Abstract

Indonesia is a country with various religions that makes influence factors of pluralism. There are many diverse and recognized religions in Indonesia, so this has led to many different religious marriages being proposed in Indonesia. This article is about to discuss the normative juridical analysis of the South Jakarta District Court decision No. 508/Pdt.P/2022/PN JKT. The cell under review also uses an approach to Islamic law and positive law. The writing of this article uses a library research approach by examining journals, theses and other theses related to interfaith marriage. As for the results of this study, according to Islamic law (Al-Qur’an and Madhzab Ulama) interfaith marriage is permitted on condition that the woman is not a polytheist and is a woman of the Bible. According to Positive Law (KHI Article 40 & Article 44 and Law No. 1 of 1974 concerning Marriage Article 2 paragraph 1) it is explained that interfaith marriage is illegal and cannot be carried out by both Muslim men and non-Muslim women. Then according to the MUI Fatwa Number 4/MUNAS VII/MUI/8/2005 the law is haram with the consideration that interfaith marriages cause more mafsada than benefits

Abstract

Pernikahan adalah institusi fundamental dalam masyarakat yang berlandaskan nilai agama dan etika. Pencatatan pernikahan langkah penting untuk memperkuat keabsahan serta kepastian hukum terhadap pernikahan suami - istri. Dalam Islam mengenai maqashid syariah menjadi kerangka teoritis yang mengemukakan maqashid syariah (tujuan utama) dari hukum islam. Pakar ilmuan Islam Kontemporer yang menggagas konsep maqashid syariah adalah Jasser Auda. Tujuan dari penelitian ini adalah untuk menjelaskan dan menyajikan dampak teori sistem Maqashid Syariah Jasser Auda terhadap permasalahan Indonesia saat ini mengenai pencatatan perkawinan yang ditinjau oleh teori sistem Jasser Auda terdiri atas: kognitif (cognitif nature), kemenyeluruhan (wholenes), keterbukaan (openess), hierarki saling berkaitan (interelated hierarchy), multidimensionalitas (multidimensionality) serta kebermaksudan (purposefulness). Hasil penelitian dari aplikasi teori Jasser Auda  yaitu: Kognitif yaitu pencatatan pernikahan hasil dari ijtihad para mujtahid karena tidak ada ayat dalam Al-Quran dan hadist yang menjelaskan terhadap pencatatan pernikahan; kemenyeluruhan yaitu dalam melihat peraturan pencatatan pernikahan diharuskan melihat seluruh peraturan; Keterbukan yaitu pernikahan harus bisa melihat perkembangan Zaman, karena dalam Al-Qur’an dan Hadist tidak menjelaskan pencatatan pernikahan; Hierarki yaitu adanya pencatan pernikahan memberikan keabsahan dan kepastian hukum dalam pernikahan; Multidimensionalitas yaitu memahami aturan pencatatan perkawinan multi perspektif; Kebermaksudan yaitu Adanya peraturan pencatatan perkawinan memberikan kepastian hukum untuk melindungi para pihak yang melangsungkan perkawinan.

Abstract

Natural viralslot disasters at this time occur because of arbitrary human actions. If you look at the various verses of the Al-Qur'an which regulate human actions so that they do not do arbitrary acts and preserve the environment viralslot. In this regard, this research aims to explain how to interpret the verse on environmental sustainability according to M. Quraish Shihab and how to istinbath the law on environmental sustainability issues. This study uses a qualitative research method based on descriptive analysis of the interpretation of M. Quraish Shihab. The data sources consist of primary sources, namely the interpretation of Al-Misbah and secondary sources, namely other relevant books, and the results of previous research. The results of the study reveal that preserving the environment is a human responsibility as part of an ecosystem, which can be explored from the instructions of the Qur'an which are regulated in sura al-'Araf verse 56 and ar-Rum verses 41-42. Preserving nature is important because it is a place to live, a source of sustenance, or a means of upbringing to God. Humans on earth as caliphs are obliged to maintain the balance of the universe that Allah created. Environmental damage factor due to two factors, namely internal factors and external factors. Reflections on Quraish Shihab's thoughts are manifested in living cleanly, not littering, recycling waste, and planting trees for sustainable life viralslot.
