Abstract

Law enforcement in Indonesia faces challenges in addressing the rampant practice of prostitution, particularly involving service users and traditional commercial sex workers. Despite government efforts to reduce involvement in prostitution, the absence of specific regulations in Indonesian law has allowed users of these services to evade appropriate legal consequences. This research aims to highlight the urgency of criminalising both traditional commercial sex workers and their clients. The primary issue stems from economic factors, such as an individual's income or needs, particularly the difficulties faced by women in meeting their needs due to a lack of skills, which reduces their competitiveness in the job market. Additionally, there is a significant gap in the legal framework concerning regulation.  This study employs a normative juridical method, utilising legislative, conceptual, and comparative approaches. The researchers analysed secondary legal materials, including local regulations from DKI Jakarta, Indramayu District, Tangerang City, Denpasar City, Badung Regency in Bali, Batam City, and Bandung Regency. Additionally, they examined Dutch regulations on brothels, specifically the "Wet Regulering Prostitutie en Bestrijding Misstanden Seksbranche" (Regulation on Prostitution and Combating Abuses in the Sex Industry).  The findings suggest a pressing need to integrate these regulations into the NATIONAL CRIMINAL CODE to enable the prosecution of both traditional sex service users and workers. Alternatively, adopting the Dutch policy of legalising brothels, where owners must demonstrate consistent tax payments and non-involvement in criminal activities, could be beneficial. Such measures aim to prevent issues like HIV/AIDS and human trafficking.

Abstract

Pengadaan tanah untuk pembangunan infrastruktur publik merupakan salah satu tugas penting pemerintah dalam rangka menyediakan kebutuhan dasar bagi masyarakat. Artikel ini membahas peran pemerintah dalam pengadaan tanah dengan menyoroti mekanisme dan kebijakan yang diterapkan berdasarkan Peraturan Pemerintah No. 19 Tahun 2021 tentang Penyelenggaraan Pengadaan Tanah untuk Kepentingan Umum. Studi ini menganalisis tahapan-tahapan penting dalam proses pengadaan tanah, termasuk perencanaan, persiapan, pelaksanaan, dan penyerahan hasil, serta bagaimana kebijakan ini diterapkan dalam konteks proyek infrastruktur. Dengan menggunakan pendekatan deskriptif kualitatif, penelitian ini mengevaluasi efektivitas peran pemerintah dalam mengelola kepentingan publik, mengatasi tantangan operasional, dan mewujudkan keadilan dalam kompensasi kepada pemilik tanah. Hasil studi ini menunjukkan bahwa implementasi yang baik dari kebijakan pengadaan tanah dapat mempercepat proses pembangunan infrastruktur, namun juga memerlukan koordinasi yang efektif antar lembaga serta pemahaman yang mendalam tentang regulasi yang berlaku. Rekomendasi yang dihasilkan diharapkan dapat membantu memperkuat peran pemerintah dalam pengadaan tanah dan mendukung pembangunan yang berkelanjutan serta bermanfaat bagi kesejahteraan masyarakat luas.

Abstract

The proliferation of artificial intelligence (AI) in the creative sector presents novel legal and ethical challenges to existing intellectual property (IP) frameworks. This study aims to explore how the growing role of AI in producing original works affects current IP laws, particularly in determining ownership and originality. Using a narrative review method, the research synthesizes literature sourced from Scopus, Google Scholar, and PubMed, filtered through strategic keyword combinations and strict inclusion criteria. It examines interdisciplinary findings covering legal theory, policy, ethics, and empirical case studies from multiple jurisdictions. The results indicate that while human involvement in algorithm design remains central to IP claims, the autonomous creative contributions of AI necessitate reformulation of legal concepts such as authorship and originality. Moreover, the study reveals significant jurisdictional disparities in legal treatment of AI-generated works, with systemic issues such as lack of international harmonization and outdated legislation contributing to legal uncertainty. Ethical concerns around dataset use and the risks of unauthorized reproduction also emerge as central themes. The discussion proposes solutions including sui generis IP models, blockchain verification systems, and cross-border policy frameworks to address these issues. The study concludes by emphasizing the urgency of coordinated legal innovation and ethical governance to ensure fair and effective IP protection in the AI era.

Abstract

This narrative review explores the dynamic interplay between legal positivism and natural law within contemporary legal systems, emphasizing their convergence in contexts of legal pluralism. The study aims to analyze how law and morality intersect and influence regulatory effectiveness across various jurisdictions. Drawing from academic databases including JSTOR, Scopus, and Web of Science, the review applies qualitative content analysis of peer-reviewed literature, focusing on legal frameworks, institutional roles, and sociocultural factors. Findings indicate significant regional differences in how legal systems balance statutory authority with ethical norms. European Union nations often implement value-driven regulations grounded in human rights and democratic accountability, while authoritarian regimes and postcolonial states face challenges due to institutional fragility and legal dualism. Institutions play a critical role in norm-setting and public trust, with successful cases demonstrating that moral legitimacy enhances legal compliance. Sociocultural factors further mediate the public’s response to laws, revealing tensions where formal law diverges from local values. Interventions such as EU compliance mechanisms and participatory justice reforms show promise in bridging the law-morality divide. The review underscores the urgency for systemic reform, advocating inclusive policy frameworks that integrate moral reasoning and community-based legal practices. These insights offer a roadmap for future research and policy interventions aimed at creating more just, culturally responsive legal systems.

Abstract

This study reviews global regulatory responses to platform dominance in digital markets. It examines the interplay between competition law and data protection, focusing on ex-ante approaches such as the EU Digital Markets Act. Using a narrative review of peer-reviewed literature, the findings show that preventive frameworks are more effective than traditional ex-post models in curbing anti-competitive practices. Evidence highlights systemic risks from data asymmetry and algorithmic manipulation, particularly in developing countries with limited enforcement capacity. The review underscores the need for coherent policies that balance innovation, fairness, and user rights, recommending further research on algorithmic accountability, harmonized governance, and the socioeconomic impacts of digital regulation.
