Abstract

Divorce is a complex phenomenon that has a significant impact not only on the couples involved, but also on the family and society at large. This research aims to make a positive contribution as steps to reduce the occurrence of divorce in Pantai Cermin, Serdang Bedagai Regency. The research method used is qualitative research with an empirical juridical approach. Data were collected through observation, interviews and documentation. The results of the study show that there are factors that cause divorce that have been reported at the Religious Court. These causes include poor communication, partner incompatibility, financial pressure, and infidelity. Efforts to reduce the occurrence of divorce are collaborative between BP4, KUA and the Religious Court which is implemented in the form of prevention, socialization and counseling in a planned manner, namely by providing marriage advice and legal consultation with mediation and deliberation as stipulated in KHI Article 36 Paragraph (1) and PMA No. 447 of 2015. Keywords: Collaborative Divorce, Divorce, Serdang Bedagai Perceraian merupakan fenomena kompleks yang memiliki dampak yang signifikan tidak hanya pada pasangan yang terlibat, tetapi juga pada keluarga dan masyarakat secara luas. Penelitian ini bertujuan memberikan kontribusi positif sebagai langkah-langkah untuk mengurangi terjadinya perceraian di Pantai Cermin Kabupaten Serdang Bedagai. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan yuridis empiris. Data dikumpulkan melalui observasi, wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa terdapat faktor-faktor yang menyebabkan terjadinya gugatan perceraian yang telah terlapor di Pengadilan Agama. Penyebab tersebut antara lain komunikasi yang buruk, ketidakcocokan nilai-nilai, tekanan finansial, dan ketidaksetiaan yang berujung pada keinginan untuk bercerai. Implikasi hukum dari temuan ini adalah organisasi BP4 dan KUA berperan penting sebagai upaya kontribusi positif untuk mengurangi dan mencegah terjadinya perceraian di Pantai Cermin Kabupaten Serdang Bedagai. Upaya yang dilakukan merupakan langkah-langkah perceraian kolaboratif dimana kasus perceraian dapat diatasi dengan cara-cara mediasi diantara kedua belah pihak tanpa harus ke pengadilan.

Abstract

Artikel ini bertujuan untuk mengetahui hak konsumen atas informasi produk dalam perspektif hukum dan etika bisnis. Permasalahan difokuskan pada pentingnya penyediaan informasi secara jelas dan akurat pada suatu produk, mengingat hal tersebut merupakan bagian dari tanggung jawab dalam hukum dan dalam etika bisnis. Tulisan ini dianalisis secara kualitatif dengan library research. Kesimpulannya hak konsumen atas informasi produk dalam perspektif hukum adalah hak kenyamanan, keamanan serta keselamatan, hak informasi yang benar, jelas serta jujur, hak didengarkan pendapat dan keluhannya, hak dibela dan dilindungi, hak dibimbingan, hak diperlakukan dengan baik, dan hak memperoleh ganti rugi. Adapun hak konsumen dalam perpektif etika bisnis adalah hak informasi yang transparan dan akurat, hak informasi yang bebas dari manipulasi dan iklan meneyesatkan, hak keterbukaan informasi, dan hak transparansi dalam transaksi bisnis.

Abstract

There are differences in terms of the naming and practice of marriage initiation funds between the Javanese and Sasak tribes. There are different concepts between the two in terms of practice, of course due to the different social and cultural backgrounds between the Javanese and Sasak tribes. The benefits and urgency are the benchmarks for how important it is to do it and become a custom. In this research, the research methodology used is library research and uses a sociological approach to help the author analyze the benefits and urgency of marriage transition funds. The results found that the funds for marriage steps between the Javanese and Sasak tribes had similarities and differences. The similarity is that this is done to honor or respect and ask permission from the sibling being stepped on, and the step can be in the form of money or other objects. Meanwhile, the difference is in practice, in the Javanese tribe, the person who is stepped over is either an unmarried female sibling or male sibling who is given the step, whereas in the Sasak tribe only unmarried older brothers are given the step. The Javanese tribe's step process has more procedures than the Sasak tribe. The Sasak tribe's concept of giving a handover is from the prospective husband to the unmarried brother of the prospective wife, whereas in the Javanese tribe the handover can tend to be from the younger sibling to the sibling's older brother/sister. The benefit and urgency is to respect each other and avoid misunderstandings, as well as carrying out the customs and culture of each tribe so that they are preserved and the stepping goods are only an entertainment for the person who steps over.
