Abstract

Tujuan penelitian menganalisis kekuatan hukum dan proses penyelesaian perkara perdata melalui mediasi dan Faktor-faktor apakah yang menghambat pelaksanaan mediasi penyelesaian perkara perdata. Penelitian ini menggunakan metode penelitian hukum yuridis normatif. Hasil penelitian ini menunjukkan bahwa Pelaksanaan mediasi di Pengadilan Negeri Makassar secara umum telah berjalan sesuai dengan prosedur yang berlaku yaitu Peraturan Mahkamah Agung Nomor 01 Tahun 2008 tentang Prosedur Mediasi di Pengadilan. Tahapan proses mediasi telah dilaksanakan oleh Hakim maupun Mediator di Pengadilan Negeri sesuai dengan ketentuan mulai dari tahap pra mediasi, tahap pelaksanaan mediasi yang mana dalam tahap tersebut terdapat hakim tunggal dan dimana tahap mediasi dilakukan secara musyawarah sampai dengan tahap akhir/pelaporan yang dilakukan oleh Mediator kepada Majelis Hakim. Faktor-faktor penghambat pelaksanaan mediasi dalam penyelesaian perkara perdata di Pengadilan Negeri adalah para pihak yang bersengketa yang tidak hadir serta kurang antusiasnya dalam melalui tahapan mediasi, kurang aktifnya mediator serta keterlibatan advokat yang cenderung tidak bersungguh-sungguh dalam membantu mengupayakan perdamaian. The research objective is to analyze the strength of the law and the process of resolving civil cases through mediation and what factors hinder the implementation of mediation in resolving civil cases. This research uses normative juridical legal research methods. The results of this research indicate that the implementation of mediation at the Makassar District Court has generally been carried out by applicable procedures, namely Supreme Court Regulation Number 01 of 2008 concerning Mediation Procedures in Court. The stages of the mediation process have been carried out by the Judge and Mediator at the District Court by the provisions starting from the pre-mediation stage, the mediation implementation stage in which there is a single judge and where the mediation stage is carried out by deliberation up to the final stage/reporting carried out by the Mediator to the panel of judges. Factors inhibiting the implementation of mediation in resolving civil cases at the District Court are the parties to the dispute not being present and their lack of enthusiasm in going through the mediation stages, the mediator being less active and the involvement of advocates who tend not to be serious in helping to achieve peace..
