Abstract

The sport sector is not only a matter of health or the pride of a nation. More than that, the sport is closely related to social welfare aspect. Therefore, it needs to be managed optimally by referring to the principles of good governance specifically in the sport sector. This study discusses the concept of Good Sport Governance, both from theoretical and legal perspectives, and its contextualization in Indonesia. This study uses doctrinal legal research methods and utilizes secondary data. Data analysis is carried out qualitatively using conceptual and statute approaches. This study concludes that the principles of Good Sport Governance need to be applied in managing the sport sector in Indonesia because in fact the dynamics of the sport sector in Indonesia still require a lot of improvement. Good Sport Governance contains several main principles, such as the principles of transparency, democracy, control and solidarity. Furthermore, in the Indonesian context, Good Sport Governance is also equipped with the principle of deliberative discussion.

Abstract

This study examines Indonesia’s sports dispute resolution landscape as well as the potential for building a comprehensive sports dispute settlement framework in Indonesia, analyzing current regulatory practices, arbitration processes, and alternative dispute resolution (ADR) mechanisms in the context of sports activities in Indonesia. This research will use doctrinal legal research methods and employs secondary data. Those data especially in the form of several legal materials, such as primary legal materials like acts or regulations as well as secondary legal materials like some studies conducted by several researchers previously. Data analyze will be undertaken qualitatively. By analyzing these issues, the paper outlines the necessary adjustments to Indonesia’s regulatory structure and the potential benefits of a dedicated sports dispute resolution body. It is important to harmonize arbitration processes with international standards to foster credibility especially after Indonesia has unified several arbitration institutions become only one institution, namely BAKI

Abstract

Kajian ini membahas mengenai konsep dan prinsip-prinsip tata kelola yang baik di bidang keolahragaan (Good Sport Governance) yang dihubungkan dengan lembaga arbitrase keolahragaan di Indonesia. Metode kajian yang digunakan untuk membahas hal tersebut adalah metode kajian doktrinal. Untuk itu, kajian akan fokus mencermati data sekunder, baik yang berupa bahan hukum primer maupun sekunder. Kajian ini menyimpulkan bahwa prinsip-prinsip Good Sport Governance sudah diadopsi ke dalam sistem hukum keolahragaan di Indonesia yang diatur dalam Undang-Undang Nomor 11 Tahun 2022 tentang Keolahragaan, yang mana di dalamnya juga memuat mekanisme penyelesaian sengketa keolahragaan melalui arbitrase. Arbitrase keolahragaan itu mengandung nilai-nilai profesionalisme, mengutamakan win-win solution serta prosedur yang sederhana dalam penyelesaian sengketa, dan nilai-nilai tersebut secara substansial sesuai dengan prinsip-prinsip Good Sport Governance.
