Abstract

Perlindungan data pribadi di Indonesia menghadapi berbagai tantangan di era digital yang berkembang pesat. Kebocoran data pribadi menjadi masalah serius yang memerlukan perhatian dari semua pihak, termasuk pemerintah, sektor swasta, dan masyarakat. Upaya perlindungan data pribadi harus dilakukan melalui kolaborasi yang erat antara berbagai sektor, dengan memperkuat kebijakan dan regulasi yang ada, meningkatkan kesadaran masyarakat, serta memperkuat infrastruktur dan teknologi keamanan siber. Pemerintah Indonesia telah mengeluarkan Undang-Undang Perlindungan Data Pribadi sebagai langkah awal, namun implementasi yang konsisten dan koordinasi yang lebih baik masih menjadi tantangan. Selain itu, perlu adanya edukasi kepada masyarakat untuk meningkatkan literasi digital agar mereka lebih sadar akan pentingnya menjaga data pribadi mereka. Dalam penelitian ini, dibahas tantangan yang dihadapi dalam upaya perlindungan data pribadi di Indonesia dan strategi yang perlu diterapkan untuk meningkatkan keamanan data pribadi serta kesadaran masyarakat akan ancaman siber yang semakin canggih.

Abstract

Based on Indonesian National Police Regulation Number 7 of 2022, this study attempts to examine police personnel' accountability in cases of transgressions of the Police Professional Code of Ethics. The study highlights the urgency of implementing the code of ethics as an instrument for supervising and controlling the behavior of police officers in order to maintain professionalism, integrity, and public trust in the police institution. This study employs a normative legal approach as its methodology, examining case studies and laws pertaining to ethical transgressions by police. The findings show that the application of the code of ethics, which incorporates elements of personal, social, institutional, and state ethics, has provided a clearer legal framework in enforcing moral and professional standards for police officers. However, challenges still exist in its implementation, including a lack of transparency in the enforcement process and ongoing cases of abuse of power that tarnish the police's image. Therefore, there is a need to strengthen the supervision mechanisms, increase accountability through the Police Code of Ethics Commission (KKEP), and optimize sanctions that are educational and have a deterrent effect on violators. The main conclusion of this study is that the success of enforcing the police professional code of ethics greatly depends on the effectiveness of regulations, consistency in the application of sanctions, and the involvement of the public in overseeing police performance to ensure that every police officer performs their duties with the highest regard for legal values, justice, and human rights.

Abstract

Addressing cybercrime in Indonesia faces various complex challenges, including legal vacuums in existing regulations, such as the Law on Information and Electronic Transactions (UU ITE) and personal data protection. This study examines the necessity of regulatory reform that is more adaptive to the development of new technologies such as artificial intelligence, blockchain, and cryptocurrency, as well as the importance of balancing individual privacy protection and the data access needs of law enforcement. Furthermore, this research highlights the role of international collaboration in tackling cross-border cybercrime, which necessitates regulatory harmonization and extradition agreements to enhance the effectiveness of law enforcement. Through a comprehensive approach that includes legal reform, the implementation of stringent personal data protection, and strengthened international cooperation, Indonesia can create a safe and protected digital environment from the threats of cybercrime.
