Abstract

Penelitian ini mengkaji permasalahan kekosongan hukum terkait fintech lending ilegal di Indonesia, serta urgensi pembentukan regulasi yang lebih komprehensif untuk melindungi konsumen. Fintech lending yang sah telah diatur dalam berbagai peraturan perundang-undangan, seperti POJK No. 10/POJK.05/2022 dan peraturan Bank Indonesia No. 19/12/PBI/2017, namun tidak ada ketentuan yang secara jelas mengatur dan menindak praktik fintech lending ilegal. Hal ini menyebabkan banyak konsumen yang dirugikan, baik dalam bentuk bunga yang sangat tinggi, penagihan yang tidak etis, maupun pelanggaran data pribadi. Penelitian ini menyarankan pembentukan Undang-Undang Fintech yang mencakup pengaturan mengenai klasifikasi fintech lending ilegal, sanksi pidana, dan tambahan pidana berupa restitusi untuk memulihkan hak konsumen. Selain itu, penelitian ini mengusulkan penerapan ajaran gabungan dalam pertanggungjawaban pidana terhadap korporasi yang terlibat dalam fintech lending ilegal, yang memungkinkan pertanggungjawaban yang lebih efektif dan adil terhadap korporasi. Dalam rangka melindungi konsumen, penelitian ini juga menekankan pentingnya pengawasan yang lebih ketat oleh Otoritas Jasa Keuangan (OJK) terhadap platform fintech lending, guna memastikan praktik yang adil dan transparan serta memperkuat perlindungan konsumen. Melalui rekomendasi-rekomendasi ini, diharapkan tercipta regulasi yang dapat mengatasi permasalahan fintech lending ilegal, sehingga dapat memberikan perlindungan maksimal bagi konsumen dan menciptakan ekosistem fintech yang lebih aman dan berkelanjutan di Indonesia.

Abstract

The development of financial technology (fintech) in the digital era has brought significant changes in financial services, providing easy access and efficiency for consumers. However, behind the benefits offered, there are various legal challenges related to consumer protection, including the risk of misuse of personal data, online fraud, and unclear dispute resolution mechanisms. Regulations governing the fintech sector are still evolving to adapt to the dynamics of rapidly changing technology. Therefore, it is vital to analyze how legal protection for consumers in the fintech sector in Indonesia is implemented and how existing regulations can provide legal certainty for the community. This research employs a normative juridical methodology that combines a conceptual and statutory approach. The Electronic Information and Transactions Law (ITE), Law Number 8 of 1999 concerning Consumer Protection, and other regulations of the Financial Services Authority (OJK) and Bank Indonesia pertaining to the fintech ecosystem in Indonesia were among the pertinent regulations that were analyzed. This study also looks at regulatory developments in the digital age and legal theories pertaining to consumer protection in electronic transactions. This study uses a normative legal approach to better understand the legal protections for consumers in fintech transactions and to pinpoint implementation issues. It is anticipated that the study would help create policies that are more adaptive to technological developments and provide recommendations for more effective legal policies in protecting consumers in the fintech era.

Abstract

Consumer disputes are issues that frequently arise in the relationship between consumers and businesses. In Indonesia, the Consumer Dispute Settlement Body (BPSK) plays a vital role in addressing these disputes. The legal efforts available through BPSK are regulated under Law of the Republic of Indonesia No. 8 of 1999 on Consumer Protection, which provides a legal framework for dispute resolution that is simple, fast, and low-cost. The dispute resolution process at BPSK includes mediation, binding decisions, and procedures regulated by the Ministry of Trade Regulation No. 11 of 2016. This research uses a qualitative approach with data collection techniques through in-depth interviews, observations, and document analysis. This study aims to analyze the effectiveness of the legal efforts undertaken by BPSK in handling consumer disputes, as well as the challenges faced in its implementation. The findings indicate that although BPSK offers better access for consumers, there are still barriers regarding socialization, resource capacity, and community legal awareness. This research is expected to provide recommendations for improving the consumer dispute resolution system in Indonesia.

Abstract

Background. Consumer protection is an essential aspect of fair business practices. In Indonesia, the Consumer Dispute Resolution Agency (BPSK) was established to provide an alternative to formal courts for resolving consumer disputes. However, issues such as legal loopholes, limited resources, and low public awareness challenge its effectiveness. Purpose. This study evaluates the effectiveness of BPSK in resolving consumer disputes and protecting consumers from harmful business practices. Method. A normative legal method was applied, focusing on the legal norms in Law Number 8 of 1999 concerning Consumer Protection (UUPK). Data were collected through document studies, including legal literature, academic journals, official reports, and regulatory frameworks. Findings. The study reveals that BPSK offers faster and more efficient dispute resolution compared to formal courts. However, challenges such as objection procedures against decisions, limited human resources and budget, and inadequate public knowledge of consumer rights hinder its optimal functioning. Conclusion. To improve BPSK’s effectiveness, its legal position must be strengthened, resources enhanced, and regulations refined. Additionally, public awareness campaigns are essential to ensure wider utilization of BPSK services. These measures aim to achieve legal certainty and justice for consumers in Indonesia.
