Abstract

The distribution of inheritance by Islamic law is carried out equitably, namely by allocating shares to both males and females. Nevertheless, the current discussion surrounding the allocation of inheritance is facing challenges, particularly about the inequitable division of inheritance, where two males receive twice as much as one female. This disparity is perceived as unjust by certain individuals. Various experts have extensively analyzed both male and female issues. This analysis provides a thorough examination of Muḥammad Shaḥrūr's ideology, focusing on its normative legal aspects, particularly about gender and legal concepts. As per Muḥammad Shaḥrūr, Allah assigns at least fifty percent of a man's share to a woman. This minimum level applies in cases where the mother does not provide any financial support for the family's maintenance. Nevertheless, if women actively participate in creating revenue and contribute to the family's financial support, their share of contribution becomes comparable to that of males. Muḥammad Shaḥrūr contends that both men and women can obtain equal portions of inheritance within the framework of gender and legal principles. However, this equality is dependent on certain conditions and must not violate the specified limits set by Islamic law.

Abstract

This paper aims to find out a conceptual approach to the social safety net in the Qur’an and some essential values that can be realized as role models in contemporary modern life. This study investigates several significant questions, such as how the Qur'an argues for taking sides with the disadvantaged people, and what instruments are outlined by the Qur'an as the main support for the implementation of social safety nets. These questions are approached contextually and critically by examining primary texts, such as verses of the Qur'an that talk about the topic, to be interpreted thematically-contextually. Meanwhile, secondary texts are used as interpretive supports to enrich perspectives in reconstructing and reformulating the idea of a social safety net based on the Qur'anic values. This study concludes; first, even though the Qur’an does not mention explicitly the term social safety net, the teachings of the social safety net are implicitly embodied in the Qur’an. Second, some fundamental instruments in the Qur’an can be realized as supporting systems for social safety nets, such as zakah, kafarat, infaq, sadaqah, qurban, dam and fidyah, fai’, and ghanimah. Third, the Qur’anic concept of social safety net engages with five principles, namely expanse and balance, justice and equity, spirituality and productivity, sustainability and empowerment, and dynamic and systematic. Thus, the concept of the social safety net in the Qur’an is a comprehensive approach, not only for the short term but also for the long term, not only consumptive-giving but also productive-empowering.

Abstract

Indonesian citizens who need marriage registration services abroad do not always get the best service from the Indonesian Representative Office abroad. With this issue, NU provided recommendations in the 33rd NU Mu'tamar to strengthen legal protection for Indonesian workers abroad. This research was conducted to answer questions related to the context in which NU formulated the protection of Indonesian migrant workers and marriage registration for Muslim migrant workers abroad. This research uses normative research with a statutory approach and conceptual approach, so this research is a type of library research. From the results of the 33rd NU Batsul Masail decision on the protection of migrant workers and marriage registration for Muslim migrant workers abroad using the approach of the Fikih rule Qawaid al-Ahkam fi Mashalih al-Anam, where this rule emphasises that on Maslahah mursalah. So it is required for the legislative body to provide more benefits, especially in relation to services for foreign migrant workers who want to register their marriage. This is seen from Law No. 39 of 2004 that has not fully regulated the protection in detail, which results in many violations that occur against migrant workers. Starting from the determination process through TKI service bureaus to placement in the workplace. In addition, Law No. 39 of 2004 does not include matters relating to marriage for overseas workers so that it raises new problems related to the protection of migrant workers, one of which is the problem of marriage registration. Judging from the urgency of marriage registration, it is very necessary to add regulations relating to this matter to Law No. 39 of 2004. With the inclusion of marriage issues in Law No.39 of 2004.

Abstract

This paper aims to provide a comprehensive perspective on strategies for promoting Qur'anic education in the Indonesian context. The study examines the halaqah of the Quran in Mecca and Medina within the strategic framework of the Qur'anic teaching-learning process. The study begins by highlighting the miserable fact that the current young Muslim generation in Indonesia lacks an interest in the Qur'an. This condition leads not only to the absence of Qur'anic spiritual values in their lives but also to the loss of the tradition of studying the Quran in Muslim societies. This research employs a combined research model that involves a literature review and field research. This study concludes by identifying three key strategies for improving Qur'anic education in Indonesia. First, by using a dialogical approach, the tradition of the halaqah of the Qur'an can be employed as a model for developing the tradition of learning the Qur'an in Indonesia. Second, to develop Qur'anic education in Indonesia, three fundamental components are critical, namely: developing learning spirit and motivation; extending time flexibility and learning innovation; and achieving external support. Third, the learning steps are addressed systematically as part of the integrated contextual learning approach. It covers facilitating a collaborative, supportive, and interactive learning environment. By integrating these elements, it is hoped that Qur'anic education in Indonesia can develop properly and reach a high level of productivity.

Abstract

In the face of growing social inequalities and marginalization in the modern Muslim world, Qur’anic interpretation is increasingly called upon to address real-world injustices. Surah Al-Anfal verse 26 highlights the early Muslims' experience of oppression, fear, and poverty, followed by divine empowerment. This verse offers a theological entry point for rethinking the Qur’an’s role in social transformation. This study aims to reinterpret Al-Anfal:26 through the lens of Hasan Hanafi’s critical-emancipatory hermeneutics, which views revelation not merely as normative doctrine but as a call to action for liberation and justice. The research adopts Hanafi’s three-stage hermeneutical method: (1) historical awareness—understanding the socio-political context of the verse; (2) eidetic analysis—extracting its essential ethical meaning; and (3) practical engagement—applying its message to contemporary struggles. The findings show that when interpreted through this gacor777 framework, the verse becomes a powerful call for solidarity with the oppressed and for active resistance against systemic injustice. It encourages Muslims to see the Qur'an as a living, historical text that responds to human suffering with moral urgency. This study concludes that Surah Al-Anfal:26 provides not only historical insight but also a theological foundation for Islamic liberation theology. The research contributes to contemporary Qur’anic studies by demonstrating how contextual hermeneutics can make sacred texts more responsive to the ethical and political demands of the present.

Abstract

The moral decline in the modern era presents a serious challenge to Islamic education, particularly in shaping strong spiritual character towards Allah SWT. Qur’anic verse QS. Al-Baqarah:186 conveys the message of divine closeness that holds deep relevance for moral development. This study aims to analyze the verse using Emilio Betti’s hermeneutic approach to uncover the moral education dimension from historical, linguistic, and contextual perspectives. The research applies a qualitative-descriptive method through textual and philosophical-hermeneutic analysis. The findings reveal that the verse contains not only theological meaning but also universal ethical messages such as spiritual optimism and slot thailand obedience to divine commands. Through Betti’s approach, the study finds that the objective meaning structure of the verse is both transhistorical and contextual. This research offers a synthesis between classical Qur’anic exegesis and modern hermeneutics, contributing practical insights for developing Islamic moral education curricula that are integrative and responsive to contemporary moral challenges.

Abstract

Pernikahan adalah institusi fundamental dalam masyarakat yang berlandaskan nilai agama dan etika. Pencatatan pernikahan langkah penting untuk memperkuat keabsahan serta kepastian hukum terhadap pernikahan suami - istri. Dalam Islam mengenai maqashid syariah menjadi kerangka teoritis yang mengemukakan maqashid syariah (tujuan utama) dari hukum islam. Pakar ilmuan Islam Kontemporer yang menggagas konsep maqashid syariah adalah Jasser Auda. Tujuan dari penelitian ini adalah untuk menjelaskan dan menyajikan dampak teori sistem Maqashid Syariah Jasser Auda terhadap permasalahan Indonesia saat ini mengenai pencatatan perkawinan yang ditinjau oleh teori sistem Jasser Auda terdiri atas: kognitif (cognitif nature), kemenyeluruhan (wholenes), keterbukaan (openess), hierarki saling berkaitan (interelated hierarchy), multidimensionalitas (multidimensionality) serta kebermaksudan (purposefulness). Hasil penelitian dari aplikasi teori Jasser Auda  yaitu: Kognitif yaitu pencatatan pernikahan hasil dari ijtihad para mujtahid karena tidak ada ayat dalam Al-Quran dan hadist yang menjelaskan terhadap pencatatan pernikahan; kemenyeluruhan yaitu dalam melihat peraturan pencatatan pernikahan diharuskan melihat seluruh peraturan; Keterbukan yaitu pernikahan harus bisa melihat perkembangan Zaman, karena dalam Al-Qur’an dan Hadist tidak menjelaskan pencatatan pernikahan; Hierarki yaitu adanya pencatan pernikahan memberikan keabsahan dan kepastian hukum dalam pernikahan; Multidimensionalitas yaitu memahami aturan pencatatan perkawinan multi perspektif; Kebermaksudan yaitu Adanya peraturan pencatatan perkawinan memberikan kepastian hukum untuk melindungi para pihak yang melangsungkan perkawinan.

Abstract

This article explores the Islamic legal perspective on the use of contraceptives, particularly through the lens of Ahkamul Fuqoha and the decisions of Nahdlatul Ulama’s Legal Advisory Council (LBM NU). Employing a qualitative method with a normative-theological approach, this study is based on comprehensive literature analysis. The findings indicate that LBM NU formulates legal rulings on contraception using a collective ijtihad (istinbath jama’i) methodology grounded in the objectives of Islamic law (maqashid al-shari’ah). Contraceptive use is considered permissible (mubah) if not permanent and aimed at protecting health, family welfare, and adhering to Islamic ethical guidelines. This reflects the adaptive nature of Islamic jurisprudence in addressing contemporary social challenges in Indonesian Muslim society.
