Abstract

Konvensi Internasional tentang Perlindungan Hak-Hak Seluruh Pekerja Migran menjadi instrumen penting dalam memastikan hak-hak dan perlindungan pekerja migran di tingkat internasional. Konvensi Internasional tentang Perlindungan Hak-Hak Seluruh Pekerja Migran memberikan kerangka kerja yang komprehensif untuk melindungi hak-hak pekerja migran, termasuk hak-hak yang relevan dengan kejahatan kemanusiaan. Namun, implementasinya masih menghadapi beberapa tantangan, seperti ketidakpatuhan negara-negara tujuan migrasi dan kurangnya mekanisme penegakan yang efektif. Studi kasus kejahatan kemanusiaan tenaga kerja Indonesia di Myanmar menggambarkan pelanggaran hak-hak pekerja migran dan perlakuan yang tidak manusiawi terhadap mereka. Hal ini menunjukkan perlunya tindakan yang lebih kuat dan langkah-langkah perlindungan yang lebih efektif oleh pemerintah Indonesia, pemerintah Myanmar, dan komunitas internasional.

Abstract

The European Union Deforestation Regulation (EUDR), implemented in 2023, requires transparent supply chains to prevent imported products from contributing to illegal deforestation, presenting both challenges and opportunities for Indonesia as a leading exporter of palm oil and timber. This study explores how natural law principles, emphasizing ecological justice and the moral balance between humans and nature, can serve as an ethical foundation to meet EUDR requirements. By integrating these principles into policy reforms such as enhancing the Indonesia Sustainable Palm Oil (ISPO) certification, investing in green technologies, and fostering international collaboration, Indonesia can overcome economic barriers and lead in sustainable trade.

Abstract

This journal discusses a collaborative effort in addressing the issue of narcotics abuse from the perspectives of health, prevention, and law enforcement. The program was implemented through a community service initiative in Cipambuan Village, Bogor, involving legal scholars, students, and practitioners who joined forces to provide public education. Two expert speakers from BNNK Bogor and the Police offered crucial insights into the health and legal aspects of narcotics abuse. The health component emphasized the protective role of family religiosity and harmony, while also warning about the emergence of new addictive substances in disguised forms, such as candy and snacks. These findings show that family-based prevention is an effective strategy when combined with consistent community education. On the legal side, the Police emphasized the importance of law enforcement in rural areas and encouraged community vigilance against illegal drug circulation. The synergy of these perspectives highlights the significance of preventive education and cooperative enforcement. The study demonstrates how students, through community service programs, act as agents of change by bridging academic knowledge with real-world societal issues. Moreover, the program embodies the spirit of tridharma education, research, and community service by creating sustainable collaborations between educational institutions, local communities, and government stakeholders. This integrated approach is essential to protect younger generations from the ever-evolving threats of narcotics.

Abstract

This study critically analyzes the existence of international criminal sanctions in the Ukraine and Gaza Strip conflicts from 2023 to 2025. Using a normative legal approach, this study examines the existence of international criminal sanctions, particularly those stipulated in Principle I (individual criminal responsibility), Principle III (denial of official immunity), and Principle IV (denial of superior orders), codified in Articles 25, 27, and 28 of the Rome Statute. Several obstacles to enforcing criminal sanctions are often hampered by the principle of complementarity (Article 17) and the UN Security Council veto mechanism (Article 27(3) of the UN Charter), making the existence of criminal sanctions through ICC decisions unenforceable. This is evident in the failure to execute the arrest warrant against Putin (March 17, 2023) for the deportation of 19,144 Ukrainian children and four simultaneous warrants against Netanyahu, Gallant, and Hamas leaders (May 20, 2024). Six Russian vetoes against Ukraine (2022 2024) and 46 US vetoes related to Israel Palestine since 1972 paralyze the reference to Article 13(b) then to what extent the existence of criminal rules for crimes imposed on the Ukraine and Gaza Strip conflicts in the period 2023-2025, how can the UN council veto rules affect this existence? So it can be concluded that to what extent the criminal rules in punishing perpetrators of international crimes exist so that they can realize an international criminal system that is not only decorative but can also be implemented effectively as a form of deterrence for perpetrators and a last resort in eliminating the existence of international crimes.
