Abstract

Perkembangan teknologi informasi dan komunikasi berlangsung sangat pesat serta membawa perubahan besar terhadap kebutuhan manusia, budaya masyarakat, kebiasaan, norma, dan adat istiadat. Perubahan tersebut meningkatkan kualitas hidup masyarakat, tetapi juga menimbulkan tantangan hukum baru, khususnya terkait penggunaan Artificial Intelligence (AI). Pemerintah Indonesia telah menetapkan berbagai instrumen perlindungan hukum, salah satunya Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Selain itu, pemberlakuan Undang-Undang Nomor 20 Tahun 2025 tentang Kitab Undang-Undang Hukum Acara Pidana memperkuat pemanfaatan teknologi informasi dalam proses peradilan pidana, mulai dari tahap pemeriksaan hingga akuntabilitas aparat penegak hukum. Penelitian ini bertujuan menganalisis urgensi pengaturan dan perlindungan rights of privacy terhadap AI. Metode yang digunakan adalah penelitian hukum normatif melalui studi kepustakaan terhadap peraturan perundang-undangan yang berlaku di Indonesia. Hasil penelitian menunjukkan bahwa Indonesia belum memiliki regulasi khusus yang memadai untuk mengatur AI. Oleh karena itu, diperlukan regulasi khusus AI sebagai kontrol sosial untuk mencegah penyalahgunaan konten berbasis AI serta melindungi kepentingan negara, sosial, dan pribadi.

Abstract

This study discusses the legal implications of using blockchain technology in civil transactions, focusing on aspects such as smart contracts, proof of ownership, data security, and regulation. Blockchain technology offers advantages such as transparency, security, and efficiency but also presents various legal challenges that need to be addressed. Smart contracts have the potential to be considered valid if they meet applicable contractual requirements, but their automatic and rigid execution can cause problems in certain situations. Proof of ownership recorded on the blockchain requires legal recognition to be valid and accepted in court, while the transfer of ownership through blockchain requires clear regulations to ensure its legality. In terms of data security, blockchain offers high protection but raises challenges related to privacy and compliance with data protection regulations such as GDPR. Clear and comprehensive regulations are needed to support the safe and effective adoption of blockchain, but many jurisdictions still lack an adequate legal framework. This study recommends the development of relevant regulations, increased education and awareness about blockchain, and further research to develop best practices and industry standards. With the right approach, blockchain technology can enhance efficiency, security, and trust in civil transactions

Abstract

This study analyses the legal certainty of circular resolutions outside the General Meeting of Shareholders (GMS) on nominee shares based on Decision Number 815/PDT/2022/PT SBY. This study focuses on the legality and legal implications of circular resolutions in corporate practice in Indonesia. Through a normative juridical approach and analysis of relevant regulations and case law, this study finds that circular resolutions made without fulfilling formal and material requirements may be potentially legally invalid. The results of this study provide recommendations on the need for stricter law enforcement regarding the use of nominee shares in the Indonesian legal system.

Abstract

The concept of interfaith marriage is not uncommon in Indonesian society, which is diverse in terms of race, ethnicity, culture, and religion. Law Number 1 of 1974 Governing Marriage governs marriages in general, however, it makes no distinctions for marriages based on specific religions. This paper examines the Central Jakarta District Court's rulings on interfaith unions and how they relate to the relevant legal statutes. This study uses a descriptive qualitative approach to analyze data gathered from primary legal sources, such as court decisions. The purpose of the analysis was to determine if the Central Jakarta District Court's ruling accords with Law Number 1 of 1974's Article 2 Paragraph 1 on marriage. The court granted the request for an interfaith marriage based on the Population Administration Law's Article 35 letter a and the Supreme Court's decision in Case Number 1400 K/PDT/1986, according to study findings. Despite taking into account both legal and societal factors, the judgment falls short of meeting all of Law Number 1 of 1974's conditions for a valid marriage. This research contributes to our understanding of Indonesian interfaith marriages and the future direction of family law. It is crucial to have more debates and analyses regarding the legitimacy of interfaith unions as well as to pass legislation that addresses this matter. To facilitate just interfaith weddings, coordination between religious, legal, and social organizations must also be taken into account.

Abstract

Crypto-asset consumers depend on regulated intermediaries to execute transactions and, in certain arrangements, to safeguard digital assets. This dependence creates a legal question when unauthorized access or another cyber incident causes an asset outflow or service disruption. This article examines the allocation of preventive and remedial duties under Indonesian law and the conditions under which a Digital Asset Trader may be held liable for hacking-related losses. It uses normative legal research with statutory, conceptual, and limited comparative approaches, supported by an event illustration concerning the September 2024 Indodax incident. The event sources are limited to company statements, news reports, and publicly observable information; no court judgment, regulator finding, internal ledger, or forensic report was available. The study finds that POJK Number 27 of 2024, as amended by POJK Number 23 of 2025, already differentiates the duties of Digital Asset Traders and Custody Managers, requires separate records and custody arrangements, and assigns responsibility for crypto assets stored by each entity. Consumer redress is also available through internal complaints, LAPS SJK, OJK action, contract, consumer-protection law, and tort. Liability nevertheless requires proof of a legal duty, breach of the applicable standard of care, foreseeability, causation, actual recoverable loss, and the absence of a valid defence. The remaining gaps are narrower: Indonesia has no hacking-specific automatic compensation fund, no uniform public assurance model reconciling reserves with customer liabilities, and no detailed common protocol for valuing complex losses. Because the required evidence is unavailable, legal responsibility for the Indodax incident cannot be conclusively determined

Abstract

This research aims to find out how the legal position of the parties in the implementation of online arisan and to find out how legal protection for online arisan members who are harmed due to default. The research method used is normative research method. The purpose of this method is to identify legal principles, legal rules, and expert opinions to answer issues related to legal problems, such as the legality of online arisan agreements according to the Civil Code and legal protection for online arisan members in the event of default by one of the parties. From the research conducted, the author obtained the following results: First, the legal position in online arisan consists of the arisan owner as the first party, arisan members as the second party, and the admin or arisan assistant as the third party. If there is a default during the implementation of online arisan, the aggrieved party can choose to resolve the problem through family channels. If the family route is unsuccessful, then dispute resolution must be pursued through legal channels in court by submitting a subpoena. Although the online arisan agreement is unwritten, the agreement is still considered valid. Second, legal protection for online arisan members includes preventive and repressive legal protection. Preventive legal protection for online arisan members is regulated in Article 28 paragraph (1) of Law Number 19 of 2016 Concerning the Amendment to Law Number 11 of 2008, which regulates prohibited acts in electronic transactions, as well as Article 1320 and Article 1338 of the Civil Code, which regulates the provisions of the agreement so that it can be implemented properly. Meanwhile, repressive legal protection is regulated in Article 45 to Article 52 of Law Number 19 of 2016, which regulates sanctions for violation of provisions, as well as Article 1243 of the Civil Code, which discusses compensation due to default.
