Abstract

AbstrakPenelitian ini bertujuan untuk menganalisa Isu Penerapan blank vote dalam pemilihan kepala daerah (Pilkada) menjadi diskursus baru saat ini, apakah blank vote dapat berfungsi sebagai solusi untuk meningkatan kualitas demokrasi atau justru menjadi sebuah anomali terhadap sistem demokrasi. Penelitian ini bertujuan untuk melihat seberapa jauh urgensi dan dampak penerapan blank vote dalam Pilkada di Indonesia. Penelitian ini menggunakan penelitian hukum normatif yang menggunakan studi kepustakaan. Lebih lanjut hasil analisa studi menegaskan bahwa Keberadaan Blank Vote menjadi sebuah diskursus, jika dilihat dari demokrasi dan legitimasi publik terhadap pemerintahan. Keberadaan blank vote atau kotak kosong di Indonesia baru dikenal ketika terdapat calon tunggal, namun konsep blank vote berbeda, karena menginginkan kotak kosong di kertas suara tampa melihat jumlah pasangan calon, sebagaimana telah di adopsi di berbagai negara lain. Gerakan penerapan blank vote dapat menjadi sinyal penting untuk melakukan reformasi sistem pemilu, namun dilain hal, jika tidak dikelola dengan baik, dapat melemahkan legitimasi proses demokrasi. AbstractThis research aims to analyze the issue of implementing blank votes in regional head elections (Pilkada) as a new discourse today, whether blank votes can function as a solution to improve the quality of democracy or instead become an anomaly in the democratic system. This research aims to examine the extent of the urgency and impact of implementing blank votes in regional elections in Indonesia. This research uses normative legal research that employs library study. Furthermore, the study's analysis results emphasize that the existence of Blank Votes has become a discourse when viewed from the perspective of democracy and public legitimacy towards the government. The existence of blank votes or empty boxes in Indonesia was only recognized when there was a single candidate, but the concept of a blank vote is different, as it desires an empty box on the ballot paper without considering the number of candidate pairs, as has been adopted in various other countries. The movement to implement blank votes can be an important signal for electoral system reform, but on the other hand, if not managed well, it can weaken the legitimacy of the democratic process.

Abstract

In practice, a lot of irregularities occur in the process of procuring goods and services both in the budget planning process, the procurement preparation process, the process of implementing the procurement of goods and services, handing over payments and in the process of monitoring and accountability. The procurement of government goods and services is indeed a wetland for a number of individuals to commit corruption. The purpose of the research is to provide a new perspective in solving the complexity of problems in the procurement of government goods and services and analyse existing problems in order to reduce legal problems in the procurement of goods / services, especially related to the formulation of problems in this study, namely How is the mechanism of procurement of goods and services in the frame of current concepts and realities and secondly, How is the best practice of financial management in the procurement of government goods and services. This research is a normative research that uses literature study. The data collection method is carried out by reading, analysing, and tracing sources through journals, books, and laws and regulations. The method of analysis used in this research is descriptive qualitative analysis, namely interpreting the data obtained in the form of sentence descriptions. The results of this study indicate that the concept of goods / services procurement is still not in line with the existing reality, where there are many problems in the procurement of goods / services both at the planning stage and the delivery of goods. So that in this study to minimise various problems in the procurement of goods / services, the government should adopt the principles of best practice in state financial management, so as to realise good governance.

Abstract

Regulation of the Minister of Research, Technology, and Higher Education (Permenristekdikti) No. 19/2017 on the Appointment and Dismissal of Leaders of State Universities indicates that the Minister of Education and Culture holds 35% voting rights to elect rectors, while the university senate holds 65% voting rights. This percentage is prone to emasculating the majority vote in universities. It has an impact on the rise of high-level lobbying ahead of the rector selection, both to political parties and to the Palace. This kind of practice undermines the independence of state universities in channelling aspirations to address the state's social issues. This research contributes to the analysis of the dynamics of rector selections in Indonesia, examining the impact of government intervention on rector independence and freedom of speech, and proposing an ideal regulatory framework based on transparency, meritocracy, and autonomy. It fills a gap in existing studies by highlighting how ministerial voting rights affect academic freedom and offering a reform-oriented model for more democratic and independent university leadership. This research is a normative juridical study that employs statutory, conceptual, and case study approaches to address the problem. The results showed that, first, government intervention in the selection of rectors is problematic in a democratic country, Second, government intervention in the selection of rectors has a significant effect on the independence of freedom of higher education in responding to social issues of state, Third, Changing the provisions of government intervention in the selection of rectors in State Universities by emphasizing transparency aspects, meritocracy and independence.
