Abstract

This paper is the result of an analysis of the marriage event of two people that have different ethnicities, Javanese and Batak, and the kinship system, Parental and Patrilinieal. In the marriage process which was carried out according to the patrilineal kinship sistem followed by giving the clan title from Batak. The question, is such marriage an interadat, or patrilinealisation, dalihan na tolu? To answer it, socio-antro legal research was done by implementating the complementary approaches, adat law science and legal anthropology. The result, the marriage isn’t named antaradat, the mentioned marriage has been legal according to the adat Batak in which the one party received one of the clans in the Batak ethnic so that the marriage is the endogamy marriage of the ethnic and the exogamy of the clan and keep on dalihan na tolu.

Abstract

Before reformation, there are as many as 38 articles of Code Penal of Indonesia repealed by acts. After reformation movement 1998, Indonesian statelegal policy has been changed by many approaches, for instance, from centralization to decentralization, top down to bottom up approach, etic to emic perspective. The main legal research question: why did the legal policy change? What's the legal implication? Which articles of Code Penal have been repealed after changing such approach? To answer it, social legal research has been done. Theoretically, the good law is not separated from its social norms and culture norms where it's existence. In the sense of public law, good public law must accommodate to the social norms and culture norms as recommended by Friedman's concept that law (judicial decision) as product of system (legal substance, legal structure, legal culture). Legal culture itself means Indonesian-social and cultural forces. The results of research is below: (1) not all legal transplantation can't be retained but must be repealed in accordance with Indonesian social-cultural character; (2) to make the good legal substance, judge made law should accommodate social and cultural forces; (3) after new approach, there are 2 (two) articles of Code Penal repealed by and 15articles of Code Penal appealed to Constitutional Court Decision. Its recommendation, in the decision making process, law should accommodate the Indonesian social and cultural forces.

Abstract

This research explores the status of customary criminal law in the context of positive law in Indonesia. Customary criminal law, as an integral part of the cultural heritage of Indonesian society, has values and norms that have developed from generation to generation. However, in an era of increasingly structured positive law, fundamental questions arise regarding the extent to which customary criminal law is accommodated and recognized by the formal legal system. This research uses a normative legal approach to analyze statutory regulations, court decisions, and related legal literature. Research findings identify that although customary criminal law is not explicitly regulated in the national positive law system, there are certain efforts to recognize and respect its existence. In this context, this research explores the concept of integrating customary criminal law into a positive legal system as a medium of preserving legal plurality and realizing local justice. Apart from that, this analysis also discusses the challenges and potential conflicts between customary criminal law and modern positive law principles, as well as efforts that can be made to achieve harmony between the two. In conclusion, this research contributes to a better understanding of the status of customary criminal law in the context of positive law in Indonesia, by highlighting important aspects to be considered in developing inclusive and just legal policies. This research is in the form of a research article.

Abstract

This research aims to analyze and document the application of customary criminal law in dealing with criminal acts in the Marind Tribe of Merauke. The Marind tribe of Merauke, as a community group that maintains traditional values and local wisdom, has a unique customary criminal law system that is deeply rooted in their traditions. The research results show that the customary criminal law system in this tribe plays an important role in maintaining social order and maintaining harmony among community members. The application of customary criminal law in the Marind Tribe of Merauke involves a process of deliberation, consensus, and the formation of collective decisions by traditional stakeholders. The decision includes traditional sanctions that reflect social norms and local wisdom values. Apart from that, this research also identifies the challenges and obstacles faced in implementing customary criminal law, especially in facing rapid changes in the social and economic environment. It is hoped that this research can contribute to understanding the dynamics of the application of customary criminal law in modern society. This research offers promise for criminal justice by providing findings that can help create a more effective and balanced approach to addressing criminal behavior. Combining traditional criminal law with a formal legal system can lead to a better and more efficient system for handling criminal activity.

Abstract

Tulisan ini mendiskusikan aspek norma Hak Asasi Manusia dalam peraturan perundang-undangan. Dalam konsep Hukum Progresif, dimana Hukum Untuk Manusia, maka setiap bentuk hukum seperti undang-undang seharusnya mengandung norma Hak Asasi manusia. Dalam pengertian demikian, pertanyaannya, apakah setiap undang-undang memuat norma Hak Asasi manusia ? Untuk menganalisanya, data yang dijadikan bahan hukum adalah Undang-Undang Tentang Organisasi Masa yang 2011 telah direview di Mahkamah Konstitusi. Dengan pendekatan budaya dan filsafat hukum, hasilnya adalah norma Hak Asasi manusia terlah terakomodasi dalam Undanh­Undang tentang Ormas dan sebagaimana norma yang sama dalam Konstitusi. Untuk itu rekomendasinya, setiap upaya pembaugan peraturan hendaknya mengakomodasi Norma Hak Asasi Manusia mengingat Hukum itu untuk manusia

Abstract

This research discusses the application of Kerinci customary criminal law to criminal acts of abuse and its comparison with national criminal law in Indonesia. There is a conflict between Article 351 paragraph (3) of the Criminal Code and the practice of resolving customary abuse in Kerinci Regency. The research method used is normative legal research with a conceptual and analytical approach. The research results show differences in the application of customary and national crimes, with an emphasis on the principle of deliberation in Kerinci customary law. The application of Kerinci's customary crime involves three levels of sanctions, adjusted to the level of the violation, with a Restorative Justice approach. Differences arise in the resolution of minor criminal cases, where customary law involves traditional judges, ninik mamak, and traditional leaders. Harmonization between customary law and national law is crucial to achieving holistic justice.

Abstract

The research explores the resolution of customary criminal disputes in the context of the Baduy tribe, an ethnic group in Banten Province, Indonesia, with a focus on harmonization between local customary law and national criminal law. Through normative juridical methodology and analytical descriptive analysis, this study explores the mechanisms for resolving customary criminal disputes and their relationship with national criminal law. The results reveal the challenges in achieving harmony between traditional values and modern criminal law principles, as well as the implications for legal justice and human rights. The statutory approach and case approach help to comprehensively describe these dynamics, provide in-depth insight into the interaction between Baduy tribal customary law and Indonesian national criminal law and highlight the need for improved policies that are more inclusive and just.

Abstract

Background: The complexity of agrarian law regulation in Indonesia has led to significant legal uncertainty and social conflicts, particularly regarding unauthorized land use. Land, as a vital resource in agrarian societies, often becomes the center of disputes due to ineffective land administration, the misuse of land certificates, and corrupt practices. Objective: This study aims to analyze the challenges in agrarian law regulation and propose measures to address disputes over unauthorized land possession. Methodology: Using a normative legal research method, this study examines relevant regulations, including Law No. 5 of 1960 on the Basic Agrarian Law, through legislative and conceptual approaches. Findings: The research identifies key challenges, such as inefficiencies in land administration, abuse of legal documentation, and systemic corruption. To resolve these issues, improvements in the land administration system, stricter enforcement of laws, and increased legal awareness among the public are necessary. Conclusion: The study concludes that more effective agrarian policies are essential to address disputes over unauthorized land use, ensuring legal certainty and minimizing conflicts.

Abstract

This study discusses the legal vacuum that occurs in the pre-prosecution process, especially related to the absence of time limits and frequency of return of examination report files (BAP) between investigators and public prosecutors. This vacuum has the potential to hinder the principle of fast, simple, and low-cost justice that should be applied in the Indonesian criminal justice system. This study proposes solutions in the form of setting clear time limits, improving coordination between investigators and public prosecutors, and providing training to improve human resource capacity. In addition, the application of sanctions for parties who violate the provisions of pre-prosecution is an important step to ensure the smooth running of the judicial process. This study is expected to contribute to increasing the efficiency of the criminal justice system in Indonesia.

Abstract

This study aims to examine the urgency of regulating underground space rights in the Indonesian agrarian legal system, with a focus on the need to provide legal certainty regarding its potential use for various purposes, such as housing, business, and public infrastructure. Using a normative legal method, this study adopts a statute approach to analyze existing legal provisions, such as Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA) and other related regulations, as well as a conceptual approach to understand the urgency of regulating underground space in the development of national agrarian law. The research data sources include primary data from relevant laws and regulations, as well as secondary data obtained from legal literature, scientific articles, and in-depth case studies. The results of this study are expected to provide recommendations to fill the legal gap regarding the use of underground space, as well as encourage the creation of legal certainty in the agrarian sector that supports sustainable development and urbanization that is increasingly growing in Indonesia.
