Abstract

Abstract: The phenomenon of "empty box" ballots in Indonesia's regional head elections (Pilkada) reflects public dissatisfaction with single candidates endorsed by political party coalitions. This highlights challenges within the local democratic system, which may hinder political participation and contribute to social instability. Purpose: This research aims to understand how the phenomenon of "empty box" ballots reflects the practice of political cartelization in Indonesia, as well as to explore the factors contributing to the emergence of single candidates and large coalitions in elections. Design/Methodology/Approach: The methodology employed in this research includes a qualitative analysis of national and local political dynamics, as well as an observation of voter behavior in the context of regional elections (Pilkada). The study also examines the implications of the "empty box" phenomenon for democratization and political representation at the regional level. Findings: The research findings indicate that the "empty box" phenomenon is not merely a matter of failed elections but also reflects a crisis of public trust in political institutions. Deep dissatisfaction with the available candidates has the potential to trigger radicalization and protest movements. Furthermore, the dominance of major political parties in candidate nomination disregards local aspirations, creating conditions where the nominated candidates fail to reflect the diversity of the community. Originality/value: This research offers new insights into the relationship between the "empty box" phenomenon and political cartelization practices in Indonesia, emphasizing the need for electoral system reforms to create a more inclusive space for public participation. By enhancing political awareness and strengthening smaller political parties, it is hoped that public dissatisfaction can be reduced, and the legitimacy of the political system can be improved.

Abstract

Election is a democratic means to elect leaders and representatives of the people, where Bawaslu has a strategic role as an election supervisory institution. Bawaslu is tasked with ensuring that each stage of the election is in accordance with laws and regulations, with the legal basis listed in Law No. 7 of 2017. As a quasi-judicial institution, Bawaslu has the authority to issue decisions that are final and binding. However, in practice, the implementation of follow-up to Bawaslu decisions often faces challenges, such as disobedience or suboptimal implementation by the KPU and related parties. This study aims to examine the urgency of legal certainty in supervising the implementation of Bawaslu decisions and to determine the ideal model of supervision to fulfill the principle of legal certainty. The method used is normative juridical with a legislative approach, with primary and secondary data sources. The results of the study show that there is a legal vacuum that hinders the optimal implementation of the decision. Therefore, this study emphasizes the urgency of an integrated supervision model with strict evaluation and sanction mechanisms, which can increase compliance with Bawaslu decisions and ensure the implementation of elections in accordance with legal provisions.

Abstract

In a country like Afghanistan, whose economy is largely based on agriculture, food security and migration are deeply intertwined, especially in Nangarhar province. This study assesses the relationship between household food security, economic status, and migration and attempts to clarify the role of food insecurity in shaping migration decisions. The study was conducted based on a cross-sectional survey, in which data were collected from 520 farmers from 9 districts of Nangarhar province. A structured questionnaire was used to collect data, and purposive sampling was used. Household food consumption was assessed based on the previous seven days, as well as children’s school attendance and household economic status. Descriptive statistics and Pearson Correlation were used to analyse the data to obtain accurate and reliable results. The results of the study show that although most households have access to basic foods such as bread and rice every day, they consume very little of nutritious foods such as meat, dairy products, and vegetables. In addition, children’s school dropout is closely linked to the poor economic status of households. The findings indicate that malnutrition and economic problems are important drivers of migration. The study concludes that strengthening targeted programs for household economic empowerment, agricultural development, and food security can reduce malnutrition and mitigate the negative impacts of livelihood-based migration. This study provides important scientific and practical insights for development policy and migration management in Afghanistan. [Di negara seperti Afghanistan, yang ekonominya sebagian besar berbasis pada pertanian, ketahanan pangan dan migrasi saling terkait erat, khususnya di provinsi Nangarhar. Studi ini menilai hubungan antara ketahanan pangan rumah tangga, status ekonomi, dan migrasi, serta berupaya mengklarifikasi peran ketidaktahanan pangan dalam membentuk keputusan migrasi. Penelitian ini dilakukan berdasarkan survei potong-lintang (cross-sectional), di mana data dikumpulkan dari 520 petani dari 9 distrik di provinsi Nangarhar. Kuesioner terstruktur digunakan untuk mengumpulkan data, dan teknik pengambilan sampel bertujuan (purposive sampling) diterapkan. Konsumsi pangan rumah tangga dinilai berdasarkan tujuh hari sebelumnya, serta kehadiran anak-anak di sekolah dan status ekonomi rumah tangga. Statistik deskriptif dan Korelasi Pearson digunakan untuk menganalisis data guna mendapatkan hasil yang akurat dan andal. Hasil studi menunjukkan bahwa meskipun sebagian besar rumah tangga memiliki akses ke makanan pokok seperti roti dan nasi setiap hari, mereka mengonsumsi sangat sedikit makanan bergizi seperti daging, produk susu, dan sayuran. Selain itu, angka putus sekolah anak-anak berkaitan erat dengan status ekonomi rumah tangga yang buruk. Temuan ini menunjukkan bahwa malnutrisi dan masalah ekonomi merupakan pendorong utama migrasi. Studi ini menyimpulkan bahwa penguatan program-program yang ditargetkan untuk pemberdayaan ekonomi rumah tangga, pengembangan pertanian, dan ketahanan pangan dapat mengurangi malnutrisi serta memitigasi dampak negatif dari migrasi berbasis penghidupan. Studi ini memberikan wawasan ilmiah dan praktis yang penting bagi kebijakan pembangunan dan pengelolaan migrasi di Afghanistan.]

Abstract

The mechanism of Pergantian Antar Waktu (PAW) for legislators in Indonesia reflects a structural tension between popular sovereignty and party sovereignty. Although constitutionally recognized, PAW in practice is predominantly initiated and controlled by political parties, often without the involvement or consent of voters. This raises a fundamental constitutional problem concerning the erosion of representative freedom and the subordination of voters’ political will to internal party interests. Within a democratic constitutional, such a configuration invites critical scrutiny, particularly when assessed through normative theories of justice and freedom. This study aims to critically examine the legal construction and implementation of party-initiated PAW and to assess its compatibility with the principles of republican justice. The research seeks to demonstrate how PAW operates as a mechanism of arbitrary power that undermines the representative mandate and weakens popular sovereignty. This research employs legal research with a statutory approach and a conceptual approach. The study finds that party-initiated PAW institutionalizes a form of structural domination, where legislators and voters are placed in a condition of dependency on party discretion. The absence of public participation and effective accountability mechanisms renders PAW an exercise of arbitrary power incompatible with republican freedom. The novelty of this research lies in its application of Philip Pettit’s republican justice theory to Indonesian constitutional law, offering a critique that reconceptualizes PAW not merely as a procedural issue, but as a constitutional injustice rooted in domination over popular political will.
