Abstract

Proses penyelesaian sengketa medis di Indonesia dapat dilakukan melalui dua jalur utama, yaitu litigasi dan non-litigasi, dengan mediasi sebagai alternatif yang semakin populer. Jalur litigasi, meskipun sering digunakan, menghadapi berbagai tantangan seperti kompleksitas hukum, waktu yang lama, dan biaya tinggi, yang dapat menimbulkan dampak emosional bagi pasien dan tenaga medis. Sebagai solusi, mediasi menawarkan proses yang lebih efisien dan terjangkau, memungkinkan komunikasi langsung antara pasien dan dokter untuk mencapai kesepakatan tanpa melalui prosedur pengadilan yang rumit. Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan menegaskan pentingnya mediasi sebagai langkah awal dalam penyelesaian sengketa medis, dengan Lembaga Mediasi-Arbitrase Medis dan Kesehatan Indonesia (LMA-MKI) berperan penting dalam memfasilitasi proses ini. Melalui langkah-langkah mediasi yang terstruktur, diharapkan dapat tercapai solusi yang saling menguntungkan bagi kedua belah pihak, memperbaiki hubungan antara dokter dan pasien, serta mengurangi beban pada sistem peradilan. Dengan demikian, mediasi diharapkan dapat meningkatkan kepercayaan masyarakat terhadap pelayanan kesehatan dan mendorong tenaga medis untuk mematuhi standar profesionalisme yang telah ditetapkan.

Abstract

Introduction: The ratification of the New Criminal Code actually has an orientation towards strengthening legal pluralism in the field of criminal law. This is evidenced by the adoption of customary criminal law as a recognized law in addition to national criminal law.Purposes of the Research:  This study aims to analyze the implications of the formulation of Article 2 of the New Criminal Code concerning the practice of Indonesian criminal law pluralism and the future orientation of the formulation of Article 2 of the New Criminal Code to strengthen the pluralism of Indonesian criminal law.Methods of the Research: This research is a normative legal research that uses a concept and statutory approach.Results of the Research: The study results show that the legal implications of formulating guarantees for the enforceability of laws that live in society affirm the existence of customary criminal law as a living law in society, thereby affirming the essence of legal pluralism. The future orientation of Indonesian criminal law pluralism after the enactment of the New Criminal Code is to maintain harmonious relations between the national legal system and the customary law system and to conduct an inventory of existing customary criminal laws. Customary criminal law that still exists is then regulated specifically in regional regulations in each region so that judges can then use it as a reference in deciding a criminal case that has a legal essence that lives in society.

Abstract

The problem of meeting the sexual needs or biological needs of prisoners is a problem that is often the cause of chaos in prisons. The non-channeling of these needs sometimes causes the inmate's emotions to become uncontrollable. In Indonesia, some provisions allow married prisoners to gather with their families through CMK (Family Visiting Leave) as stipulated in the Decree of the Minister of Justice of the Republic of Indonesia Number: M.01-PK.03.02 of 2001 concerning Family Visiting Leave for Prisoners. This regulation provides an opportunity for married inmates to go to their family's residence for 2 (two) days or 2 x 24 hours to allow the married prisoner to meet his sexual needs while taking time off. However, in practice, these regulations have yet to be maximized because this is often used by officers and has become a topic of discussion in the mass media. Various opinions and studies mention the need for prisoners to be given this right, one of which is the Conjugal Visit policy. Conjugal Visit is also often referred to as the "Romance Chamber". Based on this, researchers are interested in researching how the Indonesian Law Regulation system regulates conjugal visits. The method used is the Normative Juridical method. They are namely answering problems through literature both primary, secondary and tertiary. The assumption found is that Cobjugal Visit has yet to be regulated and has no legal umbrella. However, this is a basic right for every human being having his status, whether he is a Prisoner or a free man.

Abstract

This study aims to analyze the implementation of public order enforcement on specific business establishments operating in public spaces by the Municipal Police (Satpol PP) in Polugadung District, based on Regional Regulation of the Province of DKI Jakarta Number 8 of 2007 concerning Public Order. The research employs a normative-empirical legal method with a qualitative approach. Data were collected through document analysis, in-depth interviews with Satpol PP officers, local government officials, and business actors, as well as field observations. The findings indicate that although Regional Regulation Number 8 of 2007 provides a comprehensive legal framework, its implementation by Satpol PP remains suboptimal. Law enforcement tends to be limited to administrative measures such as warning letters and symbolic fines, without escalation to judicial proceedings. Key obstacles include regulatory overlap, limited personnel and operational resources, economic pressures on the community, and a communication approach that lacks participatory engagement. To improve legal compliance, a holistic strategy is required combining consistent repressive enforcement with preventive efforts such as participatory legal education, provision of affordable legal business locations, licensing reform, and institutional capacity strengthening within Satpol PP.

Abstract

Land disputes are legal issues that arise when there are overlapping or conflicting claims or demands regarding land rights among different parties. This study examines the role of Land Office mediators in resolving land disputes in Indonesia, focusing on challenges and strategies to enhance mediation effectiveness. The research identifies obstacles such as limited legal understanding among mediators, unclear procedures, pressure from third parties, and uncooperative attitudes from disputing parties. A normative legal research method, supported by legislative and conceptual approaches, is employed to analyze relevant laws and mediation practices. Findings indicate that effective mediation requires improving mediator capacity, standardizing procedures, fostering cooperation with stakeholders, and raising public awareness. Solutions proposed include targeted mediator training, developing clear protocols, and creating an enabling environment for constructive dialogue. These measures are expected to enhance the mediation process, ensuring fair and sustainable outcomes while promoting social harmony and economic stability in land management.
