Abstract

ABSTRACTThe notary commits a violation by canceling the sale and purchase binding agreement (PPJB) himself and replacing it with a new deed due to an error in the name of the buyer's object. This study aims to evaluate the validity of the cancellation and replacement of PPJB by a notary without any applicable legal procedures, as well as the responsibility of the notary for the legal implications in case Number 35/Pid.B/2022/Pn. but The research method used is normative juridical. The results of the study concluded that UUJN does not allow a notary to cancel the PPJB deed itself. Violations by a notary can be subject to sanctions in the form of suspension, compensation, and imprisonment if proven.Keywords: Cancellation; Unilateral; PPJB; Notary LiabilityABSTRAKNotaris melakukan pelanggaran dengan membatalkan sendiri akta perjanjian pengikatan jual beli (PPJB) dan menggantinya dengan akta baru karena kesalahan objek nama pembeli. Penelitian ini bertujuan untuk mengevaluasi validitas pembatalan dan penggantian PPJB oleh notaris tanpa prosedur hukum yang berlaku, serta tanggung jawab notaris atas implikasi hukum dalam kasus Nomor 35/Pid.B/2022/Pn. Tpg. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian disimpulkan bahwa UUJN tidak memperbolehkan notaris membatalkan akta PPJB sendiri. Pelanggaran notaris dapat dikenai sanksi berupa pemberhentian sementara, ganti rugi, dan pidana jika terbukti.Kata Kunci: Pembatalan; Sepihak; PPJB; Pertanggungjawaban Notaris
