Abstract

Artikel ini membahas mengenai potensi ancaman stabilitas Negara yaitu salah satunya berkaitan dengan konflik antara identitas nasionalisme dan identitas agama, suku, budaya, gender, dan antar golongan. Dalam rangka pemenangan kontestasi pemilu, elite politik menghadirkan isu politik identitas melalui kampanye yang tak lain bertujuan untuk memobilisasi dukungan masa. Dengan demikian, dukungan masyarakat terhadap kandidat ditentukan oleh persepsi terhadap berbagai macam perbedaan penting, seperti identitas agama, suku, budaya, gender, dan antar golongan, bukan oleh visi para calon. Penghapusan tempat ibadah sebagai lokasi kampanye dapat menghapus politik identitas mengingat Tempat ibadah memiliki makna dan nilai spiritual yang tinggi bagi setiap umat beragama. Menggunakan tempat ibadah sebagai tempat kampanye berpotensi memicu emosi dan kontroversi serta merusak nilai-nilai agama. Jenis penelitian ini adalah penelitian hukum yuridis normatif. Sumber data hukum primer yang digunakan dalam penelitian ini adalah undang-undang Pemilu dan putusan MK Nomor 65/ PUU-XXI/2023, data sekunder penelitian ini menggunakan buku, jurnal dan artikel. Adapun fokus penelitian ini dilihat berdasarkan teori Demokrasi, Kepastian Hukum dan, Kemanfaatan. Kata Kunci: Tempat ibadah, Kampanye, Politik identitas This article discusses the potential threats to State stability, one of which is related to conflicts between nationalism and religious, ethnic, cultural, gender and intergroup identities. In order to win the election contestation, political elites present the issue of identity politics through campaigns that aim to mobilize mass support. Public support for candidates is determined by perceptions of various important differences, such as religious, ethnic, cultural, gender and intergroup identities, not by the vision of the candidates. The elimination of places of worship as campaign locations can eliminate identity politics considering that places of worship have high spiritual meaning and value for every religious believer. Using places of worship as campaign sites has the potential to trigger emotions and controversy and damage religious values. This type of research is normative juridical legal research. The primary legal data sources used in this research are the Election Law and Constitutional Court Decision Number 65/PUU-XXI/2023, secondary data using books, journals and articles. The focus of this research is seen based on the theory of Democracy, Legal Certainty and, Benefit. Keywords: Places of worship, Campaign, Identity politics

Abstract

Lately there have been many police cases, especially violations in the field of firearms abuse. This situation is very regrettable where the misuse of firearms is carried out by the police officers themselves who are supposed to protect the community. This proves the increasingly poor image of the Police in the midst of society. The purpose of this research is to find out the factors causing the misuse of firearms committed by law enforcement officials, especially police officers. The research method used in this research is the literature method, which is normative juridical, meaning that the approach taken by examining the approach of theories, concepts, examining the legislation concerned with the opinions of scholars. The results of this study are factors that cause firearm abuse, namely: Psychological Factors and Economic Factors. Unstable psychological (emotional) factors from police officers, stress due to family problems or other personal problems so that abuse is very easy to occur. While the economic factor is the lack of welfare of the members themselves which then makes a police officer with short thinking do things that are actually very prohibited and have been listed in the law as dangerous criminal acts. Repressively, namely by examining the psychological aspects of the applicant (member), periodically and conducting coaching and training for members who have permission to hold firearms. Repressively is by providing action or punishment in accordance with what is done in accordance with applicable legislation.
