Abstract

Perlindungan hukum bagi pekerja dalam kasus pailitnya suatu perusahaan merupakan isu krusial, terutama dalam implementasi Undang-Undang No. 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Undang-undang tersebut menjadi landasan hukum terkait prioritas pemenuhan hak-hak pekerja sebagai kreditur preferen. Namun, implementasi perlindungan hukum bagi para pekerja dalam kasus pailitnya suatu perusahaan masih menghadapi berbagai hambatan yang signifikan, seperti ketidakpastian hukum, interpretasi, dan konflik norma lainnya. Hal tersebut menyebabkan pekerja menjadi pihak yang dirugikan dalam proses kepailitan. Untuk meningkatkan efektivitas perlindungan hukum, diperlukan reformasi terhadap regulasi yang ada, termasuk perbaikan mekanisme pembayaran yang lebih adil dan tepat waktu, serta penguatan koordinasi antara pengusaha, pemerintah, dan serikat pekerja. Peningkatan transparansi, pendidikan hukum bagi pekerja, dan pengawasan yang lebih ketat juga diperlukan untuk memastikan hak-hak pekerja dapat terlindungi dengan optimal dalam situasi kepailitan. Legal protection for workers in the case of bankruptcy of a company is a crucial issue, especially in the implementation of Law No. 37 Year 2004 on Bankruptcy and Suspension of Debt Payment Obligations. The law is a legal basis related to the priority of the fulfillment of workers' rights as preferred creditors. However, the implementation of legal protection for workers in the case of bankruptcy of a company still faces significant obstacles, such as legal uncertainty, interpretation, and other norm conflicts. This causes workers to be the disadvantaged party in the bankruptcy process. To improve the effectiveness of legal protection, reforms to existing regulations are needed, including improvements to fairer and more timely payment mechanisms, as well as strengthening coordination between employers, government, and labor unions. Increased transparency, legal education for workers, and stricter supervision are also needed to ensure that workers' rights are optimally protected in bankruptcy situations.

Abstract

Economic exploitation of children is still a serious problem that occurs in various regions, including in Pati Regency, and has a direct impact on the violation of children's rights. This problem is generally triggered by the socio-economic conditions of vulnerable families and low legal awareness of the community, so that children are often used as a means to gain economic benefits. This study aims to analyze law enforcement against the crime of economic exploitation of children in Pati Regency and formulate an integrated handling model in the context of protecting children's constitutional rights. The research method used is sociological juridical with a qualitative approach, through the collection of primary data obtained from the public and law enforcement officials, as well as secondary data sourced from laws and regulations and literature studies. The results of the study show that normatively the legal apparatus for child protection has been adequate, but its implementation at the regional level has not been running optimally. Law enforcement is still dominated by preventive efforts, while repressive actions against exploiters have not been carried out firmly and consistently. The low legal culture of the community is also a factor that inhibits the effectiveness of child protection. This study concludes that it is necessary to strengthen fair law enforcement, increase cross-sector coordination, and build community legal awareness as part of an integrated handling model to suppress the practice of economic exploitation of children and ensure the protection of children's constitutional rights in a sustainable manner.
