Abstract

Purpose:This study examines the effectiveness of the Compilation of Islamic Law (KHI) in handling divorce cases through talak, khulu’, and fasakh in Indonesia. This study aims to understand the significant role of KHI in providing justice for couples experiencing marital conflict.Methodology:Using library methods, data were collected from various literature sources and religious court decisions related to talak, khulu’, and fasakh. This study uses a library method, a systematic approach to reviewing and analyzing data from various literatures. This library research type studies theory, concepts, and regulations relevant to divorce cases through talak, khulu', and fasakh decisions.Findings:The results show that KHI functions not only as a formal rule but also as an instrument of protection for women and children and supports post-divorce welfare. These findings confirm that KHI has important flexibility relevant to the country's social conditions and can be used as a model for ethically and contextually responsive Islamic family law.Implication:This research provides an essential contribution to the development of science, both theoretically and practically. Theoretically, this research strengthens the understanding of the adaptation of Islamic law in the modern context, mainly how the KHI as a derivative of Islamic law can be applied effectively in a pluralistic society. Practically, this research enriches the study of Islamic family law in Indonesia by providing empirical data showing that the mechanisms of talak, khulu', and fasakh can be implemented formally and ethically.

Abstract

The Compilation of Islamic Law (KHI), as a legal guideline for Muslims in Indonesia, regulates in detail the Fasakh and Khulu mechanisms in resolving domestic conflicts. This study aims to provide a comprehensive analysis of these divorce mechanisms, focusing not only on their legal aspects but also on their social and psychological implications for individuals and families within the Indonesian Muslim community. The study used a juridical-normative approach that focused on legal analysis contained in the KHI. First, secondary data consisted of books, journals, and articles that discussed this topic from both the perspective of Islamic law and positive law in Indonesia. Then, case studies were conducted by identifying several divorce cases in religious courts. The findings reveal several key points related to the divorce mechanisms in the broader framework of KHI, including a lack of public understanding, social stigma, and limited resources in religious court. Finally, the study provides strategic recommendations for improving their implementation. These findings can inform policymakers, legal practitioners, and community leaders about the importance of these mechanisms in supporting the rights and welfare of individuals within the community.

Abstract

Purpose:The urgency of this topic lies in the increasing tension between religious norms, individual constitutional rights, and the implementation of positive law, which is often ambiguous or repressive. This study aims to systematically analyze and compare the legal aspects, sanctions, and administrative procedures of conversion from Islam in both countries.Methodology:This study uses a qualitative approach with a normative-comparative method, utilizing secondary data in the form of legal regulations, court decisions, and current academic literature. The analysis is carried out through document studies and content analysis of the national legal framework and religious institutions that play a role.Findings:The results of the study show that Malaysia has a more structured legal system through the Sharia Court in regulating applications to leave Islam, although the procedures tend to be restrictive and accompanied by administrative or criminal sanctions. On the other hand, Indonesia adopts a more flexible administrative approach but is vulnerable to legal uncertainty and social pressure.Implication:The conclusion of this study states that protection of the right to convert requires clear regulations, fair institutions, and inclusive social support. This study suggests the development of future empirical studies to explore the experiences of individual converts and the dynamics of legal implementation at the local level.

Abstract

Purpose:In Balikpapan City, an urban area with industrial activity and high traffic density, this practice represents a complex, risky behavior that cannot be adequately explained solely through legal or health approaches. This qualitative research aims to explore the meanings, experiences, and social processes underlying this phenomenon from the perspective of the perpetrators.Methodology:Using a phenomenological approach combined with case studies, data were collected through in-depth interviews with 15 drivers and participant observation on major roads. The data were analyzed thematically to identify essential patterns in participants' lived experiences.Findings:The research findings reveal three main themes: first, smoking functions as a psychological coping strategy to manage stress and boredom in the temporal pressure of traffic jams; second, this practice is a product of habitus normalized through social learning and peer pressure within the driving community; third, there is a constant inner dialectic between individual enjoyment and awareness of transgression and its social impact.Implication:This study contributes to the enrichment of Bourdieu's habitus theory by introducing the concepts of "mobile habitus" and "dialectical habitus," which are sensitive to the context of mobile spaces and the ambivalence of agents. Practically, these findings highlight the urgency of community-based interventions and socio-cultural approaches in road safety policy, while also opening up space for further research on the transformation of risky habitus in the context of urban mobility.

Abstract

Purpose:The urgency of this research lies in the importance of understanding how the Sharia Court applies locus standi provisions in handling these requests, which directly have implications for access to justice. This research aims to analyze juridically the decision of the Negeri Sembilan Syariah Court in the case of Noraini A/P Imara Musa, which was rejected based on the provisions of the Enakmen for Islamic Religious Administration (Negeri Sembilan) 2003 and the 2009 amendment.Methodology:The method used is qualitative research with a juridical-normative and juridical-empirical approach, through document studies, content analysis, and legal interpretation.Findings:The research findings indicate that the Court acted within its authority and applicable legal provisions, rejecting the petition because the applicant failed to meet the locus standi requirements stipulated in domestic law. This finding underscores the importance of procedural consistency in maintaining the integrity of Sharia law and preventing the Court's jurisdiction from being undermined.Implication:This research contributes to a richer understanding of the boundaries of law and religious protection within the context of an Islamic state. The implications of this research provide opportunities for strengthening the Sharia legal system and harmonizing it across countries. Future research is recommended to explore similar issues comparatively across countries to broaden the perspective of contemporary Islamic law.

Abstract

The increasingly widespread phenomenon of promiscuity shows a decline in morals and moral values among adolescents, which has an impact on the problem of adultery and increasing cases of pregnancy outside marriage. Whereas in the Islamic view, marriage is a solution to avoid adultery, but if adultery is committed it becomes a serious violation of religious teachings. This study aims to determine the legal and ethical considerations in marriage dispensation due to pregnancy out of wedlock and to determine the consideration of Maqasid Shari'ah in determining marriage dispensation due to pregnancy outside marriage. The research method used in this study is literature research, through data from sources relevant to the research, such as books and journals that discuss the analysis of Maqashid Shari'ah on the marriage of women in a pregnant state. Descriptive analysis is carried out to identify and describe various aspects, regulations, and norms related to research. The results of the study show that legal and ethical considerations in marriage dispensation due to pregnancy out of wedlock are important to maintain the benefit of individuals and society. Marriage dispensations should carefully consider the age limits on marriage, individual rights, the protection of unborn children, and their social impacts. The principles of Maqasid Shari'ah, such as the protection of religion, soul, offspring, property, and honor, serve as important guidelines in maintaining a balance between religious values and social norms in the establishment of marriage dispensation due to pregnancy out of wedlock.

Abstract

Perpindahan agama (murtad) yang terjadi dalam rumah tangga Muslim di Indonesia menimbulkan persoalan hukum yang rumit, terutama dalam konteks hukum keluarga Islam. Relevansi topik ini kian mengemuka seiring dengan meningkatnya kasus perceraian akibat perbedaan keyakinan, yang menimbulkan perdebatan antara prinsip kebebasan beragama dan norma-norma fikih. Kajian ini bertujuan untuk menelaah secara kritis prosedur fasakh sebagai mekanisme pembubaran pernikahan karena murtad, ditinjau dari perspektif hukum Islam dan hukum positif nasional, serta menelusuri praktik pengambilan keputusan di lingkungan Pengadilan Agama. Penelitian ini menggunakan pendekatan yuridis-sosiologis dalam kerangka penelitian kualitatif, dengan teknik pengumpulan data berupa studi dokumen terhadap putusan-putusan pengadilan dan analisis isi terhadap argumentasi hukum yang dikembangkan oleh para hakim. Data primer diperoleh dari sepuluh putusan Pengadilan Agama dan Mahkamah Agung yang menyebutkan murtad sebagai dasar perceraian, dilengkapi dengan sumber literatur hukum Islam dan yurisprudensi terkait. Temuan utama menunjukkan bahwa murtad telah diterima sebagai dasar yuridis sah untuk memutuskan perkawinan melalui fasakh. Kendati demikian, terdapat disparitas antar putusan hakim, khususnya dalam hal penetapan hak ekonomi bagi pihak istri pasca perceraian. Kajian ini menyumbangkan wawasan praktis penting berupa rekomendasi pembentukan pedoman nasional dari Mahkamah Agung guna menyelaraskan pelaksanaan hukum dan menjamin perlindungan hukum yang setara bagi para pihak. Kesimpulannya, diperlukan upaya harmonisasi antara norma fikih dan hak asasi manusia dalam menangani perkara yang bersifat sensitif seperti murtad, serta pembentukan regulasi teknis yang lebih rinci bagi peradilan agama. Penelitian lanjutan disarankan mengambil pendekatan lapangan untuk mengeksplorasi dimensi sosial dan subjektif yang turut membentuk pertimbangan hakim.
