Abstract

The study seeks to investigate the challenges in the enforcement of laws pertaining to human trafficking offenses involving Indonesian migrants. This research addresses legal challenges from a normative perspective grounded in the rule of law inside statutes and regulations. The material utilized in this study is empirical judicial. Field research is undertaken to examine the many legal requirements that are applicable in society. This research indicates a limited number of stakeholders involved, including Indonesian migrant workers, civil registry officials, airport staff, airport officers, and immigration personnel, who can facilitate the passage of Indonesian migrant candidates in terms of rewards. Legal action by the Indonesian migrant protection agency for the postponement of services, revocation of business licenses, recall of written agreements, business operations, and annulment of prospective commercial activities. Migrant workers and foreign laborers are responsible for their expenses. Prolonged initiatives are encouraged under the stringent oversight of Indonesia's labor service provider firms. Human trafficking is governed by Law No. 21 of 2007, which addresses eradicating this crime. The law serves two essential functions in social change: as an instrument of social control and as a method of social engineering. RT, RW, and village institutions contribute to community empowerment in effectively implementing preventative measures. Legal understanding pertains to the comprehension of the regulations established by written law about permissible and impermissible societal conduct.

Abstract

Background. The rise of the use of electric bicycles on the highways of Cirebon Regency has caused unrest among other road users, mainly due to the difference in speed, the use of inappropriate lanes, and the absence of engine noise that often surprises other motorists. To regulate this, the Minister of Transportation issued Regulation of the Minister of Transportation (Permenhub) No. 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives, which regulates technical requirements, lanes, and the minimum age of electric bicycle users, as well as requiring the use of helmets and other safety equipment. However, the Regulation has not been able to solve the above problems due to the lack of thorough socialization, which leads to a lack of public understanding of the applicable regulations and the lack of supporting infrastructure. The purpose of the research is to provide the public with an understanding of the regulations and technical rules for using electric bicycles. Aims. This study formulates a problem regarding how to implement Permenhub No. 45 of 2020 on the use of electric bicycles on the highways of Cirebon Regency. Methods. Using an empirical juridical research method, this study shows that regulation implementation is still not optimal. It is characterized by low public awareness of the rules, limited infrastructure, and the absence of derivative regulations at the regional level. Conclusion. In conclusion, the effectiveness of Permenhub No. 45 of 2020 in Cirebon Regency is influenced by factors such as a lack of socialization, a lack of supporting facilities, and weak law enforcement, so collaborative efforts are needed between the local government and the community to create safer and more orderly traffic

Abstract

Background. Aim. This study aims to analyze the application of the concept of Green Legislation to the Draft Regional Regulation (Raperda) on Groundwater Conservation and Biopore Infiltration Holes in Cirebon City in 2024 Methods. This research uses a normative juridical method, which focuses on studying legal doctrines, legal principles, and regulations relevant to the research topic. Result. Based on an analysis of the 2024 Cirebon City Groundwater Conservation and Biopore Infiltration Hole Draft Regulation, it was found that a number of Green Legislation principles have been implemented, reflecting sustainability, wise management of natural resources, and environmental protection. The analysis results show that this draft regulation has included several principles of Green Legislation, such as regulations regarding water conservation and bio-pore management. However, there are gaps in implementation that need to be corrected. Conclusion. Therefore, the Cirebon City Government needs to improve the quality of the preparation of the Regional Regulation on Groundwater Conservation and Biopore Infiltration Holes by strengthening the integration of Green Legislation principles, especially aspects of sustainability, community participation, and wise management of natural resources. This effort can start by clarifying technical standards for constructing infiltration pits, improving the supervision and law enforcement system, and involving the community in socialization and policy implementation. Implication. Harmonization is needed between this Raperda and national policies such as the Job Creation Law to minimize the potential for regulatory conflicts and achieve the goal of preserving groundwater resources effectively and consistent with the principles of sustainable development.
