Abstract

Sustainable Development Goals are an agenda to increase inclusive economic growth in a region. As the capital of West Kalimantan Province, Pontianak City has a vital role in increasing the realization of this development by implementing policies oriented towards sustainable development, specifically in fulfilling access to decent work in Pontianak City. One of the employment sectors that is of concern is providing parking attendants with decent work access. This research examines whether the fulfillment of access to decent work for parking attendants has been fully fulfilled by looking at access to the fulfillment of human rights and compliance with the laws regulated in existing regulatory policies in the City of Pontianak. This research was carried out using socio-legal research methods, as it will examine social rules that are confirmed based on existing laws in legislation. This research shows that several indicators still need to be met to fulfill access to decent work within the standards set in the Sustainable Development Goals. One aspect of access to decent work for parking attendants that needs to be met is that social security still needs to be a priority, as well as the lack of availability of laws governing parking management in Pontianak City. So, there needs to be consideration and strengthening in fulfilling the law so that parking attendants get clear legal status and legal availability to realize decent work and economic growth according to the 8 Sustainable Development Goals.

Abstract

Cryptocurrency in Indonesia presents both advantages and challenges. The Indonesian government has not yet given legality to cryptocurrency as legal tender. However, even though it does not have specific regulations, this matter regarding crypto is described as a crypto asset in several legal regulations in Indonesia. This study aims to examine the potential for implementing cryptocurrency as legal tender in Indonesia and whether it can be regulated within the country's legal framework. It also compares Indonesia's situation with the legal systems of El Salvador and the Central African Republic, where cryptocurrency has been adopted as legal tender. This study was studied in a socio-legal research method review, which used several approaches from a legislative perspective, case studies, and a comparison of state laws.  The findings reveal that while there is no specific law in Indonesia that regulates cryptocurrency as legal tender, there are existing regulations governing crypto assets, overseen by the country's futures supervisory agency. Crypto in Indonesia does not yet meet the standard requirements as legal tender, such as tability of value, divisibility, and uniformity. Based on a comparison of laws in El Salvador and the Central African Republic that have established crypto as legal tender, several comparisons can be seen starting from the structure, substance, and legal culture, where support for regulations and institutions as well as community support can maximize the legalization of crypto in Indonesia, but this requires several special considerations related to the impact and influence that will be faced if the legality of crypto is implemented. Therefore, based on the comparison of the law, it will be seen whether Indonesia.

Abstract

Pengangkutan barang tidak terlepas dari adanya peran ekspeditur sebagai penyedia jasa angkutan. Pihak ekspeditur nyatanya selalu mengemban tanggung jawab yang diberikan oleh pengguna jasa atas barang yang akan dikirimkan melalui jasa ekspeditur tersebut. Transaksi penyedia jasa dan pengguna jasa menjadi suatu tanda perjanjian antar para pihak tersebut. Penelitian ini menggunakan metode normatif-empiris karena akan melihat sisi hukum dan kenyataannya dilapangan dengan mewawancarai para pihak. Hasil penelitian ini ditemukan bahwa pengangkutan oleh ekspeditur yang menyebabkan kecelakaaan selayaknya harus benar-benar ditetapkan terlebih dahulu apakah benar-benar keadaan memaksa atau sebuah kelalaian. Pertanggungjawaban harus dapat dilakukan ekspeditur, meskipun tidak dalam bentuk ganti rugi, namun dapat berbentuk informasi atau kejelasan ekspeditur kepada pihak pengguna jasa. Hal ini nyatanya harus tetap ada sebagai bentuk pertanggungjawaban dan perlindungan terhadap konsumen.
