Abstract

This qualitative study using a descriptive-conceptual approach aims to examine the challenges and urgency of language experts in analyzing legally consequential utterances in incitement crimes. Utilizing a forensic linguistics framework and literature study, data were analyzed semantically and pragmatically through an illustrative case study of incitement. The findings indicate that utterances underlying incitement crimes do not always manifest as direct imperatives; rather, they can take the form of indirect permissive statements that gain directive force through the context of a rioting event. Language experts face several methodological challenges, including non-explicit language forms, ambiguity, inferring the speaker's communicative intent, data quality, integration with non-linguistic evidence, and maintaining expert independence. Forensic linguistic analysis is highly urgent for providing structured and objective linguistic explanations to prevent intuitive or subjective interpretations. This study concludes that the role of language experts is strategic in offering data-driven scientific explanations regarding the form, meaning, and pragmatic function of utterances to assist legal proceedings, without encroaching upon the court's authority to determine criminal liability.
