Abstract

AbstractThe rapid development of social media has led to the widespread dissemination of digital fatwas, which do not always come from credible sources, making it essential to filter these fatwas using the principles of Al-Jarh wa Al-Ta’dil. This study aims to examine the application of these principles in filtering digital fatwas circulating on social media platforms. The research method employed is a literature review and qualitative analysis of fatwas circulating on social media, focusing on the credibility of the fatwa issuers and the application of the Al-Jarh wa Al-Ta’dil principles. The findings indicate that these principles are highly relevant for ensuring the quality of fatwas accepted by the public, although challenges such as information limitations and the influence of social media algorithms remain obstacles. Digital literacy and collaboration with religious institutions are needed to optimize the filtering of authentic digital fatwas.Keyword: Al-Jarh wa at-Ta’dil; Hadits; Digital Fatwas; Social Media. AbstrakPerkembangan pesat media sosial telah menyebabkan penyebaran fatwa-fatwa digital yang tidak selalu berasal dari sumber yang kredibel, sehingga penting untuk menyaring fatwa-fatwa tersebut menggunakan prinsip Al-Jarh wa Al-Ta’dil. Penelitian ini bertujuan untuk mengkaji penerapan prinsip tersebut dalam menyaring fatwa-fatwa digital yang beredar di platform media sosial. Metode yang digunakan dalam penelitian ini adalah studi literatur dan analisis kualitatif terhadap fatwa-fatwa yang tersebar di media sosial, dengan fokus pada kredibilitas pemberi fatwa dan penerapan prinsip Al-Jarh wa Al-Ta’dil. Hasil penelitian menunjukkan bahwa prinsip ini sangat relevan untuk memastikan kualitas fatwa yang diterima masyarakat, meskipun tantangan seperti keterbatasan informasi dan pengaruh algoritma media sosial masih menjadi hambatan. Diperlukan edukasi digital dan kolaborasi dengan lembaga keagamaan untuk mengoptimalkan penyaringan fatwa-fatwa digital yang sahih.

Abstract

This study examines the relevance of the following legislation: No. 8 of 1999 on Consumer Protection (UUPK) with the principle of hifz.al-mal in maqashid syariah, as a means of achieving holistic consumer protection, especially in the era of e-commerce. The research focuses on the challenges of consumer protection in the digital digital and the potential for synergy between positive law and Islamic values. The objective of the study is to analyse the substance of the rights and obligations of consumers in the UUPK. The research aims to analyse the substance of the rights and obligations of consumers in the UUPK. explaining the principle of hifz al-mal as a moral and legal foundation Islam, and identifying the intersection of the two. The research uses a juridical method normatif dan menganalisis secara kualitatif dan komparatif sumber primer dan secondary sources, this study found a significant correlation between the rights and obligations consumers in UUPK (Articles 4 and 5) with the principle of hifz al-mal.Imam Asy-Syathibi's view of hifz al-mal as a fundamental (dharuriyat) provides a strong ethical foundation. Results: penelitian ini menunjukkan bahwa prinsip hifz al-mal sejalan dengan UUPK Pasal 4 dan 5, yang menekankan kehalalan harta (melarang riba, gharar, , and ikhtikar), distributive justice, and environmental protection. as collective property. It was concluded that the integration of hifz al-mal could strengthen the UUPK and create a more comprehensive, ethical and sustainable system for protecting consumers. comprehensive, ethical, and sustainable system, while also harmonising positive law with syariah Islam for the greater good.
