Abstract

ABSTRAKTesis ini membahas tentang Tinjauan Yuridis Terhadap Putusan Komisi Informasi Dalam Penyelesaian Sengketa Informasi (Studi Kasus Putusan Nomor : 021/XI/KI-PS-A/2016 Komisi Informasi Provinsi Kalimantan Barat). Tujuan dalam penelitian ini adalah untuk mengetahui dan mengkaji kekuatan hukum putusan Komisi Informasi dalam menangani sengketa informasi dan untuk mengetahui dan mengkaji faktor-faktor penyebab badan publik tidak tunduk pada putusan informasi yang telah mempunyai hukum yang mengikat (Inkracht). Pendekatan dalam penelitian ini menggunakan metode normatif empiris dengan spesifikasi penelitian deskriptif analitis. Jenis data yang digunakan dalam penelitian ini adalah data sekunder. Hasil Penelitian menunjukkan bahwa prosedur penyelesaian sengketa informasi publik oleh Komisi Informasi telah sesuai dengan peraturan perundang-undangan. Hal ini dapat dilihat dalam pertimbangan hukum dari putusan ajudikasi Komisi Informasi yaitu kewenangan Komisi Informasi, kedudukan hukum (legal standing) pemohon, kedudukan hukum (legal standing) termohon dan batas waktu pengajuan permohonan penyelesaian sengketa informasi. Dan apabila para pihak menerima putusan atau jangka waktu 14 (empat belas) hari sejak putusan diterima, para pihak yang berkeberatan tidak menempuh upaya hukum, hal tersebut sebagaimana yang diatur pada Pasal 48 ayat (1) UU No. 14 tahun 2008 (UU KIP) juncto Pasal 60 Perki No. 1 Tahun 2013 (Perki PPSIP) juncto Pasal 3 Perma No. 2 Tahun 2011. Dengan demikian, para pihak wajib mentaati putusan ajudikasi. Badan Publik selaku Termohon tidak melakukan upaya hukum yaitu mengajukan Gugatan dan Kasasi. Dengan demikian putusan Komisi Informasi telah berkekuatan hukum tetap (Inkracht). Putusan Komisi Informasi yang telah berkekuatan hukum tetap ini tidak dilaksanakan oleh Badan Publik. Adapun alasan dari Badan Publik tidak melaksanakan putusan Komisi Informasi yang telah mempunyai kekuatan hukum yang tetap adalah belum menerima putusan Komisi Informasi Provinsi Kalimantan Barat.Kata kunci : Komisi Informasi, sengketa informasi publik, putusan komisi informasiABSTRAC2This thesis discusses Juridical Review of Information Commission Decisions in Information Dispute Resolution (Case Study of Decision Number: 021 / XI / KI-PS-A / 2016 West Kalimantan Provincial Information Commission). The purpose of this study is to determine and examine the legal strength of the Information Commission's decision in handling information disputes and to find out and examine the factors that cause public agencies not to submit to information decisions that already have binding laws (Inkracht). The approach in this study uses empirical normative methods with descriptive analytical research specifications. The type of data used in this study is secondary data. The results showed that the procedure for resolving public information disputes by the Information Commission was in accordance with statutory regulations. This can be seen in the legal considerations of the decision of the Information Commission adjudication namely the authority of the Information Commission, the applicant's legal standing, legal standing of the respondent and the deadline for filing a dispute resolution request. And if the parties accept the decision or a period of 14 (fourteen) days after the decision is received, the parties who object do not take legal action, that is as regulated in Article 48 paragraph (1) of Law no. 14 of 2008 (UU KIP) juncto Article 60 Perki No. 1 of 2013 (Perki PPSIP) juncto Article 3 Perma No. 2 of 2011. Therefore, the parties must obey the adjudication decision. The Public Agency as the Respondent did not make legal remedies, namely filing a Lawsuit and Cassation. Thus the decision of the Information Commission has permanent legal force (Inkracht). The decision of the Information Commission which has permanent legal force is not implemented by the Public Agency. The reason for the Public Agency not implementing the decision of the Information Commission which has permanent legal force is that it has not yet received the decision of the West Kalimantan Province Information Commission.Keywords: Information Commission, public information dispute, information commission decision

Abstract

Franchise agreements have become one of the fastest-growing business models in Indonesia. However, in its implementation, legal problems often arise faced by the parties involved in the franchise agreement. This journal aims to review the implementation of franchise agreements in Indonesia from the perspective of civil law. This review was carried out by analyzing laws and regulations related to franchising, principles of civil law, and the practice of implementing franchise agreements in the field. The study results show that implementing franchise agreements in Indonesia still faces several obstacles, such as: 1) Lack of understanding of the parties to their rights and obligations in the franchise agreement. 2) Weak law enforcement against violations of franchise agreements. 3) The government's role in protecting the parties' rights in the franchise agreement has not been optimal. Based on the study's results, this journal recommends several steps to improve the implementation of franchise agreements in Indonesia: Increasing education and socialization of the parties about their rights and obligations in franchise agreements; Strengthening law enforcement against violations of franchise agreements; and Enhancing the role of the government in protecting the rights of the parties to the franchise agreement.

Abstract

AbstractThe presence of the Kijing International Port in Mempawah Regency is a maritime transportation infrastructure that has an important and strategic role for the growth of industry and trade. In fact, the construction of this international port not only has an impact on investors and activities at the port, but also on the local community who live around the port. The community is always the one affected by any development, so there is a need for protection and preventive efforts to protect their rights as well as other things such as the potential for crime to occur in the Kijing international port area. This research was studied using socio-legal research methods which analyze legal studies normatively and the implications of impacts on society empirically, so that the approach taken is based on a statutory approach, a case approach and a social approach. The results of this research analyze studies of cases that often occur in international port areas in Indonesia, such as violent crimes resulting from social conflict, criminal acts of narcotics abuse, and criminal acts of prostitution. Of the several forms of crime, not all crimes have occurred in the Kijing international port area, so it is important to prepare preventive measures for these crimes to occur. So that the construction of this port can have a positive impact on the surrounding community socially, economically and legally. AbstrakHadirnya Pelabuhan Internasional Kijing di Kabupaten Mempawah menjadi suatu infrastruktur transportasi laut yang mempunyai peran penting dan  strategis untuk pertumbuhan industri dan perdagangan. Pembangunan pelabuhan internasional ini nyatanya tidak hanya berdampak pada investor maupun kegiatan aktivitas di pelabuhan tersebut, melainkan masyarakat setempat yang  tinggal di sekitar pelabuhan. Masyarakat selalu menjadi yang terdampak pada setiap pembangunan, sehingga perlu adanya perlindungan dan upaya preventif melindungi hak-hak mereka serta hal-hal lain seperti potensi terjadinya kejahatan yang terdapat di kawasan pelabuhan internasional kijing. Penelitian ini dikaji menggunakan metode penelitian sosio-legal yang menganalisis kajian hukum secara normatif dan implikasi dampak yang terjadi pada masyarakat secara empiris, sehingga pendekatan yang dilakukan berdasarkan pendekatan undang-undang, pendekatan kasus, serta pendekatan sosial. Hasil penelitian ini menganalisis kajian kasus-kasus yang sering terjadi di kawasan pelabuhan internasional di Indonesia, seperti tindak pidana kekerasan akibat konflik sosial, tindak pidana penyalahgunaan narkotika, serta tindak pidana kasus prostitusi. Dari beberapa bentuk kejahatan tersebut, tidak semua kejahatan pernah terjadi di kawasan pelabuhan internasional kijing, sehingga penting untuk mempersiapkan upaya preventif terjadinya kejahatan tersebut. Sehingga pembangunan pelabuhan ini dapat berdampak baik kepada masyarakat sekitar secara sosial, ekonomi, maupun hukum.

Abstract

Sustainable Development Goals are an agenda to increase inclusive economic growth in a region. Pontianak City as the capital of West Kalimantan Province has an important role in increasing the realization of this development by implementing policies oriented towards sustainable development, specifically in fulfilling access to decent work in Pontianak City. One of the employment sectors that is of concern is providing access to decent work for parking attendants. The aim of this research is to examine whether the fulfillment of access to decent work for parking attendants has been fully fulfilled by looking at access to the fulfillment of human rights and compliance with the laws regulated in existing regulatory policies in the City of Pontianak. This research was carried out using socio-legal research methods as it will examine social rules which are confirmed based on existing laws in legislation. The results of this research show that in fulfilling access to decent work within the standards set in the sustainable development goals, there are still several indicators that have not been met. One aspect of access to decent work for parking attendants that has not been met is that social security is still not a priority, as well as the lack of availability of laws governing parking management in Pontianak City. So there needs to be consideration and strengthening in fulfilling the law so that parking attendants get clear legal status with legal availability to realize decent work and economic growth in accordance with the 8 Sustainable Development Goals

Abstract

Pemilihan kepala daerah merupakan kontestasi demokrasi yang dilaksanakan untuk memilih pemimpin daerah. Seringkali proses demokrasi ini menimbulkan perselisihan, sehingga memerlukan penyelesaian secara hukum. Mahkamah Konstitusi sebagai lembaga peradilan yang menangani sengketa hasil pemilu dan pilkada, salah satunya perselisihan hasil pemilihan kepala daerah yang terjadi di Sekadau. Penelitian ini merupakan menggunakan metode penelitian normatif, dimana pengkajian didasarkan pada pendekatan perundang-undangan yang terfokus pada peraturan perundang-undangan dan keputusan Mahkamah Konstitusi.  Hasil peneltitian ini menunjukan bahwa Hakim Konstitusi dalam putusan yang memerintahkan untuk dilakukannya penghitungan suara ulang pada proses pemilihan tersebut mengedepankan prinsip keadilan, transparansi, dan keberlanjutan demokrasi. Putusan tersebut memiliki dampak signifikan terhadap dinamika politik lokal di Kabupaten Sekadau. Pemberian kesempatan untuk penghitungan suara ulang memberikan harapan baru bagi pihak yang merasa dirugikan sekaligus menegaskan komitmen terhadap integritas pemilihan.

Abstract

This study aims to see how effective the implementation of the Republic of Indonesia National Police Regulation Number 1 of 2021 concerning Community Policing by the Community Police Partnership Forum in Tekarang District is?, and what are the supporting and inhibiting elements in the implementation of the Regulation?. This study uses empirical law, which is a legal research method with a field research approach or factual conditions that occur in the social environment. To obtain data, researchers use observation and interview guidelines. Based on the results of the study, it was found that the application of the law to the Republic of Indonesia National Police Regulation Number 1 of 2021 concerning Community Policing by the Community Police Partnership Forum in Tekarang District has not been implemented effectively, and that the supporting factors include: the legal factor itself, law enforcement factors and community factors, while the inhibiting factor is the law enforcement factor which is only limited to the formation of the Community Police Partnership Forum (FKPM), but there is no work program. In addition, the facility factor is the absence of the Community Police Partnership Center (BKPM) and the factor of minimal public awareness and understanding of FKPM and community policing.
