Abstract

The legalization of marriage or isbat nikah is a legal process regulated in Undang-Undang Nomor 1 Tahun 1974in Indonesia, aiming to provide legal certainty and protection for married couples. The study focused on cases of marriage legalization in Martapura, South Kalimantan, from 2021 to 2022, which identified challenges in implementing regulations, especially related to unofficially registered marriages and the practice of underage marriage. The study results show that although there are clear legal provisions, their implementation is often influenced by the social and cultural norms of the community. The cases rejected and granted by judges reflect the complexity of handling serial marriages, where there is a conflict between state law and religious validity. A holistic approach is needed to raise awareness of the importance of marriage registration and protecting children's rights so that all marriages can be legally recognized.

Abstract

This research examines the urgency of reform and harmonization Undang-Undang Narkotika (UU No. 35 Tahun 2009) dan Undang-Undang Informasi dan Transaksi Elektronik (UU No. 19 Tahun 2016) in facing the challenges of drug crime in the digital era. Through a normative juridical analysis of current cases and weaknesses in existing regulations, this study identifies an urgent need to expand the definition and scope of technology-based narcotics crimes, strengthen digital evidentiary aspects, regulate digital platform responsibilities, enhance international cooperation, integrate digital rehabilitation approaches, and provide special protection for children and adolescents in cyberspace. The study also emphasizes the importance of harmonization of the two laws accompanied by increasing the capacity of law enforcement in digital forensics and the use of advanced technologies such as artificial intelligence (AI) and big data analysis, while still paying attention to ethical aspects and human rights protection. The results of the study show that a comprehensive approach to legal reform is needed to create a more responsive and effective regulatory framework in tackling drug crime in the digital era, as well as anticipating technological developments and adaptations carried out by drug offenders in the future.

Abstract

This study discusses the influence of social media on the increase in cybercrime in Indonesia and the challenges of criminal law enforcement in dealing with it. Using normative legal research methods, this study analyses applicable regulations, technical barriers, and social dynamics that affect the effectiveness of law enforcement against cybercrime, especially those that originate from activities on social media. The study results show that the high penetration of social media, low digital literacy, and the development of increasingly complex crime modes have encouraged an increase in cybercrime cases. On the other hand, law enforcement still faces regulatory limitations, a lack of competent human resources, cross-border jurisdictional challenges, and weak coordination between agencies. This research recommends adaptive regulatory reforms, capacity building of law enforcement officials, strengthening national and international cooperation, and public digital literacy education to create a safer and more equitable digital ecosystem.
