Abstract

Indonesia has a regulation of Halal Slaughter since 2014, the provisions applied must have standardization from various aspects, such as religious and modern aspects. Religion provides strict regulations regarding one slaughter incision, chanting the name of Allah and the animal is alive. Meanwhile, the slaughter industry has developed using the stunning process. Through a literature review by looking at the aspects that affect halal slaughter standards. Using descriptive analysis by looking at the provisions of existing regulations in Indonesia. The results of this study show that the historical regulation of slaughterhouses in Indonesia considers all aspects, namely religious and modern aspects. This regulation shows that regulations in Indonesia are more comprehensive in having halal slaughterhouses. This means that the development of slaughterhouse regulations since long ago reflects the government's commitment to religious rules.

Abstract

Kasus kejahatan begal di Indonesia telah menjadi isu serius yang meresahkan masyarakat. Namun, peristiwa di mana korban begal yang melakukan perlawanan justru dijatuhi hukuman pidana menimbulkan kontroversi dan ringannya sanksi yang dijatuhkan kepada pelaku begal menjadi pertanyaan dimana keadilan dalam sistem hukum nasional. Dalam hukum Islam atau jinayah, keadilan adalah prinsip utama yang menekankan perlindungan terhadap korban dan pencegahan pengulangan kejahatan serupa. Artikel ini bertujuan untuk menganalisis keadilan dalam penjatuhan sanksi terhadap korban begal yang melawan dan para pelaku pembegalan yang dapat mengakibatkan kehilangkan nyawa, dengan membandingkan pendekatan hukum positif Indonesia dan perspektif jinayah. Penelitian ini menemukan bahwa sanksi terhadap korban yang melawan sering kali bertentangan dengan prinsip keadilan restoratif dalam jinayah dan para pelaku tidak mendapatkan hukum setimpal yang sangat berbeda dengan jinayah, yang mengutamakan perlindungan hak korban serta efek pencegahan terhadap pelaku kejahatan. Dalam hal ini, perspektif jinayah menekankan keseimbangan antara keadilan bagi korban, efek jera bagi pelaku, dan keamanan masyarakat. Di Indonesia, penerapan perspektif ini masih bersifat normatif dan diselaraskan dengan hukum nasional.

Abstract

This study aims to analyze the impact of stigma on the use of cannabis in Acehnese cuisine and its implications for the sustainability of halal tourism. The method employed is qualitative with a literature review approach, analyzing secondary data from scientific journals, books, official documents, and media articles. The primary data sources include regulations on cannabis, its historical use in cuisine, and the negative and positive impacts of stigma. The findings reveal that social stigma toward cannabis, often associated with drug abuse, poses significant challenges for Acehnese cuisine. Although historically, cannabis was used as a cooking ingredient without psychoactive effects, shifts in public perception have affected the image of Aceh's halal tourism. As a result, this stigma has the potential to reduce Muslim tourists' interest in Acehnese cuisine and negatively impact the local economic sector.. This study provides a fresh perspective on the role of stigma in hindering the potential of Acehnese cuisine in the halal tourism industry. Its scholarly contribution enriches the literature on the relationship between social stigma, traditional culinary practices, and halal tourism, which has been rarely explored in depth. Methodologically, the literature-based approach focusing on regulatory, historical, and social perception analyses offers a model that can be applied to similar issues in other regions or cultural contexts.
