Abstract

Abstract

Today's cash waqf has become one of the financing alternatives for fiscal instruments in the economy. The understanding of the benefits of waqf, which so far has only been used for direct worship facilities such as mosques and cemeteries, has shifted in a broader direction, especially to improve welfare and the economy. Cash waqf has two functions: as a means of worship and as a means of improving social welfare. Returns from the management of cash waqf can be used as instruments in poverty alleviation programs through the development of MSMEs and the establishment of tourist areas. The impact of developing tourist areas will be felt directly by the community if, in these tourist areas, MSMEs grow and develop. The utilization of productive waqf with the management of Hajj funds is in accordance with the intent of Law Number 34 of 2014 concerning Hajj Financial Management and Law Number 41 of 2004 concerning Waqf, both of which aim to provide benefit to Muslims. In its implementation, the utilization of waqf funds can be made into a hotel project or infrastructure supporting halal tourism, such as airports, MSME kiosks, and so on. Then the profits obtained will be channeled for the benefit of the people. On the other hand, the development of halal tourism facilities and infrastructure also creates jobs. In addition, Indonesia is already known as a Muslim-friendly tourist destination. This development of halal tourism can optimize Indonesian tourist destinations as Muslim-friendly tourist destinations. Cash waqf as a means of financing can be used for more than one particular sector and only certain models. Cash waqf can be used as an alternative solution for financing all sectors that support the economy, both for consumptive and productive purposes. The benefits of cash waqf for the productive sector can be realized by increasing community capital in developing their businesses, both for basic business capital and for supporting capital for their businesses. What about the attractive design and appearance of the area surrounding where they are attempting to become a community destination for visiting?

Abstract

As part of its responsibility to address refugee-related issues, Indonesia enacted Presidential Regulation No. 125 of 2016 concerning the Handling of Refugees from Abroad. This study is more in-depth than previous studies because it focuses on more specific legal regulations at the presidential regulation level. This provides the legal basis for the protection of foreign refugees in Indonesia and serves as the official guideline for managing asylum seekers and international refugees. This regulation is more operational, for example, shelter mechanisms such as shelter, accommodation and health and education, as well as basic services, and coordination with UNHCR/IOM, but does not provide formal legal status for refugees. One implementation is the relocation of asylum seekers from Immigration Detention Centers (Rudenim) to temporary shelters, thus enabling the provision of basic needs, which is facilitated and funded by the International Organization for Migration (IOM). The main differences between the international obligations of ratifying conventions and domestic authority through Presidential Regulations lie in their source, binding nature, and implications for the legal status and rights of refugees specifically. This regulation is seen as an alternative to ratifying the 1951 Convention and the 1967 Protocol Relating to the Status of Refugees, which Indonesia has not yet ratified. Presidential Regulation Number 125 of 2016 outlines several important provisions, including key definitions, detention mechanisms, shelter procedures, and protection measures for asylum seekers and refugees. This regulation consists of 45 articles detailing the coordination mechanism between government agencies in managing refugees. Based on Article 2 paragraph (1), the handling of asylum seekers and refugees is carried out through cooperation between the central government and the United Nations (UN).

Abstract

This study aims to comparatively analyze the role of mediators in non-litigation dispute resolution in Indonesia and Thailand and to examine how differences in legal and sociological orientations influence mediation effectiveness. Existing mediation studies predominantly focus on procedural or institutional aspects, leaving a limited understanding of how mediator positioning as legal and social actors affects dispute resolution outcomes. This research employs a normative legal method using statutory and comparative law approaches, supported by the analysis of legislation, legal doctrines, and scholarly literature. The findings reveal that Indonesia adopts a formal and legalistic mediation model in which mediators function as certified facilitators to ensure legal certainty and enforceability, but with relatively limited social acceptance. In contrast, Thailand applies a community-based mediation model that positions mediators as socially legitimate actors capable of fostering trust and voluntary compliance, although with weaker formal legal guarantees. This study contributes to mediation scholarship by conceptualizing mediators as hybrid legal–social institutions whose effectiveness depends on balancing juridical authority and social legitimacy. The findings imply that developing an integrative mediation framework combining legal certainty with sociological legitimacy is essential to strengthen the effectiveness, accessibility, and sustainability of non-litigation dispute resolution systems.
