Abstract

Legal protection for consumers in e-commerce transactions is crucial for the development of the community's economy. E-commerce transactions are fundamentally the same as conventional transactions, with the primary difference being the medium used. When business actors and consumers enter into an agreement, both parties are bound and have rights and obligations that must be fulfilled. This writing addresses the issue of how legal protection for consumers in e-commerce transactions is reviewed from the Consumer Protection Law and the legal relationship between parties in e-commerce transactions. The method used in this research is normative juridical research. First, consumer protection is regulated in Law No. 8 of 1999 (UUPK). The objectives of the UUPK include increasing awareness, dignity, and honor of consumers, empowering consumers, and creating a consumer protection system that guarantees legal certainty and information transparency. Second, the parties involved in electronic buying and selling transactions include sellers, buyers, banks, and internet service providers. In sales contracts, the parties have different rights and obligations.

Abstract

Dewasa ini pembangunan ekonomi Islam di Indonesia berkembang dengan pesat dimana banyak didirikannya lembaga keuangan yang berdasarkan pada prinsip syariah, salah satunya asuransi syariah. Asuransi syariah menggunakan prinsip saling tolong menolong dengan cara masing-masing menghibahkan dana tabarru’. Teori murni tabarru’ tidak membolehkan adanya penggantian, namun dalam praktiknya, peserta mendapatkan penggembalian dana tabarru’ melalui klaim atau surplus underwriting, sehingga konsep tabarru’ dalam asuransi syariah kehilangan esensi yang memiliki arti tolong menolong. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Jenis penelitiannya adalah penelitian deskriptif. Dari hasil pembahasan bahwa akad yang terdapat dalam asuransi syariah yaitu akad tijarah (investasi) dan akad tabarru’ (tolong menolong), sehingga dalam sistem pengelolaannya dibagi menjadi dua rekening, yaitu dana investasi dan dana hibah. Prinsip tolong menolong ini terda pat dalam akad tabarru’. Pada saat peserta mendapatkan klaim berarti peserta sedang menerima manfaat hibah bukan berarti menarik kembali dana hibah seperti yang dilarang oleh hukum Islam. Apabila tidak terjadi klaim, maka pembagian surplus underwriting dapat dilakukan dengan merujuk pada pendapat Abu Hanifah yang membolehkan penarikan kembali harta hibah selama belum dibalas, sehingga hibah yang terdapat dalam asuransi syariah dikategorikan ke dalam hibah dengan syarat.
