Abstract

AbstrakAdanya pengunggah ulang pada Youtube memberikan dampak kerugian bagi konten kreator. Kerugian yang ditimbulkan berupa hak ekonomi atas konten diunggah ulang, dengan maraknya pengunggah ulang maka diperlukan penelitian mengenai perlindungan hukum bagi konten kreator terhadap pengunggah ulang. Tujuan penelitian untuk mengetahui pengaturan hukum konten kreator terhadap pengunggah ulang menurut peraturan perundang- undangan dan perlindungan hukum bagi konten kreator terhadap pengunggah ulang berdasarkan Undang- Undang Hak Cipta. Penelitian ini menggunakan metode yuridis normatif, Hasil dari penelitian ini bahwa adanya pengunggah ulang menimbulkan kerugian konten kreator telah diatur pada peraturan undang- undangan Berkaitan dengan perlindungan hukum terhadap seorang pembuat konten dengan adanya pengunggah ulang yaitu penyelesaian sengketa melalui alternatif penyelesaian sengketa, arbitrase dan jalur pengadilan sebagai upaya represif dan melakukan pencatatan karya cipta, bergabung sebagai anggota Badan Manajemen Kolektif dan mengaktifkan fitur content id pada Youtube. AbstractThe existence of re-uploads on YouTube has a detrimental impact on content creators. The losses incurred are in the form of economic rights for re-uploaded content. With the rise of re-uploads, research is needed regarding legal protection for content creators against re-uploaders. The aim of the research is to determine the legal regulation of content creators for re-uploaders according to statutory regulations as well as legal protection for content creators for re-uploaders based on the Copyright Law. This research uses normative juridical methods. The results of this research are that re-uploading causes losses to content creators which have been regulated in statutory regulations relating to legal protection for content creators with re-uploading, namely resolving disputes through alternative dispute resolution, arbitration and court proceedings. as a repressive effort and to record copyrighted works, join as a member of the Collective Management Institute and activate the content ID feature on YouTube.

Abstract

The aim of this research is to find out about the implementation of the principle of simplicity in tax collection in Indonesia. Tax collection by the government must be based on the principle of simplicity. The principle of simplicity means that the taxes collected by the government must be easy and understandable by the public. Currently, it is estimated that Indonesians have around 40 identity numbers, including taxpayer identification numbers. So, to achieve the principle of simplicity in tax collection, the government issued a policy regarding the integration of NIK and NPWP as one unit in managing tax administration. This research is normative legal research with a deeper understanding of secondary information in the form of literature reviews and related laws and regulations. The results of this research show that the application of NIK to NPWP as a means of tax administration has been regulated in Law Number 7 of 2021 concerning Harmonization of Tax Regulations, and Regulation of the Minister of Finance of the Republic of Indonesia No. 112/PMK.03/2022 with the policy of integrating NIK and NPWP, it will have the potential to increase the number of taxpayers in Indonesia, as well as tax revenues in Indonesia.

Abstract

This study examines the constitutional limits of regional government authority in restricting religious activities and analyzes their implications for legal certainty concerning religious deeds and permits. Although decentralization grants substantial administrative discretion to local governments, constitutional guarantees under the 1945 Constitution require that any limitation on religious freedom comply with legality, necessity, and proportionality standards. Normative inconsistencies arise when regional regulations introduce additional procedural burdens or discretionary mechanisms that exceed statutory delegation and potentially undermine constitutional supremacy. This research employs normative legal methodology through statute, conceptual, and case approaches by examining constitutional provisions, regional governance legislation, and relevant Constitutional Court decisions. Legal materials are analyzed qualitatively using constitutional reasoning, hierarchical norm conformity review, and proportionality assessment. The findings indicate that the constitutional boundary of regional authority lies in strict adherence to proportionality parameters, including legitimate aims, suitability, necessity, and balancing. Furthermore, regional restrictions have significant implications for administrative legal certainty, particularly regarding the issuance of religious permits and the enforceability of related civil documentation. Regulatory fragmentation and inconsistent procedural standards risk generating unequal treatment and indirect limitations on religious freedom. The novelty of this research lies in integrating proportionality doctrine with administrative legal certainty analysis, offering a constitutional design model that harmonizes regional autonomy with fundamental rights protection without negating legitimate local governance functions.
