determine the basis of the nature of the peace deed in the settlement of murabahah disputes in the Banyumas Religious Court. The main problem to be revealed in this study is how the review of Islamic engagement law on the peace deed in the settlement of murabahah disputes in the Banyumas Religious Court. The research method used by the author is included in literature law research. This literature research focuses on the scope of legal conception, legal rules, and legal principles, not up to human behavior. The results of this study show that the Parties to the peace deed have indirectly applied some of the provisions of the engagement based on the Islamic law of engagement, both from the provisions of the principle or principle, the provisions of the pillars, and the provisions of the terms and some things are not applied under these provisions. So, the law of the peace deed is binding and can be implemented as the provisions of Islamic law by both parties. This means that the Banyumas Religious Court has implemented the positive rule of law well, but on the other hand has implemented the legal provisions that apply to Islam. This peace deed becomes the basic agreement document of the parties to execute or execute the agreement that has been decided by the judge. Thus, the parties must abide by it in order for the benefit of this agreement to be achieved.

Abstract

Sharia advocates (Sharia lawyers) in Indonesia face the challenge of maintaining their significant role amidst the dominance of general advocates. This research evaluates the professionalism of Sharia advocates in the Banyumas region, focusing on the Banyumas Religious Court, Banyumas District Court, Purwokerto Religious Court, and Purwokerto District Court. This study used a qualitative and constructivist approach and collected primary data through interviews with Sharia advocates and secondary data from documents. Findings indicate that legislation recognizes Sharia advocates as professional advocates eligible to practice in all courts, akin to general advocates. However, Islamic universities, especially Sharia faculties, need to prepare graduates to compete with general law graduates for advocacy roles. In the Banyumas region, Sharia advocates provide legal services primarily in civil law cases under religious court jurisdiction across four courts. The main challenge for Sharia advocates is the public perception that they only handle Islamic legal cases and only practice in religious courts. Furthermore, there is a strong negative stigma among legal practitioners regarding the low proficiency of Sharia advocates in positive law, leading to their limited involvement in handling cases in District Courts (Civil Courts).

Abstract

Indonesian legislation stipulates that individuals from foreign countries residing in Indonesia and foreign legal entities with representatives in the country are expressly barred from possessing land. This provision poses challenges for individuals in marriages involving different nationalities, particularly when one spouse is an Indonesian citizen, as it complicates the process of acquiring ownership rights and building usage rights for a property. This research explores the legal regulations pertaining to marital property in marriages involving individuals of distinct nationalities, navigating the intersection between national law and Islamic law. Employing qualitative research methods with a normative approach, the study relies on legal materials as primary data sources. The findings of this study indicate that, in accordance with national law, assets acquired during the course of marriage are deemed joint property. Nonetheless, it is noteworthy that this provision does not extend to marital assets in the form of land and buildings for foreign spouses. Conversely, Islamic law does not explicitly delve into this matter. Nevertheless, it delineates that the resolution of joint property in marriages encompassing individuals of diverse nationalities is governed by national laws pertaining to citizenship rights. In the case of foreign citizens, the relevant statute is the Agrarian Law, which specifically governs ownership rights concerning land and buildings.

Abstract

This study explores family resilience in the Banyumasan community through a socio-cultural perspective, drawing on Walsh’s Family Resilience Framework, the Double ABC-X Model, and Bronfenbrenner’s ecological systems theory. Employing a qualitative approach with interviews, participant observation, and documentation, data were collected from twelve households across peri-urban, highland, and lowland contexts, alongside community leaders, religious figures, and women’s group activists. The findings show that resilience is anchored in gotong royong (mutual cooperation), egalitarian interaction, and the cultural symbolism of the Ngapak dialect. Belief systems shaped by Islamic faith and Banyumasan pragmatism facilitate meaning-making, while kinship-based networks and neighbourly solidarity sustain economic and social survival. Direct, humorous communication reduces ambiguity and enhances collective problem-solving. Livelihood diversification strengthens economic security, whereas migration simultaneously improves material welfare and strains relational and educational dimensions. By linking these dynamics to national policy indicators, the study demonstrates that Banyumasan families exemplify resilience processes that are both culturally distinctive and policy-relevant, offering insights for culturally grounded and migration-sensitive interventions.

Abstract

Program pengabdian kepada masyarakat (PkM) tentang sertifikasi wakaf di MWC NU Purwokerto Barat merupakan kolaborasi pengabdian dosen UIN Saizu Purwokerto dengan mitra MWC NU Purwokerto Barat dengan tujuan sosialisasi dan publikasi hasil sertifikasi wakaf bagi masyarakat Nahdliyyin di Purwokerto Barat. Jumlah penduduk Purwokerto Barat sebanyak 55535 jiwa, Muslim 53119 (95,65%), Kristen 1234 (2,22%), Katolik 1099 (1,98%), Hindu 16 (0,03%), Budha 56 (0,10%), Konghucu 9 (0,02%), dan Kepercayaan 2 (0,00%). Dari segi kuantitas mayoritas masyarakat Purwokerto beragama Islam dengan afiliasi organisasi masyarakat Nahdlatul Ulama. Kegiatan pengabdian dengan model FGD dengan menghadirkan pengurus MWC NU, Nadhir NU dan Petugas KUA Purwokerto Barat yang diadakan di Gedung MWC NU Purwokerto Barat. Beberapa narasumber menyampaikan bahwa pendataan sertifikasi wakaf di bawah NU harus segera ditindaklanjuti dengan serius, sehingga masjid, mushola, madrasah di bawah NU dapat terdokumentasikan. Saat ini data sertifikasi wakaf di Kecamatan Purwokerto Barat sebanyak 179 tanah wakaf seluas 4.467,10 Meter2, dengan 97 telah bersertifikat dan 82 belum bersertifikat. Dari data tersebut baru 8 sertifikasi wakaf yang diserahkan ke Nadhir di bawah MWC NU Purwokerto Barat, dan saat ini ada 7 sertifikasi wakaf yang masih proses sertifikasi.

Abstract

Ash-Shiddieqy’s introduction of the term Indonesian fiqh was a compromise between Indonesian nationalism and Muslim reformism. By making Indonesian customs one of the sources of Indonesian fiqh. His conceptualization of “Indonesian fiqh”, through his immersion in classical Arabic texts and the writings of later reformers from the Middle East, and Hazairin’s emphasis on the role of particular cultural circumstances in shaping the Islamic content of Indonesian law, both show a comparable comparison. initiatives in the 1980s and 1990s. All of these writing initiatives continue to be the backdrop for legal discussion and debate among Indonesian Muslim intellectuals in the early twenty-first century. Indonesian fiqh can be interpreted as a concept of fiqh that is more locally based in Indonesia. Hasbi As-Shiddiqi and Hazairin are the two figures who initiated the Indonesian model of Fiqh, in addition to other scholars. Hasbi Hasbi was one of the reformers who offered his ideas comprehensively, starting from his concept of “Indonesian Jurisprudence”, to legal reform that includes both principles and methods. Meanwhile, Hazairin proposed the development of a new inheritance system which was interpreted and elaborated based on the scriptural perception of the Qur’an and Sunnah that it was not a patrilineal system, but a bilateral one, namely the family model
