Abstract

This study aims to examine and analyze the phenomenon of the Kelakat tradition, which is still controversial because some parties prohibit it because it is contrary to Sharia and has implications for shirk. Kelakat is a tradition in marriage that is often carried out by the majority of the East Loloan village community. It is passed down from generation to generation and is believed to eliminate bad luck, and if the ritual is not carried out, it can cause problems for the bride and groom. This research uses a qualitative method with a case study approach in East Loloan village, the theory used with Maqasid Al-Shari’ah Jasser Auda. The result of this research is that the Kelakat tradition has become a habit that has been attached to the East Loloan community to make it survive amid Muslim communities in East Loloan village and does not conflict with Sharia law because there has been a revolution in its implementation so that it is under the objectives of Sharia.

Abstract

Al-Qur’an adalah kitab yang menjadi pedoman utama umat Islam yang dipercaya senantiasa sesuai dengan setiap watu dan tempat yang melingkupinya. Pembagian waris merupakan hal yang sangat fundamental dalam keluarga dan merupakan salah satu hal yang dibahas di dalam al-Qur’an itu sendiri. Perempuan mendapat bagian setengah dari bagian laki-laki merupakan pandangan pemikir Islam klasik yang didasarkan pada potongan ayat al-Qur’an. Seiring dengan perubahan zaman, maka terjadi banyak perubahan khususnya dalam peran perempuan, hal itu yang kemudian menjadi faktor pemicu adanya gerakan pemikir kontemporer yang menuntut persaman hak antara laki-laki dan perempuan khususnya dalam waris seperti Muhammad Shahrur dengan teori limitnya. Secara praktik sebagain masyarakat desa Kara menerapkan pembagian waris yang didasarkan pada besarnya kontribusi ahli waris terhadap keluarga. Fokus penelitian ini adalah (1) Praktik Konversi Bagian Waris Anak Laki-Laki dan Perempuan di Desa Kara Kecamatan Torjun Kabupaten Sampang Madura (2) Praktik Konversi Bagian Waris Anak Laki-Laki dan Perempuan di Desa Kara Kecamatan Torjun Kabupaten Sampang Madura Perspektif Teori Limit Muhammad Shahrur. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian studi kasus. Teknik pengumpulan data yang digunakan adalah wawancara, observasi dan dokumentasi. Hasil penelitian menyatakan bahwa (1) anak perempuan mendapatkan bagian dua bidang tanah, pohon jati dan bangunan rumah yang jika dikonversi dalam bentuk rupiah bisa dikatakan setara atau bahkan melebihi bagian waris saudara laki-lakinya. (2) Praktik Konversi tersebut secara hasil akhir sesuai dengan konsep teori limit yang digagas oleh Muhammad Shahrur.. Abstract Al-Qur'an is a book that is the main guideline for Muslims which is believed to always be in accordance with every time and place that surrounds it. The division of inheritance is very fundamental in the family and is one of the things discussed in the Qur'an itself. Women get half of the share of men is the view of classical Islamic thinkers based on fragments of verses of the Koran. Along with the changing times, there have been many changes, especially in the role of women, this has become a triggering factor for the movement of contemporary thinkers who demand equal rights between men and women, especially in inheritance like Muhammad Shahrur with his limit theory. In practice, some of the Kara village community applies inheritance distribution based on the contribution of the heirs to the family. The focus of this research is (1) The Practice of Converting the Inheritance of Boys and Girls in Kara Village, Torjun District, Sampang Madura Regency (2) The Practice of Conversion of the Inheritance of Boys and Girls in Kara Village, Torjun District, Sampang Madura Regency Perspective of Muhammad's Limit Theory Shahrur. This study uses a qualitative approach with a case study type of research. Data collection techniques used are interviews, observation and documentation. The results of the study stated that (1) the daughter got a share of two plots of land, teak trees and house buildings which if converted in rupiah could be said to be equal or even exceed her brother's share of inheritance. (2) The conversion practice is in accordance with the concept of limit theory initiated by Muhammad Shahrur.
